<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" id="id1dd7ef0f-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a"><num value="862a">§ 862a.</num><heading> Denial of assistance and benefits for certain drug-related convictions</heading><subsection class="indent0" id="id1dd7ef10-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/a"><num value="a">(a)</num><heading> In general</heading>
<chapeau style="-uslm-lc:I11" class="blockIndent0">An individual convicted (under Federal or State law) of any offense which is classified as a felony by the law of the jurisdiction involved and which has as an element the possession, use, or distribution of a controlled substance (as defined in <ref href="/us/usc/t21/s802/6">section 802(6) of this title</ref>) shall not be eligible for—</chapeau><paragraph class="indent1" id="id1dd7ef11-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/a/1"><num value="1">(1)</num><content> assistance under any State program funded under part A of title IV of the Social Security Act [<ref href="/us/usc/t42/s601">42 U.S.C. 601</ref> et seq.], or</content>
</paragraph>
<paragraph class="indent1" id="id1dd7ef12-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/a/2"><num value="2">(2)</num><content> benefits under the food stamp program (as defined in section 3(<i>l</i>) of the Food Stamp Act of 1977 [<ref href="/us/usc/t7/s2012">7 U.S.C. 2012</ref>(<i>l</i>)]) or any State program carried out under the Food Stamp Act of 1977 [<ref href="/us/usc/t7/s2011">7 U.S.C. 2011</ref> et seq.].</content>
</paragraph>
</subsection>
<subsection class="indent0" id="id1dd7ef13-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/b"><num value="b">(b)</num><heading> Effects on assistance and benefits for others</heading><paragraph class="indent1" id="id1dd7ef14-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/b/1"><num value="1">(1)</num><heading> Program of temporary assistance for needy families</heading><content><p style="-uslm-lc:I12" class="indent1">The amount of assistance otherwise required to be provided under a State program funded under part A of title IV of the Social Security Act [<ref href="/us/usc/t42/s601">42 U.S.C. 601</ref> et seq.] to the family members of an individual to whom subsection (a) of this section applies shall be reduced by the amount which would have otherwise been made available to the individual under such part.</p>

<paragraph class="indent1" id="id1dd81525-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/b/2"><num value="2">(2)</num><heading> Benefits under the Food Stamp Act of 1977</heading><content><p style="-uslm-lc:I12" class="indent1">The amount of benefits otherwise required to be provided to a household under the food stamp program (as defined in section 3(<i>l</i>) of the Food Stamp Act of 1977 [<ref href="/us/usc/t7/s2012">7 U.S.C. 2012</ref>(<i>l</i>)]), or any State program carried out under the Food Stamp Act of 1977 [<ref href="/us/usc/t7/s2011">7 U.S.C. 2011</ref> et seq.], shall be determined by considering the individual to whom subsection (a) of this section applies not to be a member of such household, except that the income and resources of the individual shall be considered to be income and resources of the household.</p>

</subsection>
<subsection class="indent0" id="id1dd81526-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/c"><num value="c">(c)</num><heading> Enforcement</heading><content><p style="-uslm-lc:I11" class="indent0">A State that has not exercised its authority under subsection (d)(1)(A) of this section shall require each individual applying for assistance or benefits referred to in subsection (a) of this section, during the application process, to state, in writing, whether the individual, or any member of the household of the individual, has been convicted of a crime described in subsection (a) of this section.</p>

<subsection class="indent0" id="id1dd83c37-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/d"><num value="d">(d)</num><heading> Limitations</heading><paragraph class="indent1" id="id1dd83c38-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/d/1"><num value="1">(1)</num><heading> State elections</heading><subparagraph class="indent2" id="id1dd83c39-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/d/1/A"><num value="A">(A)</num><heading> Opt out</heading><content><p style="-uslm-lc:I13" class="indent2">A State may, by specific reference in a law enacted after <date date="1996-08-22">August 22, 1996</date>, exempt any or all individuals domiciled in the State from the application of subsection (a) of this section.</p>

</subparagraph>
<subparagraph class="indent2" id="id1dd83c3a-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/d/1/B"><num value="B">(B)</num><heading> Limit period of prohibition</heading><content><p style="-uslm-lc:I13" class="indent2">A State may, by law enacted after <date date="1996-08-22">August 22, 1996</date>, limit the period for which subsection (a) of this section shall apply to any or all individuals domiciled in the State.</p>

<paragraph class="indent1" id="id1dd83c3b-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/d/2"><num value="2">(2)</num><heading> Inapplicability to convictions occurring on or before <date date="1996-08-22">August 22, 1996</date></heading><content><p style="-uslm-lc:I12" class="indent1">Subsection (a) of this section shall not apply to a conviction if the conviction is for conduct occurring on or before <date date="1996-08-22">August 22, 1996</date>.</p>

<subsection class="indent0" id="id1dd83c3c-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/e"><num value="e">(e)</num><heading> “State” defined</heading>
<chapeau style="-uslm-lc:I11" class="blockIndent0">For purposes of this section, the term “State” has the meaning given it—</chapeau><paragraph class="indent1" id="id1dd83c3d-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/e/1"><num value="1">(1)</num><content> in section 419(5) of the Social Security Act [<ref href="/us/usc/t42/s619/5">42 U.S.C. 619(5)</ref>], when referring to assistance provided under a State program funded under part A of title IV of the Social Security Act [<ref href="/us/usc/t42/s601">42 U.S.C. 601</ref> et seq.], and</content>
</paragraph>
<paragraph class="indent1" id="id1dd8634e-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/e/2"><num value="2">(2)</num><content> in section 3(s) of the Food Stamp Act of 1977 [<ref href="/us/usc/t7/s2012/s">7 U.S.C. 2012(s)</ref>], when referring to the food stamp program (as defined in section 3(<i>l</i>) of the Food Stamp Act of 1977 [<ref href="/us/usc/t7/s2012">7 U.S.C. 2012</ref>(<i>l</i>)]) or any State program carried out under the Food Stamp Act of 1977 [<ref href="/us/usc/t7/s2011">7 U.S.C. 2011</ref> et seq.].</content>

<subsection class="indent0" id="id1dd8634f-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/f"><num value="f">(f)</num><heading> Rule of interpretation</heading>
<chapeau style="-uslm-lc:I11" class="blockIndent0">Nothing in this section shall be construed to deny the following Federal benefits:</chapeau><paragraph class="indent1" id="id1dd86350-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/f/1"><num value="1">(1)</num><content> Emergency medical services under title XIX of the Social Security Act [<ref href="/us/usc/t42/s1396">42 U.S.C. 1396</ref> et seq.].</content>

<paragraph class="indent1" id="id1dd86351-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/f/2"><num value="2">(2)</num><content> Short-term, noncash, in-kind emergency disaster relief.</content>
</paragraph>
<paragraph class="indent1" id="id1dd86352-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/f/3"><num value="3">(3)</num><subparagraph class="indent1" id="id1dd86353-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/f/3/A"><num value="A">(A)</num><content> Public health assistance for immunizations.</content>
</subparagraph>
<subparagraph class="indent1" id="id1dd86354-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s862a/f/3/B"><num value="B">(B)</num><content> Public health assistance for testing and treatment of communicable diseases if the Secretary of Health and Human Services determines that it is necessary to prevent the spread of such disease.</content>
</subparagraph>
