value=\"862a\">§ 862a.</num><heading> Denial of assistance and benefits for certain drug-related convictions</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id41bd6a1d-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><chapeau>An individual convicted (under Federal or State law) of any offense which is classified as a felony by the law of the jurisdiction involved and which has as an element the possession, use, or distribution of a controlled substance (as defined in <ref href=\"/us/usc/t21/s802/6\">section 802(6) of this title</ref>) shall not be eligible for—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id41bd6a1e-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/a/1\"><num value=\"1\">(1)</num><content> assistance under any State program funded under part A of title IV of the Social Security Act [<ref href=\"/us/usc/t42/s601\">42 U.S.C. 601</ref> et seq.], or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id41bd6a1f-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/a/2\"><num value=\"2\">(2)</num><content> benefits under the supplemental nutrition assistance program (as defined in section 3 of the Food and Nutrition Act of 2008 (<ref href=\"/us/usc/t7/s2012\">7 U.S.C. 2012</ref>)) or any State program carried out under that Act [<ref href=\"/us/usc/t7/s2011\">7 U.S.C. 2011</ref> et seq.].</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id41bd6a20-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Effects on assistance and benefits for others</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id41bd6a21-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Program of temporary assistance for needy families</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The amount of assistance otherwise required to be provided under a State program funded under part A of title IV of the Social Security Act [<ref href=\"/us/usc/t42/s601\">42 U.S.C. 601</ref> et seq.] to the family members of an individual to whom subsection (a) applies shall be reduced by the amount which would have otherwise been made available to the individual under such part.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id41bd6a22-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Benefits under the Food and Nutrition Act of 2008</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The amount of benefits otherwise required to be provided to a household under the supplemental nutrition assistance program (as defined in section 3 of the Food and Nutrition Act of 2008 (<ref href=\"/us/usc/t7/s2012\">7 U.S.C. 2012</ref>)), or any State program carried out under that Act [<ref href=\"/us/usc/t7/s2011\">7 U.S.C. 2011</ref> et seq.], shall be determined by considering the individual to whom subsection (a) applies not to be a member of such household, except that the income and resources of the individual shall be considered to be income and resources of the household.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id41bd6a23-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Enforcement</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">A State that has not exercised its authority under subsection (d)(1)(A) shall require each individual applying for assistance or benefits referred to in subsection (a), during the application process, to state, in writing, whether the individual, or any member of the household of the individual, has been convicted of a crime described in subsection (a).</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id41bd6a24-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Limitations</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id41bd6a25-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> State elections</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id41bd6a26-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/d/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Opt out</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">A State may, by specific reference in a law enacted after <date date=\"1996-08-22\">August 22, 1996</date>, exempt any or all individuals domiciled in the State from the application of subsection (a).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id41bd6a27-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/d/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Limit period of prohibition</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">A State may, by law enacted after <date date=\"1996-08-22\">August 22, 1996</date>, limit the period for which subsection (a) shall apply to any or all individuals domiciled in the State.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id41bd6a28-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Inapplicability to convictions occurring on or before <date date=\"1996-08-22\">August 22, 1996</date></heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Subsection (a) shall not apply to a conviction if the conviction is for conduct occurring on or before <date date=\"1996-08-22\">August 22, 1996</date>.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id41bd6a29-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> “State” defined</heading><chapeau>For purposes of this section, the term “State” has the meaning given it—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id41bd6a2a-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/e/1\"><num value=\"1\">(1)</num><content> in section 419(5) of the Social Security Act [<ref href=\"/us/usc/t42/s619/5\">42 U.S.C. 619(5)</ref>], when referring to assistance provided under a State program funded under part A of title IV of the Social Security Act [<ref href=\"/us/usc/t42/s601\">42 U.S.C. 601</ref> et seq.], and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id41bd6a2b-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/e/2\"><num value=\"2\">(2)</num><content> in section 3 of the Food and Nutrition Act of 2008 (<ref href=\"/us/usc/t7/s2012\">7 U.S.C. 2012</ref>), when referring to the supplemental nutrition assistance program (as defined in that section) or any State program carried out under that Act [<ref href=\"/us/usc/t7/s2011\">7 U.S.C. 2011</ref> et seq.].</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id41bd6a2c-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Rule of interpretation</heading><chapeau>Nothing in this section shall be construed to deny the following Federal benefits:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id41bd6a2d-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/f/1\"><num value=\"1\">(1)</num><content> Emergency medical services under title XIX of the Social Security Act [<ref href=\"/us/usc/t42/s1396\">42 U.S.C. 1396</ref> et seq.].</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id41bd6a2e-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/f/2\"><num value=\"2\">(2)</num><content> Short-term, noncash, in-kind emergency disaster relief.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id41bd6a2f-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/f/3\"><num value=\"3\">(3)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id41bd6a30-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/f/3/A\"><num value=\"A\">(A)</num><content> Public health assistance for immunizations.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id41bd6a31-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/f/3/B\"><num value=\"B\">(B)</num><content> Public health assistance for testing and treatment of communicable diseases if the Secretary of Health and Human Services determines that it is necessary to prevent the spread of such disease.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id41bd6a32-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/f/4\"><num value=\"4\">(4)</num><content> Prenatal care.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id41bd6a33-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/f/5\"><num value=\"5\">(5)</num><content> Job training programs.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id41bd6a34-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s862a/f/6\"><num value=\"6\">(6)</num><content> Drug treatment
