To this end, he is authorized to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaeb63bbd-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/a/1\"><num value=\"1\">(1)</num><content> arrange for the exchange of information between governmental officials concerning the use and abuse of controlled substances;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaeb63bbe-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/a/2\"><num value=\"2\">(2)</num><content> cooperate in the institution and prosecution of cases in the courts of the United States and before the licensing boards and courts of the several States;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaeb63bbf-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/a/3\"><num value=\"3\">(3)</num><content> conduct training programs on controlled substance law enforcement for local, State, tribal, and Federal personnel;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaeb63bc0-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/a/4\"><num value=\"4\">(4)</num><content> maintain in the Department of Justice a unit which will accept, catalog, file, and otherwise utilize all information and statistics, including records of controlled substance abusers and other controlled substance law offenders, which may be received from Federal, State, tribal, and local agencies, and make such information available for Federal, State, tribal, and local law enforcement purposes;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaeb63bc1-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/a/5\"><num value=\"5\">(5)</num><content> conduct programs of eradication aimed at destroying wild or illicit growth of plant species from which controlled substances may be extracted;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaeb63bc2-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/a/6\"><num value=\"6\">(6)</num><chapeau> assist State, tribal, and local governments in suppressing the diversion of controlled substances from legitimate medical, scientific, and commercial channels by—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaeb63bc3-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/a/6/A\"><num value=\"A\">(A)</num><content> making periodic assessments of the capabilities of State, tribal, and local governments to adequately control the diversion of controlled substances;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaeb63bc4-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/a/6/B\"><num value=\"B\">(B)</num><content> providing advice and counsel to State, tribal, and local governments on the methods by which such governments may strengthen their controls against diversion; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaeb63bc5-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/a/6/C\"><num value=\"C\">(C)</num><content> establishing cooperative investigative efforts to control diversion; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaeb63bc6-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/a/7\"><num value=\"7\">(7)</num><content> notwithstanding any other provision of law, enter into contractual agreements with State, tribal, and local law enforcement agencies to provide for cooperative enforcement and regulatory activities under this chapter.<ref class=\"footnoteRef\" idref=\"fn002119\">1</ref><note type=\"footnote\" id=\"fn002119\"><num>1</num> See References in Text note below.</note></content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaeb63bc7-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Requests by Attorney General for assistance from Federal agencies or instrumentalities</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">When requested by the Attorney General, it shall be the duty of any agency or instrumentality of the Federal Government to furnish assistance, including technical advice, to him for carrying out his functions under this subchapter; except that no such agency or instrumentality shall be required to furnish the name of, or other identifying information about, a patient or research subject whose identity it has undertaken to keep confidential.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaeb63bc8-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Descriptive and analytic reports by Attorney General to State agencies of distribution patterns of schedule II substances having highest rates of abuse</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Attorney General shall annually (1) select the controlled substance (or controlled substances) contained in schedule II which, in the Attorney General’s discretion, is determined to have the highest rate of abuse, and (2) prepare and make available to regulatory, licensing, and law enforcement agencies of States descriptive and analytic reports on the actual distribution patterns in such States of each such controlled substance.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaeb63bc9-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Grants by Attorney General</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idaeb63bca-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/d/1\"><num value=\"1\">(1)</num><chapeau> The Attorney General may make grants, in accordance with paragraph (2), to State, tribal, and local governments to assist in meeting the costs of—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaeb63bcb-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/d/1/A\"><num value=\"A\">(A)</num><content> collecting and analyzing data on the diversion of controlled substances,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaeb63bcc-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/d/1/B\"><num value=\"B\">(B)</num><content> conducting investigations and prosecutions of such diversions,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaeb63bcd-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/d/1/C\"><num value=\"C\">(C)</num><content> improving regulatory controls and other authorities to control such diversions,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaeb63bce-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/d/1/D\"><num value=\"D\">(D)</num><content> programs to prevent such diversions,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaeb63bcf-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/d/1/E\"><num value=\"E\">(E)</num><content> preventing and detecting forged prescriptions, and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaeb63bd0-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/d/1/F\"><num value=\"F\">(F)</num><content> training law enforcement and regulatory personnel to improve the control of such diversions.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idaeb63bd1-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/d/2\"><num value=\"2\">(2)</num><content> No grant may be made under paragraph (1) unless an application therefor is submitted to the Attorney General in such form and manner as the Attorney General may prescribe. No grant may exceed 80 per centum of the costs for which the grant is made, and no grant may be made unless the recipient of the grant provides assurances satisfactory to the Attorney General that it will obligate funds to meet the remaining 20 per centum of such costs. The Attorney General shall review the activities carried out with grants under paragraph (1) and shall report annually to Congress on such activities.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idaeb63bd2-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s873/d/3\"><num value=\"3\">(3)</num><content> To carry out this subsection there is authorized to be appropriated $6,000,000 for fiscal year 1985 and $6,000,000 for fiscal year 1986.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idaeb63bd3-ec38-11e5-9fc5-818d616f3d7f\">(<ref href=\"/us/pl/91/513/tII\">Pub. B, title XXXVI</ref>, § 3625, <date date=\"2000-10-17\">Oct. 17, 2000</date>, <ref href=\"/us/stat/114/1233\">114 Stat. 1233</ref>, provided that:<quotedContent origin=\"/us/pl/106/310/dB/tXXXVI\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Activities</inline>.—</heading><chapeau>In order to combat the illegal manufacturing and trafficking in amphetamine and methamphetamine, the Administrator of the Drug Enforcement Administration may—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> assist State and local law enforcement in small and mid-sized communities in all phases of investigations related to such manufacturing and trafficking, including assistance with foreign-language interpretation;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> staff additional regional enforcement and mobile enforcement teams related to such manufacturing and trafficking;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> establish additional resident offices and posts of duty to assist State and local law enforcement in rural areas in combating such manufacturing and trafficking;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> provide the Special Operations Division of the Administration with additional agents and staff to collect, evaluate, interpret, and disseminate critical intelligence targeting the command and control operations of major amphetamine and methamphetamine manufacturing and trafficking organizations;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> enhance the investigative and related functions of the Chemical Control Program of the Administration to implement more fully the provisions of the Comprehensive Methamphetamine Control Act of 1996 (<ref href=\"/us/pl/104/237\">Public Law 104–237</ref>) [see Short Title of 1996 Amendments note set out under <ref href=\"/us/usc/t21/s801\">section 801 of this title</ref>];</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"6\">“(6)</num><content> design an effective means of requiring an accurate accounting of the import and export of list I chemicals, and coordinate investigations relating to the diversion of such chemicals;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"7\">“(7)</num><content> develop a computer infrastructure sufficient to receive, process, analyze, and redistribute time-sensitive enforcement information from suspicious order reporting to field offices of the Administration and other law enforcement and regulatory agencies, including the continuing development of the Suspicious Order Reporting and Tracking System (SORTS) and the Chemical Transaction Database (CTRANS) of the Administration;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"8\">“(8)</num><content> establish an education, training, and communication process in order to alert the industry to current trends and emerging patterns in the illegal manufacturing of amphetamine and methamphetamine; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"9\">“(9)</num><content> carry out such other activities as the Administrator considers appropriate.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> Additional Positions and Personnel.—</heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>In carrying out activities under subsection (a), the Administrator may establish in the Administration not more than 50 full-time positions, including not more than 31 special-agent positions, and may appoint personnel to such positions.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Particular positions</inline>.—</heading><content>In carrying out activities under paragraphs (5) through (8) of subsection (a), the Administrator may establish in the Administration not more than 15 full-time positions, including not more than 10 diversion investigator positions, and may appoint personnel to such positions. Any positions established under this paragraph are in addition to any positions established under paragraph (1).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Authorization of Appropriations</inline>.—</heading><content>There are authorized to be appropriated for the Drug Enforcement Administration for each fiscal year after fiscal year 1999, $9,500,000 for purposes of carrying out the activities authorized by subsection (a) and employing personnel in positions established under subsection (b), of which $3,000,000 shall be available for activities under paragraphs (5) through (8) of subsection (a) and for employing personnel in positions established under subsection (b)(2).”</content>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idaeb63bd9-ec38-11e5-9fc5-818d616f3d7f\"><heading class=\"centered smallCaps\">National Drug Intelligence Center</heading><p><ref href=\"/us/pl/108/487/tI\">Pub. Within such amount, funds provided for research, development, testing, and evaluation purposes shall remain available until <date date=\"2006-09-30\">September 30, 2006</date>, and funds provided for procurement purposes shall remain available until <date date=\"2007-09-30\">September 30, 2007</date>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Transfer of funds</inline>.—</heading><content>The Director of National Intelligence shall transfer to the Attorney General funds available for the National Drug Intelligence Center under paragraph (1).
