B, title XXXVI, § 3614, Oct. 17, 2000, 114 Stat. 1230.)","seq_in_title":462,"parent_identifier":"/us/usc/t21/ch13/schI/ptD","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13","level":"chapter","num":"CHAPTER 13—","heading":"DRUG ABUSE PREVENTION AND CONTROL","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"CONTROL AND ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13/schI/ptD","level":"part","num":"Part D—","heading":"Offenses and Penalties","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" id=\"id87466cd0-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863\"><num value=\"863\">§ 863.</num><heading> Drug paraphernalia</heading><subsection class=\"indent0\" id=\"id87466cd1-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/a\"><num value=\"a\">(a)</num><heading> In general</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"blockIndent0\">It is unlawful for any person—</chapeau><paragraph class=\"indent1\" id=\"id87466cd2-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/a/1\"><num value=\"1\">(1)</num><content> to sell or offer for sale drug paraphernalia;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466cd3-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/a/2\"><num value=\"2\">(2)</num><content> to use the mails or any other facility of interstate commerce to transport drug paraphernalia; or</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466cd4-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/a/3\"><num value=\"3\">(3)</num><content> to import or export drug paraphernalia.</content>\n</paragraph>\n</subsection>\n<subsection class=\"indent0\" id=\"id87466cd5-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/b\"><num value=\"b\">(b)</num><heading> Penalties</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Anyone convicted of an offense under subsection (a) of this section shall be imprisoned for not more than three years and fined under title 18.</p>\n</content>\n</subsection>\n<subsection class=\"indent0\" id=\"id87466cd6-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/c\"><num value=\"c\">(c)</num><heading> Seizure and forfeiture</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Any drug paraphernalia involved in any violation of subsection (a) of this section shall be subject to seizure and forfeiture upon the conviction of a person for such violation. Any such paraphernalia shall be delivered to the Administrator of General Services, General Services Administration, who may order such paraphernalia destroyed or may authorize its use for law enforcement or educational purposes by Federal, State, or local authorities.</p>\n</content>\n</subsection>\n<subsection class=\"indent0\" id=\"id87466cd7-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/d\"><num value=\"d\">(d)</num><heading> “Drug paraphernalia” defined</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"blockIndent0\">The term “drug paraphernalia” means any equipment, product, or material of any kind which is primarily intended or designed for use in manufacturing, compounding, converting, concealing, producing, processing, preparing, injecting, ingesting, inhaling, or otherwise introducing into the human body a controlled substance, possession of which is unlawful under this subchapter. It includes items primarily intended or designed for use in ingesting, inhaling, or otherwise introducing marijuana,<ref class=\"footnoteRef\" idref=\"fn002110\">1</ref><note type=\"footnote\" id=\"fn002110\"><num>1</num> So in original. Probably should be “marihuana,”.</note> cocaine, hashish, hashish oil, PCP, methamphetamine, or amphetamines into the human body, such as—</chapeau><paragraph class=\"indent1\" id=\"id87466cd8-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/d/1\"><num value=\"1\">(1)</num><content> metal, wooden, acrylic, glass, stone, plastic, or ceramic pipes with or without screens, permanent screens, hashish heads, or punctured metal bowls;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466cd9-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/d/2\"><num value=\"2\">(2)</num><content> water pipes;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466cda-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/d/3\"><num value=\"3\">(3)</num><content> carburetion tubes and devices;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466cdb-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/d/4\"><num value=\"4\">(4)</num><content> smoking and carburetion masks;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466cdc-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/d/5\"><num value=\"5\">(5)</num><content> roach clips: meaning objects used to hold burning material, such as a marihuana cigarette, that has become too small or too short to be held in the hand;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466cdd-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/d/6\"><num value=\"6\">(6)</num><content> miniature spoons with level capacities of one-tenth cubic centimeter or less;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466cde-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/d/7\"><num value=\"7\">(7)</num><content> chamber pipes;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466cdf-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/d/8\"><num value=\"8\">(8)</num><content> carburetor pipes;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466ce0-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/d/9\"><num value=\"9\">(9)</num><content> electric pipes;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466ce1-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/d/10\"><num value=\"10\">(10)</num><content> air-driven pipes;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466ce2-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/d/11\"><num value=\"11\">(11)</num><content> chillums;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466ce3-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/d/12\"><num value=\"12\">(12)</num><content> bongs;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466ce4-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/d/13\"><num value=\"13\">(13)</num><content> ice pipes or chillers;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466ce5-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/d/14\"><num value=\"14\">(14)</num><content> wired cigarette papers; or</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466ce6-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/d/15\"><num value=\"15\">(15)</num><content> cocaine freebase kits.</content>\n</paragraph>\n</subsection>\n<subsection class=\"indent0\" id=\"id87466ce7-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/e\"><num value=\"e\">(e)</num><heading> Matters considered in determination of what constitutes drug paraphernalia</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"blockIndent0\">In determining whether an item constitutes drug paraphernalia, in addition to all other logically relevant factors, the following may be considered:</chapeau><paragraph class=\"indent1\" id=\"id87466ce8-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/e/1\"><num value=\"1\">(1)</num><content> instructions, oral or written, provided with the item concerning its use;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466ce9-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/e/2\"><num value=\"2\">(2)</num><content> descriptive materials accompanying the item which explain or depict its use;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466cea-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/e/3\"><num value=\"3\">(3)</num><content> national and local advertising concerning its use;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466ceb-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/e/4\"><num value=\"4\">(4)</num><content> the manner in which the item is displayed for sale;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466cec-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/e/5\"><num value=\"5\">(5)</num><content> whether the owner, or anyone in control of the item, is a legitimate supplier of like or related items to the community, such as a licensed distributor or dealer of tobacco products;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466ced-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/e/6\"><num value=\"6\">(6)</num><content> direct or circumstantial evidence of the ratio of sales of the item(s) to the total sales of the business enterprise;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466cee-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/e/7\"><num value=\"7\">(7)</num><content> the existence and scope of legitimate uses of the item in the community; and</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466cef-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/e/8\"><num value=\"8\">(8)</num><content> expert testimony concerning its use.</content>\n</paragraph>\n</subsection>\n<subsection class=\"indent0\" id=\"id87466cf0-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/f\"><num value=\"f\">(f)</num><heading> Exemptions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"blockIndent0\">This section shall not apply to—</chapeau><paragraph class=\"indent1\" id=\"id87466cf1-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/f/1\"><num value=\"1\">(1)</num><content> any person authorized by local, State, or Federal law to manufacture, possess, or distribute such items; or</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id87466cf2-050d-11e3-a300-9bed43da2d8e\" identifier=\"/us/usc/t21/s863/f/2\"><num value=\"2\">(2)</num><content> any item that, in the normal lawful course of business, is imported, exported, transported, or sold through the mail or by any other means, and traditionally intended for use with tobacco products, including any pipe, paper, or accessory.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id87466cf3-050d-11e3-a300-9bed43da2d8e\">\n(<ref href=\"/us/pl/91/513/s422\">Pub.
