L. 111–273, § 3(b), Oct. 12, 2010, 124 Stat. 2860.)","seq_in_title":481,"parent_identifier":"/us/usc/t21/ch13/schI/ptC","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13","level":"chapter","num":"CHAPTER 13—","heading":"DRUG ABUSE PREVENTION AND CONTROL","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"CONTROL AND ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13/schI/ptC","level":"part","num":"Part C—","heading":"Registration of Manufacturers, Distributors, and Dispensers of Controlled Substances","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id7daa0065-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s828\"><num value=\"828\">§ 828.</num><heading> Order forms</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id7daa0066-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s828/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Unlawful distribution of controlled substances</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">It shall be unlawful for any person to distribute a controlled substance in schedule I or II to another except in pursuance of a written order of the person to whom such substance is distributed, made on a form to be issued by the Attorney General in blank in accordance with subsection (d) and regulations prescribed by him pursuant to this section.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id7daa0067-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s828/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Nonapplicability of provisions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Nothing in subsection (a) shall apply to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7daa0068-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s828/b/1\"><num value=\"1\">(1)</num><content> the exportation of such substances from the United States in conformity with subchapter II;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7daa0069-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s828/b/2\"><num value=\"2\">(2)</num><content> the delivery of such a substance to or by a common or contract carrier for carriage in the lawful and usual course of its business, or to or by a warehouseman for storage in the lawful and usual course of its business; but where such carriage or storage is in connection with the distribution by the owner of the substance to a third person, this paragraph shall not relieve the distributor from compliance with subsection (a); or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7daa277a-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s828/b/3\"><num value=\"3\">(3)</num><content> the delivery of such a substance for the purpose of disposal by an ultimate user, long-term care facility, or other person acting in accordance with <ref href=\"/us/usc/t21/s822/g\">section 822(g) of this title</ref>.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id7daa277b-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s828/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Preservation and availability</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7daa277c-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s828/c/1\"><num value=\"1\">(1)</num><content> Every person who in pursuance of an order required under subsection (a) distributes a controlled substance shall preserve such order for a period of two years, and shall make such order available for inspection and copying by officers and employees of the United States duly authorized for that purpose by the Attorney General, and by officers or employees of States or their political subdivisions who are charged with the enforcement of State or local laws regulating the production, or regulating the distribution or dispensing, of controlled substances and who are authorized under such laws to inspect such orders.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7daa277d-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s828/c/2\"><num value=\"2\">(2)</num><content> Every person who gives an order required under subsection (a) shall, at or before the time of giving such order, make or cause to be made a duplicate thereof on a form to be issued by the Attorney General in blank in accordance with subsection (d) and regulations prescribed by him pursuant to this section, and shall, if such order is accepted, preserve such duplicate for a period of two years and make it available for inspection and copying by the officers and employees mentioned in paragraph (1) of this subsection.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id7daa277e-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s828/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Issuance</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7daa277f-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s828/d/1\"><num value=\"1\">(1)</num><content> The Attorney General shall issue forms pursuant to subsections (a) and (c)(2) only to persons validly registered under <ref href=\"/us/usc/t21/s823\">section 823 of this title</ref> (or exempted from registration under <ref href=\"/us/usc/t21/s822/d\">section 822(d) of this title</ref>). Whenever any such form is issued to a person, the Attorney General shall, before delivery thereof, insert therein the name of such person, and it shall be unlawful for any other person (A) to use such form for the purpose of obtaining controlled substances or (B) to furnish such form to any person with intent thereby to procure the distribution of such substances.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7daa2780-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s828/d/2\"><num value=\"2\">(2)</num><content> The Attorney General may charge reasonable fees for the issuance of such forms in such amounts as he may prescribe for the purpose of covering the cost to the United States of issuing such forms, and other necessary activities in connection therewith.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id7daa4e91-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s828/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Unlawful acts</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">It shall be unlawful for any person to obtain by means of order forms issued under this section controlled substances for any purpose other than their use, distribution, dispensing, or administration in the conduct of a lawful business in such substances or in the course of his professional practice or research.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id7daa4e92-81bc-11eb-b838-b6993269d559\">(<ref href=\"/us/pl/91/513/tII/s308\">Pub.
