<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id29636838-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s864a"><num value="864a">§ 864a.</num><heading> Grants to reduce production of methamphetamines from anhydrous ammonia</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id29636839-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s864a/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2963683a-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s864a/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Eligible entity</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “eligible entity” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id2963683b-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s864a/a/1/A"><num value="A">(A)</num><content> a producer of agricultural commodities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2963683c-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s864a/a/1/B"><num value="B">(B)</num><content> a cooperative association, a majority of the members of which produce or process agricultural commodities; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2963683d-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s864a/a/1/C"><num value="C">(C)</num><chapeau> a person in the trade or business of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id2963683e-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s864a/a/1/C/i"><num value="i">(i)</num><content> selling an agricultural product (including an agricultural chemical) at retail, predominantly to farmers and ranchers; or</content>

<clause style="-uslm-lc:I14" class="indent3" id="id2963683f-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s864a/a/1/C/ii"><num value="ii">(ii)</num><content> aerial and ground application of an agricultural chemical.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id29636840-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s864a/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Nurse tank</heading><content><p style="-uslm-lc:I12" class="indent1">The term “nurse tank” shall be considered to be a cargo tank (within the meaning of section 173.315(m) of title 49, Code of Federal Regulations, as in effect as of the date of the enactment of this Act).</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id29636841-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s864a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Grant authority</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary may make a grant to an eligible entity to enable the eligible entity to obtain and add to an anhydrous ammonia fertilizer nurse tank a physical lock or a substance to reduce the amount of methamphetamine that can be produced from any anhydrous ammonia removed from the nurse tank.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id29636842-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s864a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Grant amount</heading><chapeau style="-uslm-lc:I11" class="indent0">The amount of a grant made under this section to an eligible entity shall be the product obtained by multiplying—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id29636843-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s864a/c/1"><num value="1">(1)</num><content> an amount not less than $40 and not more than $60, as determined by the Secretary; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id29636844-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s864a/c/2"><num value="2">(2)</num><content> the number of fertilizer nurse tanks of the eligible entity.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id29636845-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s864a/d"><num value="d" class="bold">(d)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">There is authorized to be appropriated to the Secretary to make grants under this section $15,000,000 for the period of fiscal years 2008 through 2012.</p>
