L. 115–271, title III, § 3241, Oct. 24, 2018, 132 Stat. 3950.)","seq_in_title":457,"parent_identifier":"/us/usc/t21/ch13/schI/ptB","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13","level":"chapter","num":"CHAPTER 13—","heading":"DRUG ABUSE PREVENTION AND CONTROL","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"CONTROL AND ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13/schI/ptB","level":"part","num":"Part B—","heading":"Authority To Control; Standards and Schedules","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idd1decb1d-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s813\"><num value=\"813\">§ 813.</num><heading> Treatment of controlled substance analogues</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd1decb1e-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s813/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">A controlled substance analogue shall, to the extent intended for human consumption, be treated, for the purposes of any Federal law as a controlled substance in schedule I.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd1decb1f-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s813/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Determination</heading><chapeau>In determining whether a controlled substance analogue was intended for human consumption under subsection (a), the following factors may be considered, along with any other relevant factors:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd1decb20-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s813/b/1\"><num value=\"1\">(1)</num><content> The marketing, advertising, and labeling of the substance.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd1decb21-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s813/b/2\"><num value=\"2\">(2)</num><content> The known efficacy or usefulness of the substance for the marketed, advertised, or labeled purpose.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd1decb22-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s813/b/3\"><num value=\"3\">(3)</num><content> The difference between the price at which the substance is sold and the price at which the substance it is purported to be or advertised as is normally sold.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd1decb23-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s813/b/4\"><num value=\"4\">(4)</num><content> The diversion of the substance from legitimate channels and the clandestine importation, manufacture, or distribution of the substance.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd1decb24-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s813/b/5\"><num value=\"5\">(5)</num><content> Whether the defendant knew or should have known the substance was intended to be consumed by injection, inhalation, ingestion, or any other immediate means.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd1def235-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s813/b/6\"><num value=\"6\">(6)</num><content> Any controlled substance analogue that is manufactured, formulated, sold, distributed, or marketed with the intent to avoid the provisions of existing drug laws.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd1def236-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s813/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Limitation</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this section, evidence that a substance was not marketed, advertised, or labeled for human consumption, by itself, shall not be sufficient to establish that the substance was not intended for human consumption.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idd1def237-09f4-11e9-8d96-9378be633404\">(<ref href=\"/us/pl/91/513/tII\">Pub.
