Standards and Schedules","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id41af1188-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814\"><num value=\"814\">§ 814.</num><heading> Removal of exemption of certain drugs</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id41af1189-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Removal of exemption</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Attorney General shall by regulation remove from exemption under <ref href=\"/us/usc/t21/s802/39/A/iv\">section 802(39)(A)(iv) of this title</ref> a drug or group of drugs that the Attorney General finds is being diverted to obtain a listed chemical for use in the illicit production of a controlled substance.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id41af118a-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Factors to be considered</heading><chapeau>In removing a drug or group of drugs from exemption under subsection (a), the Attorney General shall consider, with respect to a drug or group of drugs that is proposed to be removed from exemption—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id41af118b-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/b/1\"><num value=\"1\">(1)</num><content> the scope, duration, and significance of the diversion;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id41af118c-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/b/2\"><num value=\"2\">(2)</num><content> whether the drug or group of drugs is formulated in such a way that it cannot be easily used in the illicit production of a controlled substance; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id41af118d-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/b/3\"><num value=\"3\">(3)</num><content> whether the listed chemical can be readily recovered from the drug or group of drugs.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id41af118e-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Specificity of designation</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Attorney General shall limit the designation of a drug or a group of drugs removed from exemption under subsection (a) to the most particularly identifiable type of drug or group of drugs for which evidence of diversion exists unless there is evidence, based on the pattern of diversion and other relevant factors, that the diversion will not be limited to that particular drug or group of drugs.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id41af118f-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Reinstatement of exemption with respect to particular drug products</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id41af1190-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Reinstatement</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">On application by a manufacturer of a particular drug product that has been removed from exemption under subsection (a), the Attorney General shall by regulation reinstate the exemption with respect to that particular drug product if the Attorney General determines that the particular drug product is manufactured and distributed in a manner that prevents diversion.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id41af1191-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Factors to be considered</heading><chapeau>In deciding whether to reinstate the exemption with respect to a particular drug product under paragraph (1), the Attorney General shall consider—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id41af1192-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/d/2/A\"><num value=\"A\">(A)</num><content> the package sizes and manner of packaging of the drug product;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id41af1193-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/d/2/B\"><num value=\"B\">(B)</num><content> the manner of distribution and advertising of the drug product;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id41af1194-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/d/2/C\"><num value=\"C\">(C)</num><content> evidence of diversion of the drug product;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id41af1195-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/d/2/D\"><num value=\"D\">(D)</num><content> any actions taken by the manufacturer to prevent diversion of the drug product; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id41af1196-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/d/2/E\"><num value=\"E\">(E)</num><content> such other factors as are relevant to and consistent with the public health and safety, including the factors described in subsection (b) as applied to the drug product.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id41af1197-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/d/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Status pending application for reinstatement</heading><chapeau>A transaction involving a particular drug product that is the subject of a bona fide pending application for reinstatement of exemption filed with the Attorney General not later than 60 days after a regulation removing the exemption is issued pursuant to subsection (a) shall not be considered to be a regulated transaction if the transaction occurs during the pendency of the application and, if the Attorney General denies the application, during the period of 60 days following the date on which the Attorney General denies the application, unless—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id41af1198-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/d/3/A\"><num value=\"A\">(A)</num><content> the Attorney General has evidence that, applying the factors described in subsection (b) to the drug product, the drug product is being diverted; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id41af1199-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/d/3/B\"><num value=\"B\">(B)</num><content> the Attorney General so notifies the applicant.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id41af119a-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/d/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Amendment and modification</heading><chapeau>A regulation reinstating an exemption under paragraph (1) may be modified or revoked with respect to a particular drug product upon a finding that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id41af119b-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/d/4/A\"><num value=\"A\">(A)</num><content> applying the factors described in subsection (b) to the drug product, the drug product is being diverted; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id41af119c-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s814/d/4/B\"><num value=\"B\">(B)</num><content> there is a significant change in the data that led to the issuance of the regulation.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id41af119d-a3d3-11e9-95d4-f3ff9237185e\">(<ref href=\"/us/pl/91/513/tII/s204\">Pub.
