Except to the extent a greater minimum sentence is otherwise provided by <ref href=\"/us/usc/t21/s841/b\">section 841(b) of this title</ref>, a term of imprisonment under this subsection shall be not less than one year. The mandatory minimum sentencing provisions of this subsection shall not apply to offenses involving 5 grams or less of marihuana.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id7db795a8-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s859/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Second offense</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Except as provided in <ref href=\"/us/usc/t21/s860\">section 860 of this title</ref>, any person at least eighteen years of age who violates <ref href=\"/us/usc/t21/s841/a/1\">section 841(a)(1) of this title</ref> by distributing a controlled substance to a person under twenty-one years of age after a prior conviction under subsection (a) of this section (or under <ref href=\"/us/usc/t21/s333/b\">section 333(b) of this title</ref> as in effect prior to <date date=\"1971-05-01\">May 1, 1971</date>) has become final, is subject to (1) three times the maximum punishment authorized by <ref href=\"/us/usc/t21/s841/b\">section 841(b) of this title</ref>, and (2) at least three times any term of supervised release authorized by <ref href=\"/us/usc/t21/s841/b\">section 841(b) of this title</ref>, for a second or subsequent offense involving the same controlled substance and schedule. Except to the extent a greater minimum sentence is otherwise provided by <ref href=\"/us/usc/t21/s841/b\">section 841(b) of this title</ref>, a term of imprisonment under this subsection shall be not less than one year.
