Prescriptions shall be retained in conformity with the requirements of <ref href=\"/us/usc/t21/s827\">section 827 of this title</ref>. No prescription for a controlled substance in schedule II may be refilled.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id5f38ce58-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Schedule III and IV substances</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Except when dispensed directly by a practitioner, other than a pharmacist, to an ultimate user, no controlled substance in schedule III or IV, which is a prescription drug as determined under the Federal Food, Drug, and Cosmetic Act [<ref href=\"/us/usc/t21/s301\">21 U.S.C. 301</ref> et seq.], may be dispensed without a written or oral prescription in conformity with section 503(b) of that Act [<ref href=\"/us/usc/t21/s353/b\">21 U.S.C. 353(b)</ref>]. Such prescriptions may not be filled or refilled more than six months after the date thereof or be refilled more than five times after the date of the prescription unless renewed by the practitioner.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id5f38ce59-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Schedule V substances</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">No controlled substance in schedule V which is a drug may be distributed or dispensed other than for a medical purpose.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id5f38ce5a-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Non-prescription drugs with abuse potential</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Whenever it appears to the Attorney General that a drug not considered to be a prescription drug under the Federal Food, Drug, and Cosmetic Act [<ref href=\"/us/usc/t21/s301\">21 U.S.C. 301</ref> et seq.] should be so considered because of its abuse potential, he shall so advise the Secretary and furnish to him all available data relevant thereto.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id5f38ce5b-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Controlled substances dispensed by means of the Internet</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id5f38ce5c-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/e/1\"><num value=\"1\">(1)</num><content> No controlled substance that is a prescription drug as determined under the Federal Food, Drug, and Cosmetic Act [<ref href=\"/us/usc/t21/s301\">21 U.S.C. 301</ref> et seq.] may be delivered, distributed, or dispensed by means of the Internet without a valid prescription.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id5f38ce5d-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/e/2\"><num value=\"2\">(2)</num><chapeau> As used in this subsection:</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id5f38f56e-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/e/2/A\"><num value=\"A\">(A)</num><chapeau> The term “valid prescription” means a prescription that is issued for a legitimate medical purpose in the usual course of professional practice by—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id5f38f56f-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/e/2/A/i\"><num value=\"i\">(i)</num><content> a practitioner who has conducted at least 1 in-person medical evaluation of the patient; or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id5f38f570-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/e/2/A/ii\"><num value=\"ii\">(ii)</num><content> a covering practitioner.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id5f38f571-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/e/2/B\"><num value=\"B\">(B)</num><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id5f38f572-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/e/2/B/i\"><num value=\"i\">(i)</num><content> The term “in-person medical evaluation” means a medical evaluation that is conducted with the patient in the physical presence of the practitioner, without regard to whether portions of the evaluation are conducted by other health professionals.</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id5f38f573-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/e/2/B/ii\"><num value=\"ii\">(ii)</num><content> Nothing in clause (i) shall be construed to imply that 1 in-person medical evaluation demonstrates that a prescription has been issued for a legitimate medical purpose within the usual course of professional practice.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id5f38f574-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/e/2/C\"><num value=\"C\">(C)</num><chapeau> The term “covering practitioner” means, with respect to a patient, a practitioner who conducts a medical evaluation (other than an in-person medical evaluation) at the request of a practitioner who—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id5f38f575-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/e/2/C/i\"><num value=\"i\">(i)</num><content> has conducted at least 1 in-person medical evaluation of the patient or an evaluation of the patient through the practice of telemedicine, within the previous 24 months; and</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id5f38f576-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/e/2/C/ii\"><num value=\"ii\">(ii)</num><content> is temporarily unavailable to conduct the evaluation of the patient.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id5f38f577-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/e/3\"><num value=\"3\">(3)</num><chapeau> Nothing in this subsection shall apply to—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id5f38f578-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/e/3/A\"><num value=\"A\">(A)</num><content> the delivery, distribution, or dispensing of a controlled substance by a practitioner engaged in the practice of telemedicine; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id5f38f579-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/e/3/B\"><num value=\"B\">(B)</num><content> the dispensing or selling of a controlled substance pursuant to practices as determined by the Attorney General by regulation, which shall be consistent with effective controls against diversion.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id5f38f57a-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Partial fills of schedule II controlled substances</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id5f38f57b-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/f/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Partial fills</heading><chapeau>A prescription for a controlled substance in schedule II may be partially filled if—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id5f38f57c-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/f/1/A\"><num value=\"A\">(A)</num><content> it is not prohibited by State law;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id5f38f57d-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/f/1/B\"><num value=\"B\">(B)</num><content> the prescription is written and filled in accordance with this subchapter, regulations prescribed by the Attorney General, and State law;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id5f38f57e-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/f/1/C\"><num value=\"C\">(C)</num><content> the partial fill is requested by the patient or the practitioner that wrote the prescription; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id5f38f57f-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/f/1/D\"><num value=\"D\">(D)</num><content> the total quantity dispensed in all partial fillings does not exceed the total quantity prescribed.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id5f38f580-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/f/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Remaining portions</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id5f38f581-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/f/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau>Except as provided in subparagraph (B), remaining portions of a partially filled prescription for a controlled substance in schedule II—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id5f38f582-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/f/2/A/i\"><num value=\"i\">(i)</num><content> may be filled; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id5f38f583-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/f/2/A/ii\"><num value=\"ii\">(ii)</num><content> shall be filled not later than 30 days after the date on which the prescription is written.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id5f38f584-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/f/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Emergency situations</heading><chapeau>In emergency situations, as described in subsection (a), the remaining portions of a partially filled prescription for a controlled substance in schedule II—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id5f38f585-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/f/2/B/i\"><num value=\"i\">(i)</num><content> may be filled; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id5f38f586-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/f/2/B/ii\"><num value=\"ii\">(ii)</num><content> shall be filled not later than 72 hours after the prescription is issued.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id5f38f587-ceff-11e7-ac08-9eab3197d358\" identifier=\"/us/usc/t21/s829/f/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Currently lawful partial fills</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Notwithstanding paragraph (1) or (2), in any circumstance in which, as of the day before <date date=\"2016-07-22\">July 22, 2016</date>, a prescription for a controlled substance in schedule II may be lawfully partially filled, the Attorney General may allow such a prescription to be partially filled.</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id5f38f588-ceff-11e7-ac08-9eab3197d358\">(<ref href=\"/us/pl/91/513/tII\">Pub.
