<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id0daf8301-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822"><num value="822">§ 822.</num><heading> Persons required to register</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0daf8302-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/a"><num value="a" class="bold">(a)</num><heading class="bold"> Period of registration</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id0daf8303-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/a/1"><num value="1">(1)</num><content> Every person who manufactures or distributes any controlled substance or list I chemical, or who proposes to engage in the manufacture or distribution of any controlled substance or list I chemical, shall obtain annually a registration issued by the Attorney General in accordance with the rules and regulations promulgated by him.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id0daf8304-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/a/2"><num value="2">(2)</num><content> Every person who dispenses, or who proposes to dispense, any controlled substance, shall obtain from the Attorney General a registration issued in accordance with the rules and regulations promulgated by him. The Attorney General shall, by regulation, determine the period of such registrations. In no event, however, shall such registrations be issued for less than one year nor for more than three years.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id0daf8305-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/a/3"><num value="3">(3)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id0daf8306-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/a/3/A"><num value="A">(A)</num><chapeau> Except as provided in subparagraph (C), the registration of any registrant under this subchapter to manufacture, distribute, or dispense controlled substances or list I chemicals terminates if and when such registrant—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="id0daf8307-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/a/3/A/i"><num value="i">(i)</num><content> dies;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id0daf8308-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/a/3/A/ii"><num value="ii">(ii)</num><content> ceases legal existence;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id0daf8309-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/a/3/A/iii"><num value="iii">(iii)</num><content> discontinues business or professional practice; or</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id0daf830a-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/a/3/A/iv"><num value="iv">(iv)</num><content> surrenders such registration.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id0daf830b-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/a/3/B"><num value="B">(B)</num><content> In the case of such a registrant who ceases legal existence or discontinues business or professional practice, such registrant shall promptly notify the Attorney General in writing of such fact.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id0daf830c-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/a/3/C"><num value="C">(C)</num><content> No registration under this subchapter to manufacture, distribute, or dispense controlled substances or list I chemicals, and no authority conferred thereby, may be assigned or otherwise transferred except upon such conditions as the Attorney General may specify and then only pursuant to written consent. A registrant to whom a registration is assigned or transferred pursuant to the preceding sentence may not manufacture, distribute, or dispense controlled substances or list I chemicals pursuant to such registration until the Attorney General receives such written consent.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id0daf830d-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/a/3/D"><num value="D">(D)</num><chapeau> In the case of a registrant under this subchapter to manufacture, distribute, or dispense controlled substances or list I chemicals desiring to discontinue business or professional practice altogether or with respect to controlled substances and list I chemicals (without assigning or transferring such business or professional practice to another entity), such registrant shall return to the Attorney General for cancellation—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="id0db1f20e-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/a/3/D/i"><num value="i">(i)</num><content> the registrant’s certificate of registration;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id0db1f20f-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/a/3/D/ii"><num value="ii">(ii)</num><content> any unexecuted order forms in the registrant’s possession; and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id0db1f210-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/a/3/D/iii"><num value="iii">(iii)</num><content> any other documentation that the Attorney General may require.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0db1f211-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/b"><num value="b" class="bold">(b)</num><heading class="bold"> Authorized activities</heading><content><p style="-uslm-lc:I11" class="indent0">Persons registered by the Attorney General under this subchapter to manufacture, distribute, or dispense controlled substances or list I chemicals are authorized to possess, manufacture, distribute, or dispense such substances or chemicals (including any such activity in the conduct of research) to the extent authorized by their registration and in conformity with the other provisions of this subchapter.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0db1f212-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/c"><num value="c" class="bold">(c)</num><heading class="bold"> Exceptions</heading><chapeau style="-uslm-lc:I11" class="indent0">The following persons shall not be required to register and may lawfully possess any controlled substance or list I chemical under this subchapter:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id0db1f213-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/c/1"><num value="1">(1)</num><content> An agent or employee of any registered manufacturer, distributor, or dispenser of any controlled substance or list I chemical if such agent or employee is acting in the usual course of his business or employment.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0db1f214-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/c/2"><num value="2">(2)</num><content> A common or contract carrier or warehouseman, or an employee thereof, whose possession of the controlled substance or list I chemical is in the usual course of his business or employment.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0db1f215-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/c/3"><num value="3">(3)</num><content> An ultimate user who possesses such substance for a purpose specified in <ref href="/us/usc/t21/s802/27">section 802(27) of this title</ref>.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0db1f216-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/c/4"><num value="4">(4)</num><chapeau> An agent or employee of a research institution that is conducting research with a controlled substance if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id0db1f217-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/c/4/A"><num value="A">(A)</num><content> the agent or employee is acting within the scope of the professional practice of the agent or employee;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0db1f218-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/c/4/B"><num value="B">(B)</num><content> another agent or employee of the institution is registered to conduct research with a controlled substance in the same schedule;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0db1f219-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/c/4/C"><num value="C">(C)</num><chapeau> the researcher who is so registered—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id0db1f21a-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/c/4/C/i"><num value="i">(i)</num><content> informs the Attorney General of the name, position title, and employing institution of the agent or employee who is not separately registered;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id0db1f21b-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/c/4/C/ii"><num value="ii">(ii)</num><content> authorizes that agent or employee to perform research under the registration of the registered researcher; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id0db1f21c-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/c/4/C/iii"><num value="iii">(iii)</num><content> affirms that any act taken by that agent or employee involving a controlled substance shall be attributable to the registered researcher, as if the researcher had directly committed the act, for purposes of any proceeding under <ref href="/us/usc/t21/s824/a">section 824(a) of this title</ref> to suspend or revoke the registration of the registered researcher; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0db1f21d-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/c/4/D"><num value="D">(D)</num><content> the Attorney General does not, within 30 days of receiving the information, authorization, and affirmation described in subparagraph (C), refuse, for a reason listed in <ref href="/us/usc/t21/s824/a">section 824(a) of this title</ref>, to allow the agent or employee to possess the substance without a separate registration.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0db1f21e-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/d"><num value="d" class="bold">(d)</num><heading class="bold"> Waiver</heading><content><p style="-uslm-lc:I11" class="indent0">The Attorney General may, by regulation, waive the requirement for registration of certain manufacturers, distributors, or dispensers if he finds it consistent with the public health and safety.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0db1f21f-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e"><num value="e" class="bold">(e)</num><heading class="bold"> Separate registration</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id0db1f220-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e/1"><num value="1">(1)</num><content> A separate registration shall be required at each principal place of business or professional practice where the applicant manufactures, distributes, or dispenses controlled substances or list I chemicals.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id0db1f221-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e/2"><num value="2">(2)</num><content> Notwithstanding paragraph (1), a registrant who is a veterinarian shall not be required to have a separate registration in order to transport and dispense controlled substances in the usual course of veterinary practice at a site other than the registrant’s registered principal place of business or professional practice, so long as the site of transporting and dispensing is located in a State where the veterinarian is licensed to practice veterinary medicine and is not a principal place of business or professional practice.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id0db1f222-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e/3"><num value="3">(3)</num><content> Notwithstanding paragraph (1), a registrant that is dispensing pursuant to <ref href="/us/usc/t21/s823/h">section 823(h) of this title</ref> narcotic drugs to individuals for maintenance treatment or detoxification treatment shall not be required to have a separate registration to incorporate one or more mobile medication units into the registrant’s practice to dispense such narcotics at locations other than the registrant’s principal place of business or professional practice described in paragraph (1), so long as the registrant meets such standards for operation of a mobile medication unit as the Attorney General may establish.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id0db1f223-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e/4"><num value="4">(4)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id0db1f224-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e/4/A"><num value="A">(A)</num><chapeau> Notwithstanding paragraph (1), a person registered to conduct research with a controlled substance under <ref href="/us/usc/t21/s823/g">section 823(g) of this title</ref> may conduct the research under a single registration if—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="id0db1f225-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e/4/A/i"><num value="i">(i)</num><chapeau> the research occurs exclusively on sites all of which are—</chapeau><subclause style="-uslm-lc:I13" class="indent2" id="id0db1f226-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e/4/A/i/I"><num value="I">(I)</num><content> within the same city or county; and</content>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="id0db1f227-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e/4/A/i/II"><num value="II">(II)</num><content> under the control of the same institution, organization, or agency; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id0db1f228-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e/4/A/ii"><num value="ii">(ii)</num><chapeau> before commencing the research, the researcher notifies the Attorney General of each site where—</chapeau><subclause style="-uslm-lc:I13" class="indent2" id="id0db1f229-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e/4/A/ii/I"><num value="I">(I)</num><content> the research will be conducted; or</content>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="id0db1f22a-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e/4/A/ii/II"><num value="II">(II)</num><content> the controlled substance will be stored or administered.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id0db1f22b-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e/4/B"><num value="B">(B)</num><chapeau> A site described in subparagraph (A) shall be included in a registration described in that subparagraph only if the researcher has notified the Attorney General of the site—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="id0db1f22c-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e/4/B/i"><num value="i">(i)</num><content> in the application for the registration; or</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id0db1f22d-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e/4/B/ii"><num value="ii">(ii)</num><content> before the research is conducted, or before the controlled substance is stored or administered, at the site.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id0db1f22e-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e/4/C"><num value="C">(C)</num><chapeau> The Attorney General may, in consultation with the Secretary, issue regulations addressing, with respect to research sites described in subparagraph (A)—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="id0db1f22f-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e/4/C/i"><num value="i">(i)</num><content> the manner in which controlled substances may be delivered to the research sites;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id0db1f230-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e/4/C/ii"><num value="ii">(ii)</num><content> the storage and security of controlled substances at the research sites;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id0db1f231-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e/4/C/iii"><num value="iii">(iii)</num><content> the maintenance of records for the research sites; and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id0db1f232-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/e/4/C/iv"><num value="iv">(iv)</num><content> any other matters necessary to ensure effective controls against diversion at the research sites.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0db1f233-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/f"><num value="f" class="bold">(f)</num><heading class="bold"> Inspection</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id0db1f234-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/f/1"><num value="1">(1)</num><content> The Attorney General is authorized to inspect the establishment of a registrant or applicant for registration in accordance with the rules and regulations promulgated by him.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id0db1f235-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/f/2"><num value="2">(2)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id0db1f236-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/f/2/A"><num value="A">(A)</num><content> If a person is registered to conduct research with a controlled substance and applies for a registration, or for a modification of a registration, to conduct research with a second controlled substance that is in the same schedule as the first controlled substance, or is in a schedule with a higher numerical designation than the schedule of the first controlled substance, a new inspection by the Attorney General of the registered location is not required.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id0db1f237-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/f/2/B"><num value="B">(B)</num><content> Nothing in subparagraph (A) shall prohibit the Attorney General from conducting an inspection that the Attorney General determines necessary to ensure that a registrant maintains effective controls against diversion.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0db1f238-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g"><num value="g" class="bold">(g)</num><heading class="bold"> Delivery of controlled substances by ultimate users for disposal</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id0db1f239-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/1"><num value="1">(1)</num><chapeau> An ultimate user who has lawfully obtained a controlled substance in accordance with this subchapter may, without being registered, deliver the controlled substance to another person for the purpose of disposal of the controlled substance if—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id0db1f23a-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/1/A"><num value="A">(A)</num><content> the person receiving the controlled substance is authorized under this subchapter to engage in such activity; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id0db1f23b-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/1/B"><num value="B">(B)</num><content> the disposal takes place in accordance with regulations issued by the Attorney General to prevent diversion of controlled substances.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id0db1f23c-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/2"><num value="2">(2)</num><content> In developing regulations under this subsection, the Attorney General shall take into consideration the public health and safety, as well as the ease and cost of program implementation and participation by various communities. Such regulations may not require any entity to establish or operate a delivery or disposal program.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id0db1f23d-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/3"><num value="3">(3)</num><content> The Attorney General may, by regulation, authorize long-term care facilities, as defined by the Attorney General by regulation, to dispose of controlled substances on behalf of ultimate users who reside, or have resided, at such long-term care facilities in a manner that the Attorney General determines will provide effective controls against diversion and be consistent with the public health and safety.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id0db1f23e-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/4"><num value="4">(4)</num><content> If a person dies while lawfully in possession of a controlled substance for personal use, any person lawfully entitled to dispose of the decedent’s property may deliver the controlled substance to another person for the purpose of disposal under the same conditions as provided in paragraph (1) for an ultimate user.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id0db1f23f-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5"><num value="5">(5)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id0db1f240-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/A"><num value="A">(A)</num><chapeau> In the case of a person receiving hospice care, an employee of a qualified hospice program, acting within the scope of employment, may handle, without being registered under this section, any controlled substance that was lawfully dispensed to the person receiving hospice care, for the purpose of disposal of the controlled substance so long as such disposal occurs onsite in accordance with all applicable Federal, State, Tribal, and local law and—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="id0db1f241-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/A/i"><num value="i">(i)</num><content> the disposal occurs after the death of a person receiving hospice care;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id0db1f242-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/A/ii"><num value="ii">(ii)</num><content> the controlled substance is expired; or</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id0db1f243-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/A/iii"><num value="iii">(iii)</num><subclause style="-uslm-lc:I12" class="indent1" id="id0db1f244-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/A/iii/I"><num value="I">(I)</num><chapeau> the employee is—</chapeau><item style="-uslm-lc:I13" class="indent2" id="id0db1f245-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/A/iii/I/aa"><num value="aa">(aa)</num><content> the physician of the person receiving hospice care; and</content>

<item style="-uslm-lc:I13" class="indent2" id="id0db1f246-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/A/iii/I/bb"><num value="bb">(bb)</num><content> registered under <ref href="/us/usc/t21/s823/g">section 823(g) of this title</ref>; and</content>

</subclause>
<subclause style="-uslm-lc:I12" class="indent1" id="id0db1f247-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/A/iii/II"><num value="II">(II)</num><content> the hospice patient no longer requires the controlled substance because the plan of care of the hospice patient has been modified.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id0db1f248-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/B"><num value="B">(B)</num><chapeau> For the purposes of this paragraph:</chapeau><clause style="-uslm-lc:I12" class="indent1" id="id0db1f249-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/B/i"><num value="i">(i)</num><content> The terms “hospice care” and “hospice program” have the meanings given to those terms in <ref href="/us/usc/t42/s1395x/dd">section 1395x(dd) of title 42</ref>.</content>

<clause style="-uslm-lc:I12" class="indent1" id="id0db1f24a-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/B/ii"><num value="ii">(ii)</num><chapeau> The term “employee of a qualified hospice program” means a physician, physician assistant, nurse, or other person who—</chapeau><subclause style="-uslm-lc:I13" class="indent2" id="id0db1f24b-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/B/ii/I"><num value="I">(I)</num><content> is employed by, or pursuant to arrangements made by, a qualified hospice program;</content>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="id0db1f24c-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/B/ii/II"><num value="II">(II)</num><item style="-uslm-lc:I13" class="indent2" id="id0db1f24d-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/B/ii/II/aa"><num value="aa">(aa)</num><content> is licensed to perform medical or nursing services by the jurisdiction in which the person receiving hospice care was located; and</content>
</item>
<item style="-uslm-lc:I13" class="indent2" id="id0db1f24e-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/B/ii/II/bb"><num value="bb">(bb)</num><content> is acting within the scope of such employment in accordance with applicable State law; and</content>
</item>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="id0db1f24f-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/B/ii/III"><num value="III">(III)</num><content> has completed training through the qualified hospice program regarding the disposal of controlled substances in a secure and responsible manner so as to discourage abuse, misuse, or diversion.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id0db1f250-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/B/iii"><num value="iii">(iii)</num><chapeau> The term “qualified hospice program” means a hospice program that—</chapeau><subclause style="-uslm-lc:I13" class="indent2" id="id0db1f251-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/B/iii/I"><num value="I">(I)</num><content> has written policies and procedures for assisting in the disposal of the controlled substances of a person receiving hospice care after the person’s death;</content>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="id0db1f252-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/B/iii/II"><num value="II">(II)</num><chapeau> at the time when the controlled substances are first ordered—</chapeau><item style="-uslm-lc:I14" class="indent3" id="id0db1f253-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/B/iii/II/aa"><num value="aa">(aa)</num><content> provides a copy of the written policies and procedures to the patient or patient representative and family;</content>
</item>
<item style="-uslm-lc:I14" class="indent3" id="id0db1f254-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/B/iii/II/bb"><num value="bb">(bb)</num><content> discusses the policies and procedures with the patient or representative and the family in a language and manner that they understand to ensure that these parties are educated regarding the safe disposal of controlled substances; and</content>
</item>
<item style="-uslm-lc:I14" class="indent3" id="id0db1f255-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/B/iii/II/cc"><num value="cc">(cc)</num><content> documents in the patient’s clinical record that the written policies and procedures were provided and discussed; and</content>
</item>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="id0db1f256-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/B/iii/III"><num value="III">(III)</num><chapeau> at the time following the disposal of the controlled substances—</chapeau><item style="-uslm-lc:I14" class="indent3" id="id0db1f257-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/B/iii/III/aa"><num value="aa">(aa)</num><content> documents in the patient’s clinical record the type of controlled substance, dosage, route of administration, and quantity so disposed; and</content>
</item>
<item style="-uslm-lc:I14" class="indent3" id="id0db1f258-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/g/5/B/iii/III/bb"><num value="bb">(bb)</num><content> the time, date, and manner in which that disposal occurred.</content>

</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0db1f259-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/h"><num value="h" class="bold">(h)</num><heading class="bold"> Continuation of research on substances newly added to schedule I</heading><chapeau style="-uslm-lc:I11" class="indent0">If a person is conducting research on a substance when the substance is added to schedule I, and the person is already registered to conduct research with a controlled substance in schedule I—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id0db1f25a-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/h/1"><num value="1">(1)</num><content> not later than 90 days after the scheduling of the newly scheduled substance, the person shall submit a completed application for registration or modification of existing registration, to conduct research on the substance, in accordance with regulations issued by the Attorney General for purposes of this paragraph;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0db1f25b-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/h/2"><num value="2">(2)</num><chapeau> the person may, notwithstanding subsections (a) and (b), continue to conduct the research on the substance until—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id0db1f25c-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/h/2/A"><num value="A">(A)</num><content> the person withdraws the application described in paragraph (1) of this subsection; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0db1f25d-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/h/2/B"><num value="B">(B)</num><content> the Attorney General serves on the person an order to show cause proposing the denial of the application under <ref href="/us/usc/t21/s824/c">section 824(c) of this title</ref>;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0db1f25e-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/h/3"><num value="3">(3)</num><content> if the Attorney General serves an order to show cause as described in paragraph (2)(B) and the person requests a hearing, the hearing shall be held on an expedited basis and not later than 45 days after the request is made, except that the hearing may be held at a later time if so requested by the person; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0db1f25f-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/h/4"><num value="4">(4)</num><content> if the person sends a copy of the application described in paragraph (1) to a manufacturer or distributor of the substance, receipt of the copy by the manufacturer or distributor shall constitute sufficient evidence that the person is authorized to receive the substance.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0db1f260-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/i"><num value="i" class="bold">(i)</num><heading class="bold"> Treatment of certain manufacturing activities as coincident to research</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id0db1f261-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/i/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Except as provided in paragraph (3), a person who is registered to perform research on a controlled substance may perform manufacturing activities with small quantities of that substance, including activities described in paragraph (2), without being required to obtain a manufacturing registration, if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id0db1f262-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/i/1/A"><num value="A">(A)</num><content> the activities are performed for the purpose of the research; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0db1f263-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/i/1/B"><num value="B">(B)</num><chapeau> the activities and the quantities of the substance involved in the activities are stated in—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id0db1f264-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/i/1/B/i"><num value="i">(i)</num><content> a notification submitted to the Attorney General under <ref href="/us/usc/t21/s823/n">section 823(n) of this title</ref>;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id0db1f265-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/i/1/B/ii"><num value="ii">(ii)</num><content> a research protocol filed with an application for registration approval under <ref href="/us/usc/t21/s823/g">section 823(g) of this title</ref>; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id0db1f266-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/i/1/B/iii"><num value="iii">(iii)</num><chapeau> a notification to the Attorney General that includes—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id0db1f267-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/i/1/B/iii/I"><num value="I">(I)</num><content> the name of the registrant; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id0db1f268-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/i/1/B/iii/II"><num value="II">(II)</num><content> an attestation that the research to be conducted with the small quantities of manufactured substance is consistent with the scope of the research that is the basis for the registration.</content>
</subclause>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id0db1f269-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/i/2"><num value="2" class="bold">(2)</num><heading class="bold"> Activities included</heading><chapeau style="-uslm-lc:I12" class="indent1">Activities permitted under paragraph (1) include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id0db1f26a-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/i/2/A"><num value="A">(A)</num><chapeau> processing the substance to create extracts, tinctures, oils, solutions, derivatives, or other forms of the substance consistent with—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id0db1f26b-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/i/2/A/i"><num value="i">(i)</num><content> the information provided as part of a notification submitted to the Attorney General under <ref href="/us/usc/t21/s823/n">section 823(n) of this title</ref>; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id0db1f26c-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/i/2/A/ii"><num value="ii">(ii)</num><content> a research protocol filed with an application for registration approval under <ref href="/us/usc/t21/s823/g">section 823(g) of this title</ref>; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0db1f26d-66fd-11f0-b5e6-b887b5797a43" identifier="/us/usc/t21/s822/i/2/B"><num value="B">(B)</num><content> dosage form development studies performed for the purpose of requesting an investigational new drug exemption under <ref href="/us/usc/t21/s355/i">section 355(i) of this title</ref>.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> The nonmedical use of prescription drugs is a growing problem in the United States, particularly among teenagers.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><chapeau> According to the Department of Justice’s 2009 National Prescription Drug Threat Assessment—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> the number of deaths and treatment admissions for controlled prescription drugs (CPDs) has increased significantly in recent years;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> unintentional overdose deaths involving prescription opioids, for example, increased 114 percent from 2001 to 2005, and the number of treatment admissions for prescription opioids increased 74 percent from 2002 to 2006; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> violent crime and property crime associated with abuse and diversion of CPDs has increased in all regions of the United States over the past 5 years.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><chapeau> According to the Office of National Drug Control Policy’s 2008 Report ‘Prescription for Danger’, prescription drug abuse is especially on the rise for teens—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> one-third of all new abusers of prescription drugs in 2006 were 12- to 17-year-olds;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> teens abuse prescription drugs more than any illicit drug except marijuana—more than cocaine, heroin, and methamphetamine combined; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> responsible adults are in a unique position to reduce teen access to prescription drugs because the drugs often are found in the home.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">(A)</num><content> Many State and local law enforcement agencies have established drug disposal programs (often called ‘take-back’ programs) to facilitate the collection and destruction of unused, unwanted, or expired medications. These programs help get outdated or unused medications off household shelves and out of the reach of children and teenagers.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><content> However, take-back programs often cannot dispose of the most dangerous pharmaceutical drugs—controlled substance medications—because Federal law does not permit take-back programs to accept controlled substances unless they get specific permission from the Drug Enforcement Administration and arrange for full-time law enforcement officers to receive the controlled substances directly from the member of the public who seeks to dispose of them.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="C">“(C)</num><content> Individuals seeking to reduce the amount of unwanted controlled substances in their household consequently have few disposal options beyond discarding or flushing the substances, which may not be appropriate means of disposing of the substances. Drug take-back programs are also a convenient and effective means for individuals in various communities to reduce the introduction of some potentially harmful substances into the environment, particularly into water.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="D">“(D)</num><content> Long-term care facilities face a distinct set of obstacles to the safe disposal of controlled substances due to the increased volume of controlled substances they handle.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> This Act [see Short Title of 2010 Amendment note set out under <ref href="/us/usc/t21/s801">section 801 of this title</ref>] gives the Attorney General authority to promulgate new regulations, within the framework of the Controlled Substances Act [<ref href="/us/usc/t21/s801">21 U.S.C. 801</ref> et seq.], that will allow patients to deliver unused pharmaceutical controlled substances to appropriate entities for disposal in a safe and effective manner consistent with effective controls against diversion.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><content> The goal of this Act is to encourage the Attorney General to set controlled substance diversion prevention parameters that will allow public and private entities to develop a variety of methods of collection and disposal of controlled substances, including some pharmaceuticals, in a secure, convenient, and responsible manner. This will also serve to reduce instances of diversion and introduction of some potentially harmful substances into the environment.”</content>

<continuation style="-uslm-lc:I33" class="indent0 firstIndent0">shall, with respect to each establishment for which such registration is in effect under any such section, be deemed to have a provisional registration under section 303 [<ref href="/us/usc/t21/s823">section 823 of this title</ref>] for the manufacture, distribution, or dispensing (as the case may be) of controlled substances.</continuation>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="2">“(2)</num><content> During the period his provisional registration is in effect under this section, the registration number assigned such person under such section 510 [<ref href="/us/usc/t21/s360">section 360 of this title</ref>] or under such section 4722 [<ref href="/us/usc/t26/s4722">section 4722 of Title 26</ref>] (as the case may be) shall be his registration number for purposes of <ref href="/us/usc/t21/s303">section 303 of this title</ref> [<ref href="/us/usc/t21/s823">section 823 of this title</ref>].</content>

</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><content> The provisions of section 304 [<ref href="/us/usc/t21/s824">section 824 of this title</ref>], relating to suspension and revocation of registration, shall apply to a provisional registration under this section.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><chapeau> Unless sooner suspended or revoked under subsection (b), a provisional registration of a person under subsection (a)(1) of this section shall be in effect until—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> the date on which such person has registered with the Attorney General under section 303 [<ref href="/us/usc/t21/s823">section 823 of this title</ref>] or has had his registration denied under such section, or</content>
