L. 119–26, § 6(c), July 16, 2025, 139 Stat. 417.)","seq_in_title":487,"parent_identifier":"/us/usc/t21/ch13/schI/ptA","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13","level":"chapter","num":"CHAPTER 13—","heading":"DRUG ABUSE PREVENTION AND CONTROL","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"CONTROL AND ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13/schI/ptA","level":"part","num":"Part A—","heading":"Introductory Provisions","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id0daac642-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802\"><num value=\"802\">§ 802.</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">As used in this subchapter:</chapeau><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac643-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/1\"><num value=\"1\">(1)</num><content> The term “addict” means any individual who habitually uses any narcotic drug so as to endanger the public morals, health, safety, or welfare, or who is so far addicted to the use of narcotic drugs as to have lost the power of self-control with reference to his addiction.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac644-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/2\"><num value=\"2\">(2)</num><chapeau> The term “administer” refers to the direct application of a controlled substance to the body of a patient or research subject by—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac645-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/2/A\"><num value=\"A\">(A)</num><content> a practitioner (or, in his presence, by his authorized agent), or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac646-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/2/B\"><num value=\"B\">(B)</num><content> the patient or research subject at the direction and in the presence of the practitioner,</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">whether such application be by injection, inhalation, ingestion, or any other means.</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac647-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/3\"><num value=\"3\">(3)</num><content> The term “agent” means an authorized person who acts on behalf of or at the direction of a manufacturer, distributor, or dispenser; except that such term does not include a common or contract carrier, public warehouseman, or employee of the carrier or warehouseman, when acting in the usual and lawful course of the carrier’s or warehouseman’s business.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac648-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/4\"><num value=\"4\">(4)</num><content> The term “Drug Enforcement Administration” means the Drug Enforcement Administration in the Department of Justice.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac649-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/5\"><num value=\"5\">(5)</num><content> The term “control” means to add a drug or other substance, or immediate precursor, to a schedule under part B of this subchapter, whether by transfer from another schedule or otherwise.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac64a-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/6\"><num value=\"6\">(6)</num><content> The term “controlled substance” means a drug or other substance, or immediate precursor, included in schedule I, II, III, IV, or V of part B of this subchapter. The term does not include distilled spirits, wine, malt beverages, or tobacco, as those terms are defined or used in subtitle E of the Internal Revenue Code of 1986.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac64b-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/7\"><num value=\"7\">(7)</num><content> The term “counterfeit substance” means a controlled substance which, or the container or labeling of which, without authorization, bears the trademark, trade name, or other identifying mark, imprint, number, or device, or any likeness thereof, of a manufacturer, distributor, or dispenser other than the person or persons who in fact manufactured, distributed, or dispensed such substance and which thereby falsely purports or is represented to be the product of, or to have been distributed by, such other manufacturer, distributor, or dispenser.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac64c-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/8\"><num value=\"8\">(8)</num><content> The terms “deliver” or “delivery” mean the actual, constructive, or attempted transfer of a controlled substance or a listed chemical, whether or not there exists an agency relationship.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac64d-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/9\"><num value=\"9\">(9)</num><chapeau> The term “depressant or stimulant substance” means—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac64e-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/9/A\"><num value=\"A\">(A)</num><content> a drug which contains any quantity of barbituric acid or any of the salts of barbituric acid; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac64f-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/9/B\"><num value=\"B\">(B)</num><content> a drug which contains any quantity of (i) amphetamine or any of its optical isomers; (ii) any salt of amphetamine or any salt of an optical isomer of amphetamine; or (iii) any substance which the Attorney General, after investigation, has found to be, and by regulation designated as, habit forming because of its stimulant effect on the central nervous system; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac650-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/9/C\"><num value=\"C\">(C)</num><content> lysergic acid diethylamide; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac651-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/9/D\"><num value=\"D\">(D)</num><content> any drug which contains any quantity of a substance which the Attorney General, after investigation, has found to have, and by regulation designated as having, a potential for abuse because of its depressant or stimulant effect on the central nervous system or its hallucinogenic effect.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac652-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/10\"><num value=\"10\">(10)</num><content> The term “dispense” means to deliver a controlled substance to an ultimate user or research subject by, or pursuant to the lawful order of, a practitioner, including the prescribing and administering of a controlled substance and the packaging, labeling or compounding necessary to prepare the substance for such delivery. The term “dispenser” means a practitioner who so delivers a controlled substance to an ultimate user or research subject.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac653-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/11\"><num value=\"11\">(11)</num><content> The term “distribute” means to deliver (other than by administering or dispensing) a controlled substance or a listed chemical. The term “distributor” means a person who so delivers a controlled substance or a listed chemical.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac654-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/12\"><num value=\"12\">(12)</num><content> The term “drug” has the meaning given that term by <ref href=\"/us/usc/t21/s321/g/1\">section 321(g)(1) of this title</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac655-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/13\"><num value=\"13\">(13)</num><content> The term “felony” means any Federal or State offense classified by applicable Federal or State law as a felony.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac656-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/14\"><num value=\"14\">(14)</num><content> The term “isomer” means the optical isomer, except as used in schedule I(c) and schedule II(a)(4). As used in schedule I(c), the term “isomer” means any optical, positional, or geometric isomer. As used in schedule II(a)(4), the term “isomer” means any optical or geometric isomer.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac657-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/15\"><num value=\"15\">(15)</num><content> The term “manufacture” means the production, preparation, propagation, compounding, or processing of a drug or other substance, either directly or indirectly or by extraction from substances of natural origin, or independently by means of chemical synthesis or by a combination of extraction and chemical synthesis, and includes any packaging or repackaging of such substance or labeling or relabeling of its container; except that such term does not include the preparation, compounding, packaging, or labeling of a drug or other substance in conformity with applicable State or local law by a practitioner as an incident to his administration or dispensing of such drug or substance in the course of his professional practice. The term “manufacturer” means a person who manufactures a drug or other substance.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac658-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/16\"><num value=\"16\">(16)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac659-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/16/A\"><num value=\"A\">(A)</num><content> Subject to subparagraph (B), the terms “marihuana” and “marijuana” mean all parts of the plant Cannabis sativa L., whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture, or preparation of such plant, its seeds or resin.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac65a-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/16/B\"><num value=\"B\">(B)</num><chapeau> The terms “marihuana” and “marijuana” do not include—</chapeau><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac65b-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/16/B/i\"><num value=\"i\">(i)</num><content> hemp, as defined in section 1639<i>o</i> of title 7; or</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac65c-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/16/B/ii\"><num value=\"ii\">(ii)</num><content> the mature stalks of such plant, fiber produced from such stalks, oil or cake made from the seeds of such plant, any other compound, manufacture, salt, derivative, mixture, or preparation of such mature stalks (except the resin extracted therefrom), fiber, oil, or cake, or the sterilized seed of such plant which is incapable of germination.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac65d-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/17\"><num value=\"17\">(17)</num><chapeau> The term “narcotic drug” means any of the following whether produced directly or indirectly by extraction from substances of vegetable origin, or independently by means of chemical synthesis, or by a combination of extraction and chemical synthesis:</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac65e-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/17/A\"><num value=\"A\">(A)</num><content> Opium, opiates, derivatives of opium and opiates, including their isomers, esters, ethers, salts, and salts of isomers, esters, and ethers, whenever the existence of such isomers, esters, ethers, and salts is possible within the specific chemical designation. Such term does not include the isoquinoline alkaloids of opium.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac65f-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/17/B\"><num value=\"B\">(B)</num><content> Poppy straw and concentrate of poppy straw.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac660-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/17/C\"><num value=\"C\">(C)</num><content> Coca leaves, except coca leaves and extracts of coca leaves from which cocaine, ecgonine, and derivatives of ecgonine or their salts have been removed.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac661-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/17/D\"><num value=\"D\">(D)</num><content> Cocaine, its salts, optical and geometric isomers, and salts of isomers.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac662-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/17/E\"><num value=\"E\">(E)</num><content> Ecgonine, its derivatives, their salts, isomers, and salts of isomers.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac663-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/17/F\"><num value=\"F\">(F)</num><content> Any compound, mixture, or preparation which contains any quantity of any of the substances referred to in subparagraphs (A) through (E).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac664-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/18\"><num value=\"18\">(18)</num><content> The term “opiate” or “opioid” means any drug or other substance having an addiction-forming or addiction-sustaining liability similar to morphine or being capable of conversion into a drug having such addiction-forming or addiction-sustaining liability.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac665-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/19\"><num value=\"19\">(19)</num><content> The term “opium poppy” means the plant of the species Papaver somniferum L., except the seed thereof.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac666-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/20\"><num value=\"20\">(20)</num><content> The term “poppy straw” means all parts, except the seeds, of the opium poppy, after mowing.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac667-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/21\"><num value=\"21\">(21)</num><content> The term “practitioner” means a physician, dentist, veterinarian, scientific investigator, pharmacy, hospital, or other person licensed, registered, or otherwise permitted, by the United States or the jurisdiction in which he practices or does research, to distribute, dispense, conduct research with respect to, administer, or use in teaching or chemical analysis, a controlled substance in the course of professional practice or research.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac668-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/22\"><num value=\"22\">(22)</num><content> The term “production” includes the manufacture, planting, cultivation, growing, or harvesting of a controlled substance.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac669-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/23\"><num value=\"23\">(23)</num><chapeau> The term “immediate precursor” means a substance—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac66a-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/23/A\"><num value=\"A\">(A)</num><content> which the Attorney General has found to be and by regulation designated as being the principal compound used, or produced primarily for use, in the manufacture of a controlled substance;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac66b-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/23/B\"><num value=\"B\">(B)</num><content> which is an immediate chemical intermediary used or likely to be used in the manufacture of such controlled substance; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac66c-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/23/C\"><num value=\"C\">(C)</num><content> the control of which is necessary to prevent, curtail, or limit the manufacture of such controlled substance.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac66d-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/24\"><num value=\"24\">(24)</num><content> The term “Secretary”, unless the context otherwise indicates, means the Secretary of Health and Human Services.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac66e-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/25\"><num value=\"25\">(25)</num><chapeau> The term “serious bodily injury” means bodily injury which involves—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac66f-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/25/A\"><num value=\"A\">(A)</num><content> a substantial risk of death;</content>\n</subparagraph>\n<subparagraph or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac671-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/25/C\"><num value=\"C\">(C)</num><content> protracted loss or impairment of the function of a bodily member, organ, or mental faculty.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac672-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/26\"><num value=\"26\">(26)</num><content> The term “State” means a State of the United States, the District of Columbia, and any commonwealth, territory, or possession of the United States.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac673-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/27\"><num value=\"27\">(27)</num><content> The term “ultimate user” means a person who has lawfully obtained, and who possesses, a controlled substance for his own use or for the use of a member of his household or for an animal owned by him or by a member of his household.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac674-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/28\"><num value=\"28\">(28)</num><content> The term “United States”, when used in a geographic sense, means all places and waters, continental or insular, subject to the jurisdiction of the United States.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac675-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/29\"><num value=\"29\">(29)</num><content> The term “maintenance treatment” means the dispensing, for a period in excess of twenty-one days, of a narcotic drug in the treatment of an individual for dependence upon heroin or other morphine-like drugs.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac676-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/30\"><num value=\"30\">(30)</num><content> The term “detoxification treatment” means the dispensing, for a period not in excess of one hundred and eighty days, of a narcotic drug in decreasing doses to an individual in order to alleviate adverse physiological or psychological effects incident to withdrawal from the continuous or sustained use of a narcotic drug and as a method of bringing the individual to a narcotic drug-free state within such period.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac677-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/31\"><num value=\"31\">(31)</num><content> The term “Convention on Psychotropic Substances” means the Convention on Psychotropic Substances signed at Vienna, Austria, on <date date=\"1971-02-21\">February 21, 1971</date>; and the term “Single Convention on Narcotic Drugs” means the Single Convention on Narcotic Drugs signed at New York, New York, on <date date=\"1961-03-30\">March 30, 1961</date>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac678-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/32\"><num value=\"32\">(32)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac679-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/32/A\"><num value=\"A\">(A)</num><chapeau> Except as provided in subparagraph (C), the term “controlled substance analogue” means a substance—</chapeau><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac67a-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/32/A/i\"><num value=\"i\">(i)</num><content> the chemical structure of which is substantially similar to the chemical structure of a controlled substance in schedule I or II;</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac67b-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/32/A/ii\"><num value=\"ii\">(ii)</num><content> which has a stimulant, depressant, or hallucinogenic effect on the central nervous system that is substantially similar to or greater than the stimulant, depressant, or hallucinogenic effect on the central nervous system of a controlled substance in schedule I or II; or</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac67c-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/32/A/iii\"><num value=\"iii\">(iii)</num><content> with respect to a particular person, which such person represents or intends to have a stimulant, depressant, or hallucinogenic effect on the central nervous system that is substantially similar to or greater than the stimulant, depressant, or hallucinogenic effect on the central nervous system of a controlled substance in schedule I or II.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac67d-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/32/B\"><num value=\"B\">(B)</num><content> The designation of gamma butyrolactone or any other chemical as a listed chemical pursuant to paragraph (34) or (35) does not preclude a finding pursuant to subparagraph (A) of this paragraph that the chemical is a controlled substance analogue.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac67e-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/32/C\"><num value=\"C\">(C)</num><chapeau> Such term does not include—</chapeau><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac67f-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/32/C/i\"><num value=\"i\">(i)</num><content> a controlled substance;</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac680-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/32/C/ii\"><num value=\"ii\">(ii)</num><content> any substance for which there is an approved new drug application;</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac681-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/32/C/iii\"><num value=\"iii\">(iii)</num><content> with respect to a particular person any substance, if an exemption is in effect for investigational use, for that person, under <ref href=\"/us/usc/t21/s355\">section 355 of this title</ref> to the extent conduct with respect to such substance is pursuant to such exemption; or</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac682-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/32/C/iv\"><num value=\"iv\">(iv)</num><content> any substance to the extent not intended for human consumption before such an exemption takes effect with respect to that substance.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac683-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/33\"><num value=\"33\">(33)</num><content> The term “listed chemical” means any list I chemical or any list II chemical.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac684-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/34\"><num value=\"34\">(34)</num><chapeau> The term “list I chemical” means a chemical specified by regulation of the Attorney General as a chemical that is used in manufacturing a controlled substance in violation of this subchapter and is important to the manufacture of the controlled substances, and such term includes (until otherwise specified by regulation of the Attorney General, as considered appropriate by the Attorney General or upon petition to the Attorney General by any person) the following:</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" href=\"/us/usc/t21/s830\">section 830 of this title</ref>;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac6b0-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/39/A/iii\"><num value=\"iii\">(iii)</num><content> any category of transaction or any category of transaction for a specific listed chemical or chemicals specified by regulation of the Attorney General as excluded from this definition as unnecessary for enforcement of this subchapter or subchapter II;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac6b1-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/39/A/iv\"><num value=\"iv\">(iv)</num><chapeau> any transaction in a listed chemical that is contained in a drug that may be marketed or distributed lawfully in the United States under the Federal Food, Drug, and Cosmetic Act [<ref href=\"/us/usc/t21/s301\">21 U.S.C. 301</ref> et seq.], subject to clause (v), unless—</chapeau><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id0daac6b2-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/39/A/iv/I\"><num value=\"I\">(I)</num><content> the Attorney General has determined under <ref href=\"/us/usc/t21/s814\">section 814 of this title</ref> that the drug or group of drugs is being diverted to obtain the listed chemical for use in the illicit production of a controlled substance; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id0daac6b3-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/39/A/iv/II\"><num value=\"II\">(II)</num><content> the quantity of the listed chemical contained in the drug included in the transaction or multiple transactions equals or exceeds the threshold established for that chemical by the Attorney General;</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac6b4-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/39/A/v\"><num value=\"v\">(v)</num><content> any transaction in a scheduled listed chemical product that is a sale at retail by a regulated seller or a distributor required to submit reports under <ref href=\"/us/usc/t21/s830/b/3\">section 830(b)(3) of this title</ref>; or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac6b5-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/39/A/vi\"><num value=\"vi\">(vi)</num><content> any transaction in a chemical mixture which the Attorney General has by regulation designated as exempt from the application of this subchapter and subchapter II based on a finding that the mixture is formulated in such a way that it cannot be easily used in the illicit production of a controlled substance and that the listed chemical or chemicals contained in the mixture cannot be readily recovered; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac6b6-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/39/B\"><num value=\"B\">(B)</num><content> a distribution, importation, or exportation of a tableting machine or encapsulating machine.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac6b7-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/40\"><num value=\"40\">(40)</num><content> The term “chemical mixture” means a combination of two or more chemical substances, at least one of which is not a list I chemical or a list II chemical, except that such term does not include any combination of a list I chemical or a list II chemical with another chemical that is present solely as an impurity.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac6b8-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/41\"><num value=\"41\">(41)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac6b9-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/41/A\"><num value=\"A\">(A)</num><chapeau> The term “anabolic steroid” means any drug or hormonal substance, chemically and pharmacologically related to testosterone (other than estrogens, progestins, corticosteroids, and dehydroepiandrosterone), and includes—</chapeau><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac6ba-66fd-11f0-b5e6-b887b5797a43\" paragraph.</content>\n</clause>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">The substances excluded under this subparagraph may at any time be scheduled by the Attorney General in accordance with the authority and requirements of subsections (a) through (c) of <ref href=\"/us/usc/t21/s811\">section 811 of this title</ref>.</continuation>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac714-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/41/B\"><num value=\"B\">(B)</num><clause style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac715-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/41/B/i\"><num value=\"i\">(i)</num><content> Except as provided in clause (ii), such term does not include an anabolic steroid which is expressly intended for administration through implants to cattle or other nonhuman species and which has been approved by the Secretary of Health and Human Services for such administration.</content>\n</clause>\n<clause style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac716-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/41/B/ii\"><num value=\"ii\">(ii)</num><content> If any person prescribes, dispenses, or distributes such steroid for human use, such person shall be considered to have prescribed, dispensed, or distributed an anabolic steroid within the meaning of subparagraph (A).</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac717-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/41/C\"><num value=\"C\">(C)</num><clause style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac718-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/41/C/i\"><num value=\"i\">(i)</num><chapeau> Subject to clause (ii), a drug or hormonal substance (other than estrogens, progestins, corticosteroids, and dehydroepiandrosterone) that is not listed in subparagraph (A) and is derived from, or has a chemical structure substantially similar to, 1 or more anabolic steroids listed in subparagraph (A) shall be considered to be an anabolic steroid for purposes of this chapter if—</chapeau><subclause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac719-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/41/C/i/I\"><num value=\"I\">(I)</num><chapeau> the drug or substance has been created or manufactured with the intent of producing a drug or other substance that either—</chapeau><item style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac71a-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/41/C/i/I/aa\"><num value=\"aa\">(aa)</num><content> promotes muscle growth; or</content>\n</item>\n<item style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac71b-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/41/C/i/I/bb\"><num value=\"bb\">(bb)</num><content> otherwise causes a pharmacological effect similar to that of testosterone; or</content>\n</item>\n</subclause>\n<subclause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac71c-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/41/C/i/II\"><num value=\"II\">(II)</num><content> the drug or substance has been, or is intended to be, marketed or otherwise promoted in any manner suggesting that consuming it will promote muscle growth or any other pharmacological effect similar to that of testosterone.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac71d-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/41/C/ii\"><num value=\"ii\">(ii)</num><chapeau> A substance shall not be considered to be a drug or hormonal substance for purposes of this subparagraph if it—</chapeau><subclause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac71e-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/41/C/ii/I\"><num value=\"I\">(I)</num><chapeau> is—</chapeau><item style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac71f-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/41/C/ii/I/aa\"><num value=\"aa\">(aa)</num><content> an herb or other botanical;</content>\n</item>\n<item style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac720-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/41/C/ii/I/bb\"><num value=\"bb\">(bb)</num><content> a concentrate, metabolite, or extract of, or a constituent isolated directly from, an herb or other botanical; or</content>\n</item>\n<item style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac721-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/41/C/ii/I/cc\"><num value=\"cc\">(cc)</num><content> a combination of 2 or more substances described in item (aa) or (bb);</content>\n</item>\n</subclause>\n<subclause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac722-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/41/C/ii/II\"><num value=\"II\">(II)</num><content> is a dietary ingredient for purposes of the Federal Food, Drug, and Cosmetic Act (<ref href=\"/us/usc/t21/s301\">21 U.S.C. 301</ref> et seq.); and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac723-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/41/C/ii/III\"><num value=\"III\">(III)</num><content> is not anabolic or androgenic.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac724-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/41/C/iii\"><num value=\"iii\">(iii)</num><content> In accordance with <ref href=\"/us/usc/t21/s885/a\">section 885(a) of this title</ref>, any person claiming the benefit of an exemption or exception under clause (ii) shall bear the burden of going forward with the evidence with respect to such exemption or exception.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac725-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/42\"><num value=\"42\">(42)</num><content> The term “international transaction” means a transaction involving the shipment of a listed chemical across an international border (other than a United States border) in which a broker or trader located in the United States participates.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac726-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/43\"><num value=\"43\">(43)</num><chapeau> The terms “broker” and “trader” mean a person that assists in arranging an international transaction in a listed chemical by—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac727-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/43/A\"><num value=\"A\">(A)</num><content> negotiating contracts;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac728-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/43/B\"><num value=\"B\">(B)</num><content> serving as an agent or intermediary; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac729-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/43/C\"><num value=\"C\">(C)</num><content> bringing together a buyer and seller, a buyer and transporter, or a seller and transporter.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac72a-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/44\"><num value=\"44\">(44)</num><content> The term “felony drug offense” means an offense that is punishable by imprisonment for more than one year under any law of the United States or of a State or foreign country that prohibits or restricts conduct relating to narcotic drugs, marihuana, anabolic steroids, or depressant or stimulant substances.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac72b-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/45\"><num value=\"45\">(45)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac72c-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/45/A\"><num value=\"A\">(A)</num><chapeau> The term “scheduled listed chemical product” means, subject to subparagraph (B), a product that—</chapeau><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac72d-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/45/A/i\"><num value=\"i\">(i)</num><content> contains ephedrine, pseudoephedrine, or phenylpropanolamine; and</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac72e-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/45/A/ii\"><num value=\"ii\">(ii)</num><content> may be marketed or distributed lawfully in the United States under the Federal, Food, Drug, and Cosmetic Act [<ref href=\"/us/usc/t21/s301\">21 U.S.C. 301</ref> et seq.] as a nonprescription drug.</content>\n</clause>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">Each reference in clause (i) to ephedrine, pseudoephedrine, or phenylpropanolamine includes each of the salts, optical isomers, and salts of optical isomers of such chemical.</continuation>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac72f-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/45/B\"><num value=\"B\">(B)</num><content> Such term does not include a product described in subparagraph (A) if the product contains a chemical specified in such subparagraph that the Attorney General has under <ref href=\"/us/usc/t21/s811/a\">section 811(a) of this title</ref> added to any of the schedules under <ref href=\"/us/usc/t21/s812/c\">section 812(c) of this title</ref>. In the absence of such scheduling by the Attorney General, a chemical specified in such subparagraph may not be considered to be a controlled substance.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac730-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/46\"><num value=\"46\">(46)</num><content> The term “regulated seller” means a retail distributor (including a pharmacy or a mobile retail vendor), except that such term does not include an employee or agent of such distributor.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac731-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/47\"><num one location to another, whether the stand is located within or on the premises of a fixed facility (such as a kiosk at a shopping center or an airport) or whether the stand is located on unimproved real estate (such as a lot or field leased for retail purposes).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac732-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/48\"><num value=\"48\">(48)</num><content> The term “at retail”, with respect to the sale or purchase of a scheduled listed chemical product, means a sale or purchase for personal use, respectively.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac733-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/49\"><num value=\"49\">(49)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac734-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/49/A\"><num value=\"A\">(A)</num><content> The term “retail distributor” means a grocery store, general merchandise store, drug store, or other entity or person whose activities as a distributor relating to ephedrine, pseudoephedrine, or phenylpropanolamine products are limited almost exclusively to sales for personal use, both in number of sales and volume of sales, either directly to walk-in customers or in face-to-face transactions by direct sales.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac735-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/49/B\"><num value=\"B\">(B)</num><chapeau> For purposes of this paragraph, entities are defined by reference to the Standard Industrial Classification (SIC) code, as follows:</chapeau><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac736-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/49/B/i\"><num value=\"i\">(i)</num><content> A grocery store is an entity within SIC code 5411.</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac737-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/49/B/ii\"><num value=\"ii\">(ii)</num><content> A general merchandise store is an entity within SIC codes 5300 through 5399 and 5499.</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac738-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/49/B/iii\"><num value=\"iii\">(iii)</num><content> A drug store is an entity within SIC code 5912.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac739-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/50\"><num value=\"50\">(50)</num><content> The term “Internet” means collectively the myriad of computer and telecommunications facilities, including equipment and operating software, which comprise the interconnected worldwide network of networks that employ the Transmission Control Protocol/Internet Protocol, or any predecessor or successor protocol to such protocol, to communicate information of all kinds by wire or radio.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac73a-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/51\"><num value=\"51\">(51)</num><content> The term “deliver, distribute, or dispense by means of the Internet” refers, respectively, to any delivery, distribution, or dispensing of a controlled substance that is caused or facilitated by means of the Internet.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac73b-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/52\"><num value=\"52\">(52)</num><chapeau> The term “online pharmacy”—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac73c-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/52/A\"><num value=\"A\">(A)</num><content> means a person, entity, or Internet site, whether in the United States or abroad, that knowingly or intentionally delivers, distributes, or dispenses, or offers or attempts to deliver, distribute, or dispense, a controlled substance by means of the Internet; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac73d-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/52/B\"><num value=\"B\">(B)</num><chapeau> does not include—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac73e-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/52/B/i\"><num value=\"i\">(i)</num><content> manufacturers or distributors registered under subsection (a), (b), (e), or (f) of <ref href=\"/us/usc/t21/s823\">section 823 of this title</ref> who do not dispense controlled substances to an unregistered individual or entity;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac73f-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/52/B/ii\"><num value=\"ii\">(ii)</num><content> nonpharmacy practitioners who are registered under <ref href=\"/us/usc/t21/s823/g\">section 823(g) of this title</ref> and whose activities are authorized by that registration;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac740-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/52/B/iii\"><num value=\"iii\">(iii)</num><content> any hospital or other medical facility that is operated by an agency of the United States (including the Armed Forces), provided such hospital or other facility is registered under <ref href=\"/us/usc/t21/s823/g\">section 823(g) of this title</ref>;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac741-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/52/B/iv\"><num value=\"iv\">(iv)</num><content> a health care facility owned or operated by an Indian tribe or tribal organization, only to the extent such facility is carrying out a contract or compact under the Indian Self-Determination and Education Assistance Act [<ref href=\"/us/usc/t25/s5301\">25 U.S.C. 5301</ref> et seq.];</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac742-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/52/B/v\"><num value=\"v\">(v)</num><content> any agent or employee of any hospital or facility referred to in clause (iii) or (iv), provided such agent or employee is lawfully acting in the usual course of business or employment, and within the scope of the official duties of such agent or employee, with such hospital or facility, and, with respect to agents or employees of health care facilities specified in clause (iv), only to the extent such individuals are furnishing services pursuant to the contracts or compacts described in such clause;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac743-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/52/B/vi\"><num value=\"vi\">(vi)</num><content> mere advertisements that do not attempt to facilitate an actual transaction involving a controlled substance;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac744-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/52/B/vii\"><num value=\"vii\">(vii)</num><content> a person, entity, or Internet site that is not in the United States and does not facilitate the delivery, distribution, or dispensing of a controlled substance by means of the Internet to any person in the United States;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac745-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/52/B/viii\"><num value=\"viii\">(viii)</num><chapeau> a pharmacy registered under <ref href=\"/us/usc/t21/s823/g\">section 823(g) of this title</ref> whose dispensing of controlled substances via the Internet consists solely of—</chapeau><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id0daac746-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/52/B/viii/I\"><num value=\"I\">(I)</num><content> refilling prescriptions for controlled substances in schedule III, IV, or V, as defined in paragraph (55); or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id0daac747-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/52/B/viii/II\"><num value=\"II\">(II)</num><content> filling new prescriptions for controlled substances in schedule III, IV, or V, as defined in paragraph (56); or</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac748-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/52/B/ix\"><num value=\"ix\">(ix)</num><content> any other persons for whom the Attorney General and the Secretary have jointly, by regulation, found it to be consistent with effective controls against diversion and otherwise consistent with the public health and safety to exempt from the definition of an “online pharmacy”.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac749-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/53\"><num value=\"53\">(53)</num><content> The term “homepage” means the opening or main page or screen of the website of an online pharmacy that is viewable on the Internet.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac74a-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54\"><num value=\"54\">(54)</num><chapeau> The term “practice of telemedicine” means, for purposes of this subchapter, the practice of medicine in accordance with applicable Federal and State laws by a practitioner (other than a pharmacist) who is at a location remote from the patient and is communicating with the patient, or health care professional who is treating the patient, using a telecommunications system referred to in <ref href=\"/us/usc/t42/s1395m/m\">section 1395m(m) of title 42</ref>, which practice—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac74b-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/A\"><num value=\"A\">(A)</num><chapeau> is being conducted—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac74c-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/A/i\"><num value=\"i\">(i)</num><content> while the patient is being treated by, and physically located in, a hospital or clinic registered under <ref href=\"/us/usc/t21/s823/g\">section 823(g) of this title</ref>; and</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac74d-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/A/ii\"><num value=\"ii\">(ii)</num><chapeau> by a practitioner—</chapeau><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id0daac74e-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/A/ii/I\"><num value=\"I\">(I)</num><content> acting in the usual course of professional practice;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id0daac74f-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/A/ii/II\"><num value=\"II\">(II)</num><content> acting in accordance with applicable State law; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id0daac750-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/A/ii/III\"><num value=\"III\">(III)</num><chapeau> registered under <ref href=\"/us/usc/t21/s823/g\">section 823(g) of this title</ref> in the State in which the patient is located, unless the practitioner—</chapeau><item style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id0daac751-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/A/ii/III/aa\"><num value=\"aa\">(aa)</num><content> is exempted from such registration in all States under <ref href=\"/us/usc/t21/s822/d\">section 822(d) of this title</ref>; or</content>\n</item>\n<item style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id0daac752-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/A/ii/III/bb\"><num value=\"bb\">(bb)</num><chapeau> is—</chapeau><subitem style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id0daac753-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/A/ii/III/bb/AA\"><num value=\"AA\">(AA)</num><content> an employee or contractor of the Department of Veterans Affairs who is acting in the scope of such employment or contract; and</content>\n</subitem>\n<subitem style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id0daac754-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/A/ii/III/bb/BB\"><num value=\"BB\">(BB)</num><content> registered under <ref href=\"/us/usc/t21/s823/g\">section 823(g) of this title</ref> in any State or is utilizing the registration of a hospital or clinic operated by the Department of Veterans Affairs registered under <ref href=\"/us/usc/t21/s823/g\">section 823(g) of this title</ref>;</content>\n</subitem>\n</item>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac755-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/B\"><num value=\"B\">(B)</num><chapeau> is being conducted while the patient is being treated by, and in the physical presence of, a practitioner—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac756-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/B/i\"><num value=\"i\">(i)</num><content> acting in the usual course of professional practice;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac757-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/B/ii\"><num value=\"ii\">(ii)</num><content> acting in accordance with applicable State law; and</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac758-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/B/iii\"><num value=\"iii\">(iii)</num><chapeau> registered under <ref href=\"/us/usc/t21/s823/g\">section 823(g) of this title</ref> in the State in which the patient is located, unless the practitioner—</chapeau><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id0daac759-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/B/iii/I\"><num value=\"I\">(I)</num><content> is exempted from such registration in all States under <ref href=\"/us/usc/t21/s822/d\">section 822(d) of this title</ref>; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id0daac75a-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/B/iii/II\"><num value=\"II\">(II)</num><chapeau> is—</chapeau><item style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id0daac75b-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/B/iii/II/aa\"><num value=\"aa\">(aa)</num><content> an employee or contractor of the Department of Veterans Affairs who is acting in the scope of such employment or contract; and</content>\n</item>\n<item style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id0daac75c-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/B/iii/II/bb\"><num value=\"bb\">(bb)</num><content> registered under <ref href=\"/us/usc/t21/s823/g\">section 823(g) of this title</ref> in any State or is using the registration of a hospital or clinic operated by the Department of Veterans Affairs registered under <ref href=\"/us/usc/t21/s823/g\">section 823(g) of this title</ref>;</content>\n</item>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac75d-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/C\"><num value=\"C\">(C)</num><chapeau> is being conducted by a practitioner—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac75e-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/C/i\"><num value=\"i\">(i)</num><content> who is an employee or contractor of the Indian Health Service, or is working for an Indian tribe or tribal organization under its contract or compact with the Indian Health Service under the Indian Self-Determination and Education Assistance Act [<ref href=\"/us/usc/t25/s5301\">25 U.S.C. 5301</ref> et seq.];</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac75f-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/C/ii\"><num value=\"ii\">(ii)</num><content> acting within the scope of the employment, contract, or compact described in clause (i); and</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac760-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/C/iii\"><num value=\"iii\">(iii)</num><content> who is designated as an Internet Eligible Controlled Substances Provider by the Secretary under <ref href=\"/us/usc/t21/s831/g/2\">section 831(g)(2) of this title</ref>;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac761-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/D\"><num value=\"D\">(D)</num><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac762-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/D/i\"><num value=\"i\">(i)</num><content> is being conducted during a public health emergency declared by the Secretary under <ref href=\"/us/usc/t42/s247d\">section 247d of title 42</ref>; and</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac763-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/D/ii\"><num value=\"ii\">(ii)</num><content> involves patients located in such areas, and such controlled substances, as the Secretary, with the concurrence of the Attorney General, designates, provided that such designation shall not be subject to the procedures prescribed by subchapter II of chapter 5 of title 5;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac764-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/E\"><num value=\"E\">(E)</num><content> is being conducted by a practitioner who has obtained from the Attorney General a special registration under <ref href=\"/us/usc/t21/s831/h\">section 831(h) of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac765-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/F\"><num value=\"F\">(F)</num><chapeau> is being conducted—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac766-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/F/i\"><num value=\"i\">(i)</num><chapeau> in a medical emergency situation—</chapeau><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id0daac767-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/F/i/I\"><num value=\"I\">(I)</num><content> that prevents the patient from being in the physical presence of a practitioner registered under <ref href=\"/us/usc/t21/s823/g\">section 823(g) of this title</ref> who is an employee or contractor of the Veterans Health Administration acting in the usual course of business and employment and within the scope of the official duties or contract of that employee or contractor;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id0daac768-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/F/i/II\"><num value=\"II\">(II)</num><content> that prevents the patient from being physically present at a hospital or clinic operated by the Department of Veterans Affairs registered under <ref href=\"/us/usc/t21/s823/g\">section 823(g) of this title</ref>;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id0daac769-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/F/i/III\"><num value=\"III\">(III)</num><content> during which the primary care practitioner of the patient or a practitioner otherwise practicing telemedicine within the meaning of this paragraph is unable to provide care or consultation; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id0daac76a-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/F/i/IV\"><num value=\"IV\">(IV)</num><content> that requires immediate intervention by a health care practitioner using controlled substances to prevent what the practitioner reasonably believes in good faith will be imminent and serious clinical consequences, such as further injury or death; and</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0daac76b-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/F/ii\"><num value=\"ii\">(ii)</num><chapeau> by a practitioner that—</chapeau><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id0daac76c-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/F/ii/I\"><num value=\"I\">(I)</num><content> is an employee or contractor of the Veterans Health Administration acting within the scope of that employment or contract;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id0daac76d-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/F/ii/II\"><num value=\"II\">(II)</num><content> is registered under <ref href=\"/us/usc/t21/s823/g\">section 823(g) of this title</ref> in any State or is utilizing the registration of a hospital or clinic operated by the Department of Veterans Affairs registered under <ref href=\"/us/usc/t21/s823/g\">section 823(g) of this title</ref>; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id0daac76e-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/F/ii/III\"><num value=\"III\">(III)</num><content> issues a controlled substance prescription in this emergency context that is limited to a maximum of a 5-day supply which may not be extended or refilled; or</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac76f-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/54/G\"><num value=\"G\">(G)</num><content> is being conducted under any other circumstances that the Attorney General and the Secretary have jointly, by regulation, determined to be consistent with effective controls against diversion and otherwise consistent with the public health and safety.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac770-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/55\"><num value=\"55\">(55)</num><chapeau> The term “refilling prescriptions for controlled substances in schedule III, IV, or V”—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac771-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/55/A\"><num value=\"A\">(A)</num><content> means the dispensing of a controlled substance in schedule III, IV, or V in accordance with refill instructions issued by a practitioner as part of a valid prescription that meets the requirements of subsections (b) and (c) of <ref href=\"/us/usc/t21/s829\">section 829 of this title</ref>, as appropriate; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac772-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/55/B\"><num value=\"B\">(B)</num><content> does not include the issuance of a new prescription to an individual for a controlled substance that individual was previously prescribed.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac773-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/56\"><num value=\"56\">(56)</num><chapeau> The term “filling new prescriptions for controlled substances in schedule III, IV, or V” means filling a prescription for an individual for a controlled substance in schedule III, IV, or V, if—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac774-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/56/A\"><num value=\"A\">(A)</num><content> the pharmacy dispensing that prescription has previously dispensed to the patient a controlled substance other than by means of the Internet and pursuant to the valid prescription of a practitioner that meets the applicable requirements of subsections (b) and (c) of <ref href=\"/us/usc/t21/s829\">section 829 of this title</ref> (in this paragraph referred to as the “original prescription”);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac775-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/56/B\"><num value=\"B\">(B)</num><content> the pharmacy contacts the practitioner who issued the original prescription at the request of that individual to determine whether the practitioner will authorize the issuance of a new prescription for that individual for the controlled substance described in subparagraph (A); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac776-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/56/C\"><num value=\"C\">(C)</num><content> the practitioner, acting in the usual course of professional practice, determines there is a legitimate medical purpose for the issuance of the new prescription.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac777-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/57\"><num value=\"57\">(57)</num><chapeau> The term “suspicious order” may include, but is not limited to—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac778-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/57/A\"><num value=\"A\">(A)</num><content> an order of a controlled substance of unusual size;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac779-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/57/B\"><num value=\"B\">(B)</num><content> an order of a controlled substance deviating substantially from a normal pattern; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac77a-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/57/C\"><num value=\"C\">(C)</num><content> orders of controlled substances of unusual frequency.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac77b-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/58\"><num value=\"58\">(58)</num><chapeau> The term “serious drug felony” means an offense described in <ref href=\"/us/usc/t18/s924/e/2\">section 924(e)(2) of title 18</ref> for which—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac77c-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/58/A\"><num value=\"A\">(A)</num><content> the offender served a term of imprisonment of more than 12 months; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac77d-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/58/B\"><num value=\"B\">(B)</num><content> the offender’s release from any term of imprisonment was within 15 years of the commencement of the instant offense.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac77e-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/59\"><num value=\"59\">(59)</num><chapeau> The term “serious violent felony” means—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac77f-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/59/A\"><num value=\"A\">(A)</num><content> an offense described in <ref href=\"/us/usc/t18/s3559/c/2\">section 3559(c)(2) of title 18</ref> for which the offender served a term of imprisonment of more than 12 months; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0daac780-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/59/B\"><num value=\"B\">(B)</num><content> any offense that would be a felony violation of <ref href=\"/us/usc/t18/s113\">section 113 of title 18</ref>, if the offense were committed in the special maritime and territorial jurisdiction of the United States, for which the offender served a term of imprisonment of more than 12 months.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0daac781-66fd-11f0-b5e6-b887b5797a43\" identifier=\"/us/usc/t21/s802/60\"><num L. 106–310, div. B, title XXXVI, § 3642</ref>, <date date=\"2000-10-17\">Oct. 17, 2000</date>, <ref href=\"/us/stat/114/1237\">114 Stat. 1237</ref>, provided that:<quotedContent origin=\"/us/pl/106/310/dB/tXXXVI/s3642\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Study</inline>.—</heading><chapeau>The Attorney General shall conduct a study of the use of ordinary, over-the-counter pseudoephedrine and phenylpropanolamine products in the clandestine production of illicit drugs. Sources of data for the study shall include the following:</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> Information from Federal, State, and local clandestine laboratory seizures and related investigations identifying the source, type, or brand of drug products being utilized and how they were obtained for the illicit production of methamphetamine and amphetamine.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> Information submitted voluntarily from the pharmaceutical and retail industries involved in the manufacture, distribution, and sale of drug products containing ephedrine, pseudoephedrine, and phenylpropanolamine, including information on changes in the pattern, volume, or both, of sales of ordinary, over-the-counter pseudoephedrine and phenylpropanolamine products.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Report.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Requirement</inline>.—</heading><content>Not later than 1 year after the date of the enactment of this Act [<date date=\"2000-10-17\">Oct. 17, 2000</date>], the Attorney General shall submit to Congress a report on the study conducted under subsection (a).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Elements</inline>.—</heading><chapeau>The report shall include—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> the findings of the Attorney General as a result of the study; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> such recommendations on the need to establish additional measures to prevent diversion of ordinary, over-the-counter pseudoephedrine and phenylpropanolamine (such as a threshold on ordinary, over-the-counter pseudoephedrine and phenylpropanolamine products) as the Attorney General considers appropriate.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Matters considered</inline>.—</heading><content>In preparing the report, the Attorney General shall consider the comments and recommendations including the comments on the Attorney General’s proposed findings and recommendations, of State and local law enforcement and regulatory officials and of representatives of the industry described in subsection (a)(2).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Regulation of Retail Sales.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>Notwithstanding section 401(d) of the Comprehensive Methamphetamine Control Act of 1996 [<ref href=\"/us/pl/104/237\">Pub. L. 104–237</ref>] (<ref href=\"/us/usc/t21/s802\">21 U.S.C. 802</ref> note) and subject to paragraph (2), the Attorney General shall establish by regulation a single-transaction limit of not less than 24 grams of ordinary, over-the-counter pseudoephedrine or phenylpropanolamine (as the case may be) for retail distributors, if the Attorney General finds, in the report under subsection (b), that—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> there is a significant number of instances (as set forth in paragraph (3)(A) of such section 401(d) for purposes of such section) where ordinary, over-the-counter pseudoephedrine products, phenylpropanolamine products, or both such products that were purchased from retail distributors were widely used in the clandestine production of illicit drugs; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> the best practical method of preventing such use is the establishment of single-transaction limits for retail distributors of either or both of such products.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Due process</inline>.—</heading><content>The Attorney General shall establish the single-transaction limit under paragraph (1) only after notice, comment, and an informal hearing.”</content>\n</paragraph>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"id0dad3798-66fd-11f0-b5e6-b887b5797a43\"><heading class=\"centered smallCaps\">Regulation of Retail Sales of Certain Precursor Chemicals; Effect on Thresholds; Combination Ephedrine Products</heading><p style=\"-uslm-lc:I21\" class=\"indent0\"><ref href=\"/us/pl/104/237/tIV/s401/d\">Pub. L. 109–177, title VII, § 712(b)</ref>, <date date=\"2006-03-09\">Mar. 9, 2006</date>, <ref href=\"/us/stat/120/264\">120 Stat. 264</ref>.</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"id0dad3799-66fd-11f0-b5e6-b887b5797a43\"><heading class=\"centered smallCaps\">Exemption for Substances in Paragraph (41)</heading><p><ref href=\"/us/pl/101/647/tXIX/s1903\">Pub. L. 101–647, title XIX, § 1903</ref>, <date date=\"1990-11-29\">Nov. 29, 1990</date>, <ref href=\"/us/stat/104/4853\">104 Stat. 4853</ref>, as amended by <ref href=\"/us/pl/108/358/s2/c\">Pub.
