<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id29669c81-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882"><num value="882">§ 882.</num><heading> Injunctions</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id29669c82-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882/a"><num value="a" class="bold">(a)</num><heading class="bold"> Jurisdiction</heading><content><p style="-uslm-lc:I11" class="indent0">The district courts of the United States and all courts exercising general jurisdiction in the territories and possessions of the United States shall have jurisdiction in proceedings in accordance with the Federal Rules of Civil Procedure to enjoin violations of this subchapter.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id29669c83-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882/b"><num value="b" class="bold">(b)</num><heading class="bold"> Jury trial</heading><content><p style="-uslm-lc:I11" class="indent0">In case of an alleged violation of an injunction or restraining order issued under this section, trial shall, upon demand of the accused, be by a jury in accordance with the Federal Rules of Civil Procedure.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id29669c84-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882/c"><num value="c" class="bold">(c)</num><heading class="bold"> State cause of action pertaining to online pharmacies</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id29669c85-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">In any case in which the State has reason to believe that an interest of the residents of that State has been or is being threatened or adversely affected by the action of a person, entity, or Internet site that violates the provisions of section 823(f), 829(e), or 831 of this title, the State may bring a civil action on behalf of such residents in a district court of the United States with appropriate jurisdiction—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id29669c86-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882/c/1/A"><num value="A">(A)</num><content> to enjoin the conduct which violates this section;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id29669c87-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882/c/1/B"><num value="B">(B)</num><content> to enforce compliance with this section;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id29669c88-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882/c/1/C"><num value="C">(C)</num><content> to obtain damages, restitution, or other compensation, including civil penalties under <ref href="/us/usc/t21/s842/b">section 842(b) of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id29669c89-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882/c/1/D"><num value="D">(D)</num><content> to obtain such other legal or equitable relief as the court may find appropriate.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id29669c8a-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Service; intervention</heading><subparagraph style="-uslm-lc:I12" class="indent1" id="id29669c8b-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882/c/2/A"><num value="A">(A)</num><content> Prior to filing a complaint under paragraph (1), the State shall serve a copy of the complaint upon the Attorney General and upon the United States Attorney for the judicial district in which the complaint is to be filed. In any case where such prior service is not feasible, the State shall serve the complaint on the Attorney General and the appropriate United States Attorney on the same day that the State’s complaint is filed in Federal district court of the United States. Such proceedings shall be independent of, and not in lieu of, criminal prosecutions or any other proceedings under this subchapter or any other laws of the United States.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id2966c39c-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882/c/2/B"><num value="B">(B)</num><content> Upon receiving notice respecting a civil action pursuant to this section, the United States shall have the right to intervene in such action and, upon so intervening, to be heard on all matters arising therein, and to file petitions for appeal.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id2966c39d-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882/c/2/C"><num value="C">(C)</num><content> Service of a State’s complaint on the United States as required in this paragraph shall be made in accord with the requirements of rule 4(i)(1) of the Federal Rule <ref class="footnoteRef" idref="fn002148">1</ref><note type="footnote" id="fn002148"><num>1</num> So in original. <paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2966c39e-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Powers conferred by State law</heading><content><p style="-uslm-lc:I12" class="indent1">For purposes of bringing any civil action under paragraph (1), nothing in this chapter shall prevent an attorney general of a State from exercising the powers conferred on the attorney general of a State by the laws of such State to conduct investigations or to administer oaths or affirmations or to compel the attendance of witnesses of or the production of documentary or other evidence.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2966c39f-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882/c/4"><num value="4" class="bold">(4)</num><heading class="bold"> Venue</heading><content><p style="-uslm-lc:I12" class="indent1">Any civil action brought under paragraph (1) in a district court of the United States may be brought in the district in which the defendant is found, is an inhabitant, or transacts business or wherever venue is proper under <ref href="/us/usc/t28/s1391">section 1391 of title 28</ref>. Process in such action may be served in any district in which the defendant is an inhabitant or in which the defendant may be found.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2966c3a0-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882/c/5"><num value="5" class="bold">(5)</num><heading class="bold"> No private right of action</heading><content><p style="-uslm-lc:I12" class="indent1">No private right of action is created under this subsection.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2966c3a1-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882/c/6"><num value="6" class="bold">(6)</num><heading class="bold"> Limitation</heading><chapeau style="-uslm-lc:I12" class="indent1">No civil action may be brought under paragraph (1) against—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id2966c3a2-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882/c/6/A"><num value="A">(A)</num><content> the United States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2966c3a3-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882/c/6/B"><num value="B">(B)</num><content> an Indian Tribe or tribal organization, to the extent such tribe or tribal organization is lawfully carrying out a contract or compact under the Indian Self-Determination and Education Assistance Act [<ref href="/us/usc/t25/s5301">25 U.S.C. 5301</ref> et seq.]; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2966c3a4-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s882/c/6/C"><num value="C">(C)</num><content> any employee of the United States or such Indian tribe or tribal organization, provided such agent or employee is acting in the usual course of business or employment, and within the scope of the official duties of such agent or employee therewith.</content>
