<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id92bfb8d7-1b46-11ea-8cc6-e08b531bedee" identifier="/us/usc/t21/s960a"><num value="960a">§ 960a.</num><heading> Foreign terrorist organizations, terrorist persons and groups</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id92bfb8d8-1b46-11ea-8cc6-e08b531bedee" identifier="/us/usc/t21/s960a/a"><num value="a" class="bold">(a)</num><heading class="bold"> Prohibited acts</heading><content><p style="-uslm-lc:I11" class="indent0">Whoever engages in conduct that would be punishable under section 841(a) <ref class="footnoteRef" idref="fn002150">1</ref><note type="footnote" id="fn002150"><num>1</num> See References in Text note below.</note> of this title if committed within the jurisdiction of the United States, or attempts or conspires to do so, knowing or intending to provide, directly or indirectly, anything of pecuniary value to any person or organization that has engaged or engages in terrorist activity (as defined in <ref href="/us/usc/t8/s1182/a/3/B">section 1182(a)(3)(B) of title 8</ref>) or terrorism (as defined in <ref href="/us/usc/t22/s2656f/d/2">section 2656f(d)(2) of title 22</ref>), shall be sentenced to a term of imprisonment of not less than twice the minimum punishment under section 841(b)(1),<ref class="footnoteRef" idref="fn002150">1</ref> and not more than life, a fine in accordance with the provisions of title 18, or both. Notwithstanding <ref href="/us/usc/t18/s3583">section 3583 of title 18</ref>, any sentence imposed under this subsection shall include a term of supervised release of at least 5 years in addition to such term of imprisonment.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id92bfb8d9-1b46-11ea-8cc6-e08b531bedee" identifier="/us/usc/t21/s960a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Jurisdiction</heading><chapeau>There is jurisdiction over an offense under this section if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id92bfb8da-1b46-11ea-8cc6-e08b531bedee" identifier="/us/usc/t21/s960a/b/1"><num value="1">(1)</num><content> the prohibited drug activity or the terrorist offense is in violation of the criminal laws of the United States;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id92bfb8db-1b46-11ea-8cc6-e08b531bedee" identifier="/us/usc/t21/s960a/b/2"><num value="2">(2)</num><content> the offense, the prohibited drug activity, or the terrorist offense occurs in or affects interstate or foreign commerce;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id92bfb8dc-1b46-11ea-8cc6-e08b531bedee" identifier="/us/usc/t21/s960a/b/3"><num value="3">(3)</num><content> an offender provides anything of pecuniary value for a terrorist offense that causes or is designed to cause death or serious bodily injury to a national of the United States while that national is outside the United States, or substantial damage to the property of a legal entity organized under the laws of the United States (including any of its States, districts, commonwealths, territories, or possessions) while that property is outside of the United States;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id92bfb8dd-1b46-11ea-8cc6-e08b531bedee" identifier="/us/usc/t21/s960a/b/4"><num value="4">(4)</num><content> the offense or the prohibited drug activity occurs in whole or in part outside of the United States (including on the high seas), and a perpetrator of the offense or the prohibited drug activity is a national of the United States or a legal entity organized under the laws of the United States (including any of its States, districts, commonwealths, territories, or possessions); or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id92bfb8de-1b46-11ea-8cc6-e08b531bedee" identifier="/us/usc/t21/s960a/b/5"><num value="5">(5)</num><content> after the conduct required for the offense occurs an offender is brought into or found in the United States, even if the conduct required for the offense occurs outside the United States.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id92bfb8df-1b46-11ea-8cc6-e08b531bedee" identifier="/us/usc/t21/s960a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Proof requirements</heading><content><p style="-uslm-lc:I11" class="indent0">To violate subsection (a), a person must have knowledge that the person or organization has engaged or engages in terrorist activity (as defined in <ref href="/us/usc/t8/s1182/a/3/B">section 1182(a)(3)(B) of title 8</ref>) or terrorism (as defined in <ref href="/us/usc/t22/s2656f/d/2">section 2656f(d)(2) of title 22</ref>).</p>
