L. 109–177, title VII, § 715, Mar. 9, 2006, 120 Stat. 264.)","seq_in_title":567,"parent_identifier":"/us/usc/t21/ch13/schII","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13","level":"chapter","num":"CHAPTER 13—","heading":"DRUG ABUSE PREVENTION AND CONTROL","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch13/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"IMPORT AND EXPORT","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id7dc1801c-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s952\"><num value=\"952\">§ 952.</num><heading> Importation of controlled substances</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id7dc1801d-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s952/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Controlled substances in schedule I or II and narcotic drugs in schedule III, IV, or V; exceptions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">It shall be unlawful to import into the customs territory of the United States from any place outside thereof (but within the United States), or to import into the United States from any place outside thereof, any controlled substance in schedule I or II of subchapter I, or any narcotic drug in schedule III, IV, or V of subchapter I, or ephedrine, pseudoephedrine, or phenylpropanolamine, except that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7dc1801e-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s952/a/1\"><num value=\"1\">(1)</num><content> such amounts of crude opium, poppy straw, concentrate of poppy straw, and coca leaves, and of ephedrine, pseudoephedrine, and phenylpropanolamine, as the Attorney General finds to be necessary to provide for medical, scientific, or other legitimate purposes, and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7dc1801f-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s952/a/2\"><num value=\"2\">(2)</num><chapeau> such amounts of any controlled substance in schedule I or II or any narcotic drug in schedule III, IV, or V that the Attorney General finds to be necessary to provide for the medical, scientific, or other legitimate needs of the United States—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7dc18020-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s952/a/2/A\"><num value=\"A\">(A)</num><content> during an emergency in which domestic supplies of such substance or drug are found by the Attorney General to be inadequate,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7dc18021-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s952/a/2/B\"><num value=\"B\">(B)</num><content> in any case in which the Attorney General finds that competition among domestic manufacturers of the controlled substance is inadequate and will not be rendered adequate by the registration of additional manufacturers under <ref href=\"/us/usc/t21/s823\">section 823 of this title</ref>, or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7dc18022-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s952/a/2/C\"><num value=\"C\">(C)</num><content> in any case in which the Attorney General finds that such controlled substance is in limited quantities exclusively for scientific, analytical, or research uses,</content>\n</subparagraph>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">may be so imported under such regulations as the Attorney General shall prescribe. No crude opium may be so imported for the purpose of manufacturing heroin or smoking opium.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id7dc18023-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s952/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Nonnarcotic controlled substances in schedule III, IV, or V</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">It shall be unlawful to import into the customs territory of the United States from any place outside thereof (but within the United States), or to import into the United States from  any  place  outside  thereof,  any  non­narcotic controlled substance in schedule III, IV, or V, unless such nonnarcotic controlled substance—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7dc1a734-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s952/b/1\"><num value=\"1\">(1)</num><content> is imported for medical, scientific, or other legitimate uses, and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7dc1a735-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s952/b/2\"><num value=\"2\">(2)</num><content> is imported pursuant to such notification, or declaration, or in the case of any nonnarcotic controlled substance in schedule III, such import permit, notification, or declaration, as the Attorney General may by regulation prescribe, except that if a nonnarcotic controlled substance in schedule IV or V is also listed in schedule I or II of the Convention on Psychotropic Substances it shall be imported pursuant to such import permit requirements, prescribed by regulation of the Attorney General, as are required by the Convention.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id7dc1a736-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s952/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Coca leaves</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In addition to the amount of coca leaves authorized to be imported into the United States under subsection (a), the Attorney General may permit the importation of additional amounts of coca leaves. All cocaine and ecgonine (and all salts, derivatives, and preparations from which cocaine or ecgonine may be synthesized or made) contained in such additional amounts of coca leaves imported under this subsection shall be destroyed under the supervision of an authorized representative of the Attorney General.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id7dc1a737-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s952/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Application for increased importation of ephedrine, pseudoephedrine, or phenylpropanolamine</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7dc1a738-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s952/d/1\"><num value=\"1\">(1)</num><content> With respect to a registrant under <ref href=\"/us/usc/t21/s958\">section 958 of this title</ref> who is authorized under subsection (a)(1) to import ephedrine, pseudoephedrine, or phenylpropanolamine, at any time during the year the registrant may apply for an increase in the amount of such chemical that the registrant is authorized to import, and the Attorney General may approve the application if the Attorney General determines that the approval is necessary to provide for medical, scientific, or other legitimate purposes regarding the chemical.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7dc1a739-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s952/d/2\"><num value=\"2\">(2)</num><chapeau> With respect to the application under paragraph (1):</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7dc1a73a-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s952/d/2/A\"><num value=\"A\">(A)</num><content> Not later than 60 days after receiving the application, the Attorney General shall approve or deny the application.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7dc1a73b-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s952/d/2/B\"><num value=\"B\">(B)</num><content> In approving the application, the Attorney General shall specify the period of time for which the approval is in effect, or shall provide that the approval is effective until the registrant involved is notified in writing by the Attorney General that the approval is terminated.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7dc1a73c-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s952/d/2/C\"><num value=\"C\">(C)</num><content> If the Attorney General does not approve or deny the application before the expiration of the 60-day period under subparagraph (A), the application is deemed to be approved, and such approval remains in effect until the Attorney General notifies the registrant in writing that the approval is terminated.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id7dc1ce4d-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s952/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Reference to ephedrine, pseudoephedrine, or phenylpropanolamine</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Each reference in this section to ephedrine, pseudoephedrine, or phenylpropanolamine includes each of the salts, optical isomers, and salts of optical isomers of such chemical.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id7dc1ce4e-81bc-11eb-b838-b6993269d559\">(<ref href=\"/us/pl/91/513/tIII/s1002\">Pub.
