L. 103–322, title XVIII, § 180201(b)(1), Sept. 13, 1994, 108 Stat. 2046.)","seq_in_title":476,"parent_identifier":"/us/usc/t21/ch13/schI/ptD","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13","level":"chapter","num":"CHAPTER 13—","heading":"DRUG ABUSE PREVENTION AND CONTROL","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"CONTROL AND ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13/schI/ptD","level":"part","num":"Part D—","heading":"Offenses and Penalties","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id28897405-93e5-11e7-9024-a70e43310041\" identifier=\"/us/usc/t21/s849\"><num value=\"849\">§ 849.</num><heading> Transportation safety offenses</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id28897406-93e5-11e7-9024-a70e43310041\" identifier=\"/us/usc/t21/s849/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Definitions</heading><chapeau>In this section—</chapeau><chapeau style=\"-uslm-lc:I12\" role=\"listItem\" class=\"indent1\">“safety rest area” means a roadside facility with parking facilities for the rest or other needs of motorists.</chapeau>\n<chapeau style=\"-uslm-lc:I12\" role=\"listItem\" class=\"indent1\">“truck stop” means a facility (including any parking lot appurtenant thereto) that—</chapeau>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id28897407-93e5-11e7-9024-a70e43310041\" identifier=\"/us/usc/t21/s849/a/A\"><num value=\"A\">(A)</num><content> has the capacity to provide fuel or service, or both, to any commercial motor vehicle (as defined in <ref href=\"/us/usc/t49/s31301\">section 31301 of title 49</ref>), operating in commerce (as defined in that section); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id28897408-93e5-11e7-9024-a70e43310041\" identifier=\"/us/usc/t21/s849/a/B\"><num value=\"B\">(B)</num><content> is located within 2,500 feet of the National System of Interstate and Defense Highways or the Federal-Aid Primary System.</content>\n</subparagraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id28897409-93e5-11e7-9024-a70e43310041\" identifier=\"/us/usc/t21/s849/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> First offense</heading><chapeau>A person who violates <ref href=\"/us/usc/t21/s841/a/1\">section 841(a)(1) of this title</ref> or <ref href=\"/us/usc/t21/s856\">section 856 of this title</ref> by distributing or possessing with intent to distribute a controlled substance in or on, or within 1,000 feet of, a truck stop or safety rest area is (except as provided in subsection (b)) <ref class=\"footnoteRef\" idref=\"fn002132\">1</ref><note type=\"footnote\" id=\"fn002132\"><num>1</num> So in original. Probably should refer to subsection (c).</note> subject to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2889740a-93e5-11e7-9024-a70e43310041\" identifier=\"/us/usc/t21/s849/b/1\"><num value=\"1\">(1)</num><content> twice the maximum punishment authorized by <ref href=\"/us/usc/t21/s841/b\">section 841(b) of this title</ref>; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id28899b1b-93e5-11e7-9024-a70e43310041\" identifier=\"/us/usc/t21/s849/b/2\"><num value=\"2\">(2)</num><content> twice any term of supervised release authorized by <ref href=\"/us/usc/t21/s841/b\">section 841(b) of this title</ref> for a first offense.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id28899b1c-93e5-11e7-9024-a70e43310041\" identifier=\"/us/usc/t21/s849/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Subsequent offense</heading><chapeau>A person who violates <ref href=\"/us/usc/t21/s841/a/1\">section 841(a)(1) of this title</ref> or <ref href=\"/us/usc/t21/s856\">section 856 of this title</ref> by distributing or possessing with intent to distribute a controlled substance in or on, or within 1,000 feet of, a truck stop or a safety rest area after a prior conviction or convictions under subsection (a) <ref class=\"footnoteRef\" idref=\"fn002133\">2</ref><note type=\"footnote\" id=\"fn002133\"><num>2</num> So in original.
