<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" id="id1dce515c-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s849"><num value="849">§ 849.</num><heading> Transportation safety offenses</heading><subsection class="indent0" id="id1dce515d-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s849/a"><num value="a">(a)</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="blockIndent0">In this section—</chapeau>
<chapeau style="-uslm-lc:I12" class="blockIndent1">“safety rest area” means a roadside facility with parking facilities for the rest or other needs of motorists.</chapeau>
<chapeau style="-uslm-lc:I12" class="blockIndent1">“truck stop” means a facility (including any parking lot appurtenant thereto) that—</chapeau><subparagraph class="indent2" id="id1dce515e-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s849/a/A"><num value="A">(A)</num><content> has the capacity to provide fuel or service, or both, to any commercial motor vehicle (as defined in <ref href="/us/usc/t49/s31301">section 31301 of title 49</ref>), operating in commerce (as defined in that section); and</content>
</subparagraph>
<subparagraph class="indent2" id="id1dce786f-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s849/a/B"><num value="B">(B)</num><content> is located within 2,500 feet of the National System of Interstate and Defense Highways or the Federal-Aid Primary System.</content>
</subparagraph>
</subsection>
<subsection class="indent0" id="id1dce7870-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s849/b"><num value="b">(b)</num><heading> First offense</heading>
<chapeau style="-uslm-lc:I11" class="blockIndent0">A person who violates <ref href="/us/usc/t21/s841/a/1">section 841(a)(1) of this title</ref> or <ref href="/us/usc/t21/s856">section 856 of this title</ref> by distributing or possessing with intent to distribute a controlled substance in or on, or within 1,000 feet of, a truck stop or safety rest area is (except as provided in subsection (b) <ref class="footnoteRef" idref="fn002104">1</ref><note type="footnote" id="fn002104"><num>1</num> So in original. Probably should be subsection “(c)”.</note> of this section) subject to—</chapeau><paragraph class="indent1" id="id1dce7871-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s849/b/1"><num value="1">(1)</num><content> twice the maximum punishment authorized by <ref href="/us/usc/t21/s841/b">section 841(b) of this title</ref>; and</content>
</paragraph>
<paragraph class="indent1" id="id1dce7872-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s849/b/2"><num value="2">(2)</num><content> twice any term of supervised release authorized by <ref href="/us/usc/t21/s841/b">section 841(b) of this title</ref> for a first offense.</content>

<subsection class="indent0" id="id1dce7873-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s849/c"><num value="c">(c)</num><heading> Subsequent offense</heading>
<chapeau style="-uslm-lc:I11" class="blockIndent0">A person who violates <ref href="/us/usc/t21/s841/a/1">section 841(a)(1) of this title</ref> or <ref href="/us/usc/t21/s856">section 856 of this title</ref> by distributing or possessing with intent to distribute a controlled substance in or on, or within 1,000 feet of, a truck stop or a safety rest area after a prior conviction or convictions under subsection (a) <ref class="footnoteRef" idref="fn002105">2</ref><note type="footnote" id="fn002105"><num>2</num> So in original. Probably should be subsection “(b)”.</note> of this section have become final is subject to—</chapeau><paragraph class="indent1" id="id1dce9f84-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s849/c/1"><num value="1">(1)</num><content> 3 times the maximum punishment authorized by <ref href="/us/usc/t21/s841/b">section 841(b) of this title</ref>; and</content>
</paragraph>
