L. 115–271, title III, § 3204(a), Oct. 24, 2018, 132 Stat. 3945.)","seq_in_title":470,"parent_identifier":"/us/usc/t21/ch13/schI/ptC","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13","level":"chapter","num":"CHAPTER 13—","heading":"DRUG ABUSE PREVENTION AND CONTROL","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"CONTROL AND ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13/schI/ptC","level":"part","num":"Part C—","heading":"Registration of Manufacturers, Distributors, and Dispensers of Controlled Substances","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idd1e4beaa-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s829a\"><num value=\"829a\">§ 829a.</num><heading> Delivery of a controlled substance by a pharmacy to an administering practitioner</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd1e4beab-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s829a/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><chapeau>Notwithstanding <ref href=\"/us/usc/t21/s802/10\">section 802(10) of this title</ref>, a pharmacy may deliver a controlled substance to a practitioner in accordance with a prescription that meets the requirements of this subchapter and the regulations issued by the Attorney General under this subchapter, for the purpose of administering the controlled substance by the practitioner if—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd1e4beac-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s829a/a/1\"><num value=\"1\">(1)</num><content> the controlled substance is delivered by the pharmacy to the prescribing practitioner or the practitioner administering the controlled substance, as applicable, at the location listed on the practitioner’s certificate of registration issued under this subchapter;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd1e4bead-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s829a/a/2\"><num value=\"2\">(2)</num><chapeau> the controlled substance is to be administered for the purpose of maintenance or detoxification treatment under <ref href=\"/us/usc/t21/s823/g/2\">section 823(g)(2) of this title</ref> and—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd1e4beae-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s829a/a/2/A\"><num value=\"A\">(A)</num><content> the practitioner who issued the prescription is a qualifying practitioner authorized under, and acting within the scope of that section; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd1e4beaf-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s829a/a/2/B\"><num value=\"B\">(B)</num><content> the controlled substance is to be administered by injection or implantation;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd1e4beb0-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s829a/a/3\"><num value=\"3\">(3)</num><content> the pharmacy and the practitioner are authorized to conduct the activities specified in this section under the law of the State in which such activities take place;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd1e4beb1-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s829a/a/4\"><num value=\"4\">(4)</num><content> the prescription is not issued to supply any practitioner with a stock of controlled substances for the purpose of general dispensing to patients;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd1e4beb2-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s829a/a/5\"><num value=\"5\">(5)</num><content> except as provided in subsection (b), the controlled substance is to be administered only to the patient named on the prescription not later than 14 days after the date of receipt of the controlled substance by the practitioner; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd1e4beb3-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s829a/a/6\"><num value=\"6\">(6)</num><content> notwithstanding any exceptions under <ref href=\"/us/usc/t21/s827\">section 827 of this title</ref>, the prescribing practitioner, and the practitioner administering the controlled substance, as applicable, maintain complete and accurate records of all controlled substances delivered, received, administered, or otherwise disposed of under this section, including the persons to whom controlled substances were delivered and such other information as may be required by regulations of the Attorney General.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd1e4beb4-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s829a/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Modification of number of days before which controlled substance shall be administered</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd1e4e5c5-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s829a/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Initial 2-year period</heading><chapeau>During the 2-year period beginning on <date date=\"2018-10-24\">October 24, 2018</date>, the Attorney General, in coordination with the Secretary, may reduce the number of days described in subsection (a)(5) if the Attorney General determines that such reduction will—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd1e4e5c6-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s829a/b/1/A\"><num value=\"A\">(A)</num><content> reduce the risk of diversion; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd1e4e5c7-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s829a/b/1/B\"><num value=\"B\">(B)</num><content> protect the public health.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd1e4e5c8-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s829a/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Modifications after submission of report</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">After the date on which the report described in section 3204(b) of the SUPPORT for Patients and Communities Act is submitted, the Attorney General, in coordination with the Secretary, may modify the number of days described in subsection (a)(5).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd1e4e5c9-09f4-11e9-8d96-9378be633404\" identifier=\"/us/usc/t21/s829a/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Minimum number of days</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Any modification under this subsection shall be for a period of not less than 7 days.</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idd1e4e5ca-09f4-11e9-8d96-9378be633404\">(<ref href=\"/us/pl/91/513/tII\">Pub.
