Prescriptions shall be retained in conformity with the requirements of <ref href=\"/us/usc/t21/s827\">section 827 of this title</ref>. No prescription for a controlled substance in schedule II may be refilled.</p>\n</content>\n</subsection>\n<subsection class=\"indent0\" id=\"id1db96a4a-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s829/b\"><num value=\"b\">(b)</num><heading> Schedule III and IV substances</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Except when dispensed directly by a practitioner, other than a pharmacist, to an ultimate user, no controlled substance in schedule III or IV, which is a prescription drug as determined under the Federal Food, Drug, and Cosmetic Act [<ref href=\"/us/usc/t21/s301\">21 U.S.C. 301</ref> et seq.], may be dispensed without a written or oral prescription in conformity with section 503(b) of that Act [<ref href=\"/us/usc/t21/s353/b\">21 U.S.C. 353(b)</ref>]. Such prescriptions may not be filled or refilled more than six months after the date thereof or be refilled more than five times after the date of the prescription unless renewed by the practitioner.</p>\n</content>\n</subsection>\n<subsection class=\"indent0\" id=\"id1db9915b-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s829/c\"><num value=\"c\">(c)</num><heading> Schedule V substances</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">No controlled substance in schedule V which is a drug may be distributed or dispensed other than for a medical purpose.</p>\n</content>\n</subsection>\n<subsection class=\"indent0\" id=\"id1db9915c-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s829/d\"><num value=\"d\">(d)</num><heading> Non-prescription drugs with abuse potential</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Whenever it appears to the Attorney General that a drug not considered to be a prescription drug under the Federal Food, Drug, and Cosmetic Act [<ref href=\"/us/usc/t21/s301\">21 U.S.C. 301</ref> et seq.] should be so considered because of its abuse potential, he shall so advise the Secretary and furnish to him all available data relevant thereto.</p>\n</content>\n</subsection>\n<subsection class=\"indent0\" id=\"id1db9915d-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s829/e\"><num value=\"e\">(e)</num><heading> Controlled substances dispensed by means of the Internet</heading><paragraph class=\"indent0\" id=\"id1db9915e-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s829/e/1\"><num value=\"1\">(1)</num><content> No controlled substance that is a prescription drug as determined under the Federal Food, Drug, and Cosmetic Act [<ref href=\"/us/usc/t21/s301\">21 U.S.C. 301</ref> et seq.] may be delivered, distributed, or dispensed by means of the Internet without a valid prescription.</content>\n</paragraph>\n<paragraph class=\"indent0\" id=\"id1db9915f-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s829/e/2\"><num value=\"2\">(2)</num><chapeau> As used in this subsection:</chapeau><subparagraph class=\"indent1\" id=\"id1db99160-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s829/e/2/A\"><num value=\"A\">(A)</num><chapeau> The term “valid prescription” means a prescription that is issued for a legitimate medical purpose in the usual course of professional practice by—</chapeau><clause class=\"indent2\" id=\"id1db9b871-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s829/e/2/A/i\"><num value=\"i\">(i)</num><content> a practitioner who has conducted at least 1 in-person medical evaluation of the patient; or</content>\n</clause>\n<clause class=\"indent2\" id=\"id1db9b872-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s829/e/2/A/ii\"><num value=\"ii\">(ii)</num><content> a covering practitioner.</content>\n</clause>\n</subparagraph>\n<subparagraph class=\"indent1\" id=\"id1db9b873-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s829/e/2/B\"><num value=\"B\">(B)</num><clause class=\"indent1\" id=\"id1db9b874-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s829/e/2/B/i\"><num value=\"i\">(i)</num><content> The term “in-person medical evaluation” means a medical evaluation that is conducted with the patient in the physical presence of the practitioner, without regard to whether portions of the evaluation are conducted by other health professionals.</content>\n</clause>\n<clause class=\"indent1\" id=\"id1db9b875-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s829/e/2/B/ii\"><num value=\"ii\">(ii)</num><content> Nothing in clause (i) shall be construed to imply that 1 in-person medical evaluation demonstrates that a prescription has been issued for a legitimate medical purpose within the usual course of professional practice.</content>\n</clause>\n</subparagraph>\n<subparagraph class=\"indent1\" id=\"id1db9b876-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s829/e/2/C\"><num value=\"C\">(C)</num><chapeau> The term “covering practitioner” means, with respect to a patient, a practitioner who conducts a medical evaluation (other than an in-person medical evaluation) at the request of a practitioner who—</chapeau><clause class=\"indent2\" id=\"id1db9df87-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s829/e/2/C/i\"><num value=\"i\">(i)</num><content> has conducted at least 1 in-person medical evaluation of the patient or an evaluation of the patient through the practice of telemedicine, within the previous 24 months; and</content>\n</clause>\n<clause class=\"indent2\" id=\"id1db9df88-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s829/e/2/C/ii\"><num value=\"ii\">(ii)</num><content> is temporarily unavailable to conduct the evaluation of the patient.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph class=\"indent0\" id=\"id1db9df89-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s829/e/3\"><num value=\"3\">(3)</num><chapeau> Nothing in this subsection shall apply to—</chapeau><subparagraph class=\"indent1\" id=\"id1db9df8a-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s829/e/3/A\"><num value=\"A\">(A)</num><content> the delivery, distribution, or dispensing of a controlled substance by a practitioner engaged in the practice of telemedicine; or</content>\n</subparagraph>\n<subparagraph class=\"indent1\" id=\"id1db9df8b-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s829/e/3/B\"><num value=\"B\">(B)</num><content> the dispensing or selling of a controlled substance pursuant to practices as determined by the Attorney General by regulation, which shall be consistent with effective controls against diversion.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id1db9df8c-f63b-11e2-8470-abc29ba29c4d\">\n(<ref href=\"/us/pl/91/513/s309\">Pub.
