<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idc3a7aab2-8eec-11e6-a076-e06bbb453686" identifier="/us/usc/t21/s861"><num value="861">§ 861.</num><heading> Employment or use of persons under 18 years of age in drug operations</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc3a7aab3-8eec-11e6-a076-e06bbb453686" identifier="/us/usc/t21/s861/a"><num value="a" class="bold">(a)</num><heading class="bold"> Unlawful acts</heading><chapeau>It shall be unlawful for any person at least eighteen years of age to knowingly and intentionally—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idc3a7aab4-8eec-11e6-a076-e06bbb453686" identifier="/us/usc/t21/s861/a/1"><num value="1">(1)</num><content> employ, hire, use, persuade, induce, entice, or coerce, a person under eighteen years of age to violate any provision of this subchapter or subchapter II;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idc3a7aab5-8eec-11e6-a076-e06bbb453686" identifier="/us/usc/t21/s861/a/2"><num value="2">(2)</num><content> employ, hire, use, persuade, induce, entice, or coerce, a person under eighteen years of age to assist in avoiding detection or apprehension for any offense of this subchapter or subchapter II by any Federal, State, or local law enforcement official; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idc3a7aab6-8eec-11e6-a076-e06bbb453686" identifier="/us/usc/t21/s861/a/3"><num value="3">(3)</num><content> receive a controlled substance from a person under 18 years of age, other than an immediate family member, in violation of this subchapter or subchapter II.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc3a7aab7-8eec-11e6-a076-e06bbb453686" identifier="/us/usc/t21/s861/b"><num value="b" class="bold">(b)</num><heading class="bold"> Penalty for first offense</heading><content><p style="-uslm-lc:I11" class="indent0">Any person who violates subsection (a) is subject to twice the maximum punishment otherwise authorized and at least twice any term of supervised release otherwise authorized for a first offense. Except to the extent a greater minimum sentence is otherwise provided, a term of imprisonment under this subsection shall not be less than one year.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc3a7aab8-8eec-11e6-a076-e06bbb453686" identifier="/us/usc/t21/s861/c"><num value="c" class="bold">(c)</num><heading class="bold"> Penalty for subsequent offenses</heading><content><p style="-uslm-lc:I11" class="indent0">Any person who violates subsection (a) after a prior conviction under subsection (a) of this section has become final, is subject to three times the maximum punishment otherwise authorized and at least three times any term of supervised release otherwise authorized for a first offense. Except to the extent a greater minimum sentence is otherwise provided, a term of imprisonment under this subsection shall not be less than one year. Penalties for third and subsequent convictions shall be governed by <ref href="/us/usc/t21/s841/b/1/A">section 841(b)(1)(A) of this title</ref>.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc3a7aab9-8eec-11e6-a076-e06bbb453686" identifier="/us/usc/t21/s861/d"><num value="d" class="bold">(d)</num><heading class="bold"> Penalty for providing or distributing controlled substance to underage person</heading><chapeau>Any person who violates subsection (a)(1) or (2) <ref class="footnoteRef" idref="fn002115">1</ref><note type="footnote" id="fn002115"><num>1</num> So in original. <paragraph style="-uslm-lc:I12" class="indent1" id="idc3a7aabb-8eec-11e6-a076-e06bbb453686" identifier="/us/usc/t21/s861/d/2"><num value="2">(2)</num><content> if the person employed, hired, or used is fourteen years of age or younger,</content>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">shall be subject to a term of imprisonment for not more than five years or a fine of not more than $50,000, or both, in addition to any other punishment authorized by this section.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc3a7aabc-8eec-11e6-a076-e06bbb453686" identifier="/us/usc/t21/s861/e"><num value="e" class="bold">(e)</num><heading class="bold"> Suspension of sentence; probation; parole</heading><content><p style="-uslm-lc:I11" class="indent0">In any case of any sentence imposed under this section, imposition or execution of such sentence shall not be suspended and probation shall not be granted. An individual convicted under this section of an offense for which a mandatory minimum term of imprisonment is applicable shall not be eligible for parole under <ref href="/us/usc/t18/s4202">section 4202 of title 18</ref> <ref class="footnoteRef" idref="fn002116">2</ref><note type="footnote" id="fn002116"><num>2</num> See References in Text note below.</note> until the individual has served the mandatory term of imprisonment as enhanced by this section.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc3a7aabd-8eec-11e6-a076-e06bbb453686" identifier="/us/usc/t21/s861/f"><num value="f" class="bold">(f)</num><heading class="bold"> Distribution of controlled substance to pregnant individual</heading><content><p style="-uslm-lc:I11" class="indent0">Except as authorized by this subchapter, it shall be unlawful for any person to knowingly or intentionally provide or distribute any controlled substance to a pregnant individual in violation of any provision of this subchapter. Any person who violates this subsection shall be subject to the provisions of subsections (b), (c), and (e).</p>
