<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd28fad7e-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563"><num value="8563">§ 8563.</num><heading> Report and imposition of sanctions with respect to persons who are responsible for or complicit in abuses toward dissidents on behalf of the Government of Iran</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd28fad7f-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/a"><num value="a" class="bold">(a)</num><heading class="bold"> Report required</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd28fad80-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Not later than 180 days after <date date="2022-12-29">December 29, 2022</date>, the Secretary of State, in consultation with the Secretary of the Treasury, the Director of National Intelligence, and the Attorney General, shall submit to the appropriate congressional committees a report that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd28fad81-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/a/1/A"><num value="A">(A)</num><chapeau> includes a detailed description and assessment of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd28fad82-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/a/1/A/i"><num value="i">(i)</num><content> the state of human rights and the rule of law inside Iran, including the treatment of marginalized individuals and communities in Iran;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd28fad83-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/a/1/A/ii"><num value="ii">(ii)</num><content> actions taken by the Government of Iran during the year preceding submission of the report to target and silence dissidents both inside and outside of Iran who advocate for human rights inside Iran;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd28fad84-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/a/1/A/iii"><num value="iii">(iii)</num><content> the methods used by the Government of Iran to target and silence dissidents both inside and outside of Iran; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd28fad85-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/a/1/A/iv"><num value="iv">(iv)</num><content> the means through which the Government of Iran finances efforts to target and silence dissidents both inside and outside of Iran and the amount of that financing;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd28fad86-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/a/1/B"><num value="B">(B)</num><chapeau> identifies foreign persons working as part of the Government of Iran or acting on behalf of that Government or its proxies that are involved in harassment and surveillance and that the Secretary of State may also, as appropriate, determine, in consultation with the Secretary of the Treasury, are knowingly responsible for, complicit in, or involved in ordering, conspiring, planning, or implementing the surveillance, harassment, kidnapping, illegal extradition, imprisonment, torture, killing, or assassination, on or after <date date="2022-12-29">December 29, 2022</date>, of citizens of Iran (including citizens of Iran of dual nationality) or citizens of the United States, inside or outside Iran, who seek—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd28fad87-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/a/1/B/i"><num value="i">(i)</num><content> to expose illegal or corrupt activity carried out by officials of the Government of Iran; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd28fad88-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/a/1/B/ii"><num value="ii">(ii)</num><content> to obtain, exercise, defend, or promote the human rights of individuals, including members of marginalized communities, in Iran; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd28fad89-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/a/1/C"><num value="C">(C)</num><content> includes, for each foreign person identified under subparagraph (B), a clear explanation for why the foreign person was so identified.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd28fad8a-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Updates of report</heading><chapeau style="-uslm-lc:I12" class="indent1">The report required by paragraph (1) shall be updated, and the updated version submitted to the appropriate congressional committees, during the 10-year period following <date date="2022-12-29">December 29, 2022</date>—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd28fad8b-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/a/2/A"><num value="A">(A)</num><content> not less frequently than annually; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd28fad8c-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/a/2/B"><num value="B">(B)</num><content> with respect to matters relating to the identification of foreign persons under paragraph (1)(B), on an ongoing basis as appropriate.</content>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd28fad8d-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Form of report</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd28fad8e-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/a/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Each report required by paragraph (1) and each update required by paragraph (2) shall be submitted in unclassified form but may include a classified annex.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd28fad8f-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/a/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Public availability</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary of State shall post the unclassified portion of each report required by paragraph (1) and each update required by paragraph (2) on a publicly available internet website of the Department of State.</p>

</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd28fad90-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/b"><num value="b" class="bold">(b)</num><heading class="bold"> Imposition of sanctions</heading><content><p style="-uslm-lc:I11" class="indent0">In the case of a foreign person identified under paragraph (1)(B) of subsection (a) in the most recent report or update submitted under that subsection, the President shall impose the sanctions described in subsection (c), pursuant to this section or an appropriate Executive authority.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd28fad91-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/c"><num value="c" class="bold">(c)</num><heading class="bold"> Sanctions described</heading><chapeau style="-uslm-lc:I11" class="indent0">The sanctions described in this subsection are the following:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd28fad92-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Blocking of property</heading><content><p style="-uslm-lc:I12" class="indent1">The President shall exercise all powers granted to the President by the International Emergency Economic Powers Act (<ref href="/us/usc/t50/s1701">50 U.S.C. 1701</ref> et seq.) to the extent necessary to block and prohibit all transactions in all property and interests in property of a foreign person described in subsection (a)(1)(B) if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd28fad93-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Inadmissibility of certain individuals</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd28fad94-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/c/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Ineligibility for visas and admission to the United States</heading><chapeau style="-uslm-lc:I13" class="indent2">In the case of a foreign person described in subsection (a)(1)(B) who is an individual, the individual is—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd28fad95-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/c/2/A/i"><num value="i">(i)</num><content> inadmissible to the United States;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd28fad96-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/c/2/A/ii"><num value="ii">(ii)</num><content> ineligible to receive a visa or other documentation to enter the United States; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd28fad97-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/c/2/A/iii"><num value="iii">(iii)</num><content> otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<ref href="/us/usc/t8/s1101">8 U.S.C. 1101</ref> et seq.).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd28fad98-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/c/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Current visas revoked</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idd28fad99-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/c/2/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">The visa or other entry documentation of an individual described in subparagraph (A) shall be revoked, regardless of when such visa or other entry documentation is or was issued.</p>

<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idd28fad9a-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/c/2/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Immediate effect</heading><chapeau style="-uslm-lc:I14" class="indent3">A revocation under clause (i) shall—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd28fad9b-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/c/2/B/ii/I"><num value="I">(I)</num><content> take effect immediately; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd28fad9c-f339-11ed-9577-c10d33d9b873" identifier="/us/usc/t22/s8563/c/2/B/ii/II"><num value="II">(II)</num><content> automatically cancel any other valid visa or entry documentation that is in the individual’s possession.</content>
