A second closing parenthesis probably should precede the comma.</note> shall, if the offense is committed under the circumstance described in subsection (b), be increased by a consecutive term of imprisonment of not more than 15 years.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id6fd1b2c6-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s865/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Circumstances</heading><chapeau>For purposes of subsection (a), the circumstance described in this subsection is that the offense described in subsection (a) was committed by a person who—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6fd1b2c7-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s865/b/1\"><num value=\"1\">(1)</num><content> was enrolled in, or who was acting on behalf of any person or entity enrolled in, any dedicated commuter lane, alternative or accelerated inspection system, or other facilitated entry program administered or approved by the Federal Government for use in entering the United States; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6fd1b2c8-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s865/b/2\"><num value=\"2\">(2)</num><content> committed the offense while entering the United States, using such lane, system, or program.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id6fd1b2c9-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s865/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Permanent ineligibility</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Any person whose term of imprisonment is increased under subsection (a) shall be permanently and irrevocably barred from being eligible for or using any lane, system, or program described in subsection (b)(1).</p>\n</content>\n</subsection>\n<sourceCredit id=\"id6fd1b2ca-6123-11e3-9d46-8388bf8dcc60\">(<ref href=\"/us/pl/109/177/s731\">Pub.
