L. 108–21, title VI, § 608(b)(1), (2), (c), Apr. 30, 2003, 117 Stat. 691.)","seq_in_title":483,"parent_identifier":"/us/usc/t21/ch13/schI/ptD","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13","level":"chapter","num":"CHAPTER 13—","heading":"DRUG ABUSE PREVENTION AND CONTROL","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"CONTROL AND ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13/schI/ptD","level":"part","num":"Part D—","heading":"Offenses and Penalties","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idec97a7af-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s856\"><num value=\"856\">§ 856.</num><heading> Maintaining drug-involved premises</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idec97a7b0-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s856/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Unlawful acts</heading><chapeau>Except as authorized by this subchapter, it shall be unlawful to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idec97a7b1-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s856/a/1\"><num value=\"1\">(1)</num><content> knowingly open, lease, rent, use, or maintain any place, whether permanently or temporarily, for the purpose of manufacturing, distributing, or using any controlled substance;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idec97a7b2-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s856/a/2\"><num value=\"2\">(2)</num><content> manage or control any place, whether permanently or temporarily, either as an owner, lessee, agent, employee, occupant, or mortgagee, and knowingly and intentionally rent, lease, profit from, or make available for use, with or without compensation, the place for the purpose of unlawfully manufacturing, storing, distributing, or using a controlled substance.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idec97a7b3-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s856/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Criminal penalties</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Any person who violates subsection (a) of this section shall be sentenced to a term of imprisonment of not more than 20 years or a fine of not more than $500,000, or both, or a fine of $2,000,000 for a person other than an individual.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idec97a7b4-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s856/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Violation as offense against property</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">A violation of subsection (a) shall be considered an offense against property for purposes of <ref href=\"/us/usc/t18/s3663A/c/1/A/ii\">section 3663A(c)(1)(A)(ii) of title 18</ref>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idec97a7b5-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s856/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Civil penalties</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idec97a7b6-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s856/d/1\"><num value=\"1\">(1)</num><chapeau> Any person who violates subsection (a) shall be subject to a civil penalty of not more than the greater of—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idec97a7b7-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s856/d/1/A\"><num value=\"A\">(A)</num><content> $250,000; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idec97a7b8-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s856/d/1/B\"><num value=\"B\">(B)</num><content> 2 times the gross receipts, either known or estimated, that were derived from each violation that is attributable to the person.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idec97a7b9-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s856/d/2\"><num value=\"2\">(2)</num><content> If a civil penalty is calculated under paragraph (1)(B), and there is more than 1 defendant, the court may apportion the penalty between multiple violators, but each violator shall be jointly and severally liable for the civil penalty under this subsection.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idec97a7ba-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s856/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Declaratory and injunctive remedies</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Any person who violates subsection (a) shall be subject to declaratory and injunctive remedies as set forth in <ref href=\"/us/usc/t21/s843/f\">section 843(f) of this title</ref>.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idec97a7bb-0c74-11e6-b5d4-9376778ac99d\">(<ref href=\"/us/pl/91/513/tII\">Pub.
