<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id193a3b4a-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151"><num value="151">§ 151.</num><heading> National electric vehicle charging and hydrogen, propane, and natural gas fueling corridors</heading><subsection style="-uslm-lc:I11" class="indent0" id="id193a3b4b-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><content>The Secretary shall periodically designate national electric vehicle charging and hydrogen, propane, and natural gas fueling corridors that identify the near- and long-term need for, and location of, electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, and natural gas fueling infrastructure at strategic locations along major national highways to support changes in the transportation sector that help achieve a reduction in greenhouse gas emissions and improve the mobility of passenger and commercial vehicles that employ electric, hydrogen fuel cell, propane, and natural gas fueling technologies across the United States.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id193a3b4c-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/b"><num value="b">(b)</num><heading> <inline class="small-caps">Designation of Corridors</inline>.—</heading><chapeau>In designating the corridors under subsection (a), the Secretary shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id193a3b4d-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/b/1"><num value="1">(1)</num><content> solicit nominations from State and local officials for facilities to be included in the corridors;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id193a3b4e-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/b/2"><num value="2">(2)</num><content> incorporate existing electric vehicle charging, hydrogen fueling, propane fueling, and natural gas fueling corridors previously designated by the Federal Highway Administration or designated by a State or group of States; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id193a3b4f-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/b/3"><num value="3">(3)</num><content> consider the demand for, and location of, existing electric vehicle charging stations, hydrogen fueling stations, propane fueling stations, and natural gas fueling infrastructure.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id193a3b50-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/c"><num value="c">(c)</num><heading> <inline class="small-caps">Stakeholders</inline>.—</heading><chapeau>In designating corridors under subsection (a), the Secretary shall involve, on a voluntary basis, stakeholders that include—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id193a3b51-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/c/1"><num value="1">(1)</num><content> the heads of other Federal agencies;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id193a3b52-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/c/2"><num value="2">(2)</num><content> State and local officials;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id193a3b53-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/c/3"><num value="3">(3)</num><chapeau> representatives of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b54-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/c/3/A"><num value="A">(A)</num><content> energy utilities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b55-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/c/3/B"><num value="B">(B)</num><content> the electric, fuel cell electric, propane, and natural gas vehicle industries;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b56-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/c/3/C"><num value="C">(C)</num><content> the freight and shipping industry;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b57-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/c/3/D"><num value="D">(D)</num><content> clean technology firms;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b58-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/c/3/E"><num value="E">(E)</num><content> the hospitality industry;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b59-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/c/3/F"><num value="F">(F)</num><content> the restaurant industry;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b5a-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/c/3/G"><num value="G">(G)</num><content> highway rest stop vendors; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b5b-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/c/3/H"><num value="H">(H)</num><content> industrial gas and hydrogen manufacturers; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id193a3b5c-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/c/4"><num value="4">(4)</num><content> such other stakeholders as the Secretary determines to be necessary.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id193a3b5d-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/d"><num value="d">(d)</num><heading> <inline class="small-caps">Redesignation.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id193a3b5e-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/d/1"><num value="1">(1)</num><heading> <inline class="small-caps">Initial redesignation</inline>.—</heading><content>Not later than 180 days after the date of enactment of the Surface Transportation Reauthorization Act of 2021, the Secretary shall update and redesignate the corridors under subsection (a).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id193a3b5f-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/d/2"><num value="2">(2)</num><heading> <inline class="small-caps">Subsequent redesignation</inline>.—</heading><content>The Secretary shall establish a recurring process to regularly update and redesignate the corridors under subsection (a).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id193a3b60-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/e"><num value="e">(e)</num><heading> <inline class="small-caps">Report</inline>.—</heading><chapeau>During designation and redesignation of the corridors under this section, the Secretary shall issue a report that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id193a3b61-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/e/1"><num value="1">(1)</num><content> identifies electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, and natural gas fueling infrastructure and standardization needs for electricity providers, industrial gas providers, natural gas providers, infrastructure providers, vehicle manufacturers, electricity purchasers, and natural gas purchasers;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id193a3b62-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/e/2"><num value="2">(2)</num><content> describes efforts, including through funds awarded through the grant program under subsection (f), that will aid efforts to achieve strategic deployment of electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, and natural gas fueling infrastructure in those corridors; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id193a3b63-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/e/3"><num value="3">(3)</num><content> summarizes best practices and provides guidance, developed through consultation with the Secretary of Energy, for project development of electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure and natural gas fueling infrastructure at the State, Tribal, and local level to allow for the predictable deployment of that infrastructure.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id193a3b64-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f"><num value="f">(f)</num><heading> <inline class="small-caps">Grant Program.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id193a3b65-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/1"><num value="1">(1)</num><heading> <inline class="small-caps">Definition of private entity</inline>.—</heading><content>In this subsection, the term “private entity” means a corporation, partnership, company, or nonprofit organization.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id193a3b66-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/2"><num value="2">(2)</num><heading> <inline class="small-caps">Establishment</inline>.—</heading><content>Not later than 1 year after the date of enactment of the Surface Transportation Reauthorization Act of 2021, the Secretary shall establish a grant program to award grants to eligible entities to carry out the activities described in paragraph (6).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id193a3b67-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/3"><num value="3">(3)</num><heading> <inline class="small-caps">Eligible entities</inline>.—</heading><chapeau>An entity eligible to receive a grant under this subsection is—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b68-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/3/A"><num value="A">(A)</num><content> a State or political subdivision of a State;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b69-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/3/B"><num value="B">(B)</num><content> a metropolitan planning organization;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b6a-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/3/C"><num value="C">(C)</num><content> a unit of local government;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b6b-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/3/D"><num value="D">(D)</num><content> a special purpose district or public authority with a transportation function, including a port authority;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b6c-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/3/E"><num value="E">(E)</num><content> an Indian tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<ref href="/us/usc/t25/s5304">25 U.S.C. 5304</ref>));</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b6d-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/3/F"><num value="F">(F)</num><content> a territory of the United States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b6e-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/3/G"><num value="G">(G)</num><content> an authority, agency, or instrumentality of, or an entity owned by, 1 or more entities described in subparagraphs (A) through (F); or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b6f-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/3/H"><num value="H">(H)</num><content> a group of entities described in subparagraphs (A) through (G).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id193a3b70-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/4"><num value="4">(4)</num><heading> <inline class="small-caps">Applications</inline>.—</heading><chapeau>To be eligible to receive a grant under this subsection, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary shall require, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b71-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/4/A"><num value="A">(A)</num><chapeau> a description of how the eligible entity has considered—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id193a3b72-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/4/A/i"><num value="i">(i)</num><chapeau> public accessibility of charging or fueling infrastructure proposed to be funded with a grant under this subsection, including—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id193a3b73-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/4/A/i/I"><num value="I">(I)</num><content> charging or fueling connector types and publicly available information on real-time availability; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id193a3b74-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/4/A/i/II"><num value="II">(II)</num><content> payment methods to ensure secure, convenient, fair, and equal access;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3b75-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/4/A/ii"><num value="ii">(ii)</num><chapeau> collaborative engagement with stakeholders (including automobile manufacturers, utilities, infrastructure providers, technology providers, electric charging, hydrogen, propane, and natural gas fuel providers, metropolitan planning organizations, States, Indian tribes, and units of local governments, fleet owners, fleet managers, fuel station owners and operators, labor organizations, infrastructure construction and component parts suppliers, and multi-State and regional entities)—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id193a3b76-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/4/A/ii/I"><num value="I">(I)</num><content> to foster enhanced, coordinated, public-private or private investment in electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id193a3b77-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/4/A/ii/II"><num value="II">(II)</num><content> to expand deployment of electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id193a3b78-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/4/A/ii/III"><num value="III">(III)</num><content> to protect personal privacy and ensure cybersecurity; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id193a3b79-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/4/A/ii/IV"><num value="IV">(IV)</num><content> to ensure that a properly trained workforce is available to construct and install electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3b7a-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/4/A/iii"><num value="iii">(iii)</num><chapeau> the location of the station or fueling site, such as consideration of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id193a3b7b-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/4/A/iii/I"><num value="I">(I)</num><content> the availability of onsite amenities for vehicle operators, such as restrooms or food facilities;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id193a3b7c-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/4/A/iii/II"><num value="II">(II)</num><content> access in compliance with the Americans with Disabilities Act of 1990 (<ref href="/us/usc/t42/s12101">42 U.S.C. 12101</ref> et seq.);</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id193a3b7d-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/4/A/iii/III"><num value="III">(III)</num><content> height and fueling capacity requirements for facilities that charge or refuel large vehicles, such as semi-trailer trucks; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id193a3b7e-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/4/A/iii/IV"><num value="IV">(IV)</num><content> appropriate distribution to avoid redundancy and fill charging or fueling gaps;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3b7f-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/4/A/iv"><num value="iv">(iv)</num><content> infrastructure installation that can be responsive to technology advancements, such as accommodating autonomous vehicles, vehicle-to-grid technology, and future charging methods; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3b80-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/4/A/v"><num value="v">(v)</num><content> the long-term operation and maintenance of the electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure, to avoid stranded assets and protect the investment of public funds in that infrastructure; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b81-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/4/B"><num value="B">(B)</num><content> an assessment of the estimated emissions that will be reduced through the use of electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure, which shall be conducted using the Alternative Fuel Life-Cycle Environmental and Economic Transportation (AFLEET) tool developed by Argonne National Laboratory (or a successor tool).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id193a3b82-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/5"><num value="5">(5)</num><heading> <inline class="small-caps">Considerations</inline>.—</heading><chapeau>In selecting eligible entities to receive a grant under this subsection, the Secretary shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b83-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/5/A"><num value="A">(A)</num><chapeau> consider the extent to which the application of the eligible entity would—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id193a3b84-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/5/A/i"><num value="i">(i)</num><chapeau> improve alternative fueling corridor networks by—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id193a3b85-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/5/A/i/I"><num value="I">(I)</num><content> converting corridor-pending corridors to corridor-ready corridors; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id193a3b86-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/5/A/i/II"><num value="II">(II)</num><chapeau> in the case of corridor-ready corridors, providing redundancy—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id193a3b87-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/5/A/i/II/aa"><num value="aa">(aa)</num><content> to meet excess demand for charging or fueling infrastructure; or</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id193a3b88-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/5/A/i/II/bb"><num value="bb">(bb)</num><content> to reduce congestion at existing charging or fueling infrastructure in high-traffic locations;</content>
</item>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3b89-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/5/A/ii"><num value="ii">(ii)</num><content> meet current or anticipated market demands for charging or fueling infrastructure;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3b8a-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/5/A/iii"><num value="iii">(iii)</num><content> enable or accelerate the construction of charging or fueling infrastructure that would be unlikely to be completed without Federal assistance;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3b8b-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/5/A/iv"><num value="iv">(iv)</num><content> support a long-term competitive market for electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure that does not significantly impair existing electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure providers;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3b8c-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/5/A/v"><num value="v">(v)</num><content> provide access to electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure in areas with a current or forecasted need; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3b8d-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/5/A/vi"><num value="vi">(vi)</num><content> deploy electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure for medium- and heavy-duty vehicles (including along the National Highway Freight Network established under section 167(c)) and in proximity to intermodal transfer stations;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b8e-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/5/B"><num value="B">(B)</num><content> ensure, to the maximum extent practicable, geographic diversity among grant recipients to ensure that electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure is available throughout the United States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b8f-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/5/C"><num value="C">(C)</num><chapeau> consider whether the private entity that the eligible entity contracts with under paragraph (6)—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id193a3b90-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/5/C/i"><num value="i">(i)</num><content> submits to the Secretary the most recent year of audited financial statements; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3b91-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/5/C/ii"><num value="ii">(ii)</num><content> has experience in installing and operating electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b92-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/5/D"><num value="D">(D)</num><chapeau> consider whether, to the maximum extent practicable, the eligible entity and the private entity that the eligible entity contracts with under paragraph (6) enter into an agreement—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id193a3b93-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/5/D/i"><num value="i">(i)</num><content> to operate and maintain publicly available electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas infrastructure; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3b94-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/5/D/ii"><num value="ii">(ii)</num><content> that provides a remedy and an opportunity to cure if the requirements described in clause (i) are not met.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id193a3b95-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/6"><num value="6">(6)</num><heading> <inline class="small-caps">Use of funds.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b96-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/6/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>An eligible entity receiving a grant under this subsection shall only use the funds in accordance with this paragraph to contract with a private entity for acquisition and installation of publicly accessible electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure that is directly related to the charging or fueling of a vehicle.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b97-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/6/B"><num value="B">(B)</num><heading> <inline class="small-caps">Location of infrastructure</inline>.—</heading><content>Any publicly accessible electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure acquired and installed with a grant under this subsection shall be located along an alternative fuel corridor designated under this section, on the condition that any affected Indian tribes are consulted before the designation.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b98-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/6/C"><num value="C">(C)</num><heading> <inline class="small-caps">Operating assistance.—</inline></heading><clause style="-uslm-lc:I14" class="indent3" id="id193a3b99-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/6/C/i"><num value="i">(i)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Subject to clauses (ii) and (iii), an eligible entity that receives a grant under this subsection may use a portion of the funds to provide to a private entity operating assistance for the first 5 years of operations after the installation of publicly available electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure while the facility transitions to independent system operations.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3b9a-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/6/C/ii"><num value="ii">(ii)</num><heading> <inline class="small-caps">Inclusions</inline>.—</heading><content>Operating assistance under this subparagraph shall be limited to costs allocable to operating and maintaining the electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure and service.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3b9b-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/6/C/iii"><num value="iii">(iii)</num><heading> <inline class="small-caps">Limitation</inline>.—</heading><content>Operating assistance under this subparagraph may not exceed the amount of a contract under subparagraph (A) to acquire and install publicly accessible electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3b9c-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/6/D"><num value="D">(D)</num><heading> <inline class="small-caps">Traffic control devices.—</inline></heading><clause style="-uslm-lc:I14" class="indent3" id="id193a3b9d-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/6/D/i"><num value="i">(i)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Subject to this paragraph, an eligible entity that receives a grant under this subsection may use a portion of the funds to acquire and install traffic control devices located in the right-of-way to provide directional information to publicly accessible electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure acquired, installed, or operated with the grant.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3b9e-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/6/D/ii"><num value="ii">(ii)</num><heading> <inline class="small-caps">Applicability</inline>.—</heading><chapeau>Clause (i) shall apply only to an eligible entity that—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id193a3b9f-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/6/D/ii/I"><num value="I">(I)</num><content> receives a grant under this subsection; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id193a3ba0-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/6/D/ii/II"><num value="II">(II)</num><content> is using that grant for the acquisition and installation of publicly accessible electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure.</content>

</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3ba1-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/6/D/iii"><num value="iii">(iii)</num><heading> <inline class="small-caps">Limitation on amount</inline>.—</heading><content>The amount of funds used to acquire and install traffic control devices under clause (i) may not exceed the amount of a contract under subparagraph (A) to acquire and install publicly accessible charging or fueling infrastructure.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3ba2-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/6/D/iv"><num value="iv">(iv)</num><heading> <inline class="small-caps">No new authority created</inline>.—</heading><content>Nothing in this subparagraph authorizes an eligible entity that receives a grant under this subsection to acquire and install traffic control devices if the entity is not otherwise authorized to do so.</content>

</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3ba3-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/6/E"><num value="E">(E)</num><heading> <inline class="small-caps">Revenue.—</inline></heading><clause style="-uslm-lc:I14" class="indent3" id="id193a3ba4-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/6/E/i"><num value="i">(i)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>An eligible entity receiving a grant under this subsection and a private entity referred to in subparagraph (A) may enter into a cost-sharing agreement under which the private entity submits to the eligible entity a portion of the revenue from the electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3ba5-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/6/E/ii"><num value="ii">(ii)</num><heading> <inline class="small-caps">Uses of revenue</inline>.—</heading><content>An eligible entity that receives revenue from a cost-sharing agreement under clause (i) may only use that revenue for a project that is eligible under this title.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id193a3ba6-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/7"><num value="7">(7)</num><heading> <inline class="small-caps">Certain fuels</inline>.—</heading><content>The use of grants for propane fueling infrastructure under this subsection shall be limited to infrastructure for medium- and heavy-duty vehicles.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id193a3ba7-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8"><num value="8">(8)</num><heading> <inline class="small-caps">Community grants.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3ba8-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Notwithstanding paragraphs (4), (5), and (6), the Secretary shall reserve 50 percent of the amounts made available each fiscal year to carry out this section to provide grants to eligible entities in accordance with this paragraph.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3ba9-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/B"><num value="B">(B)</num><heading> <inline class="small-caps">Applications</inline>.—</heading><content>To be eligible to receive a grant under this paragraph, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3baa-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/C"><num value="C">(C)</num><heading> <inline class="small-caps">Eligible entities</inline>.—</heading><chapeau>An entity eligible to receive a grant under this paragraph is—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id193a3bab-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/C/i"><num value="i">(i)</num><content> an entity described in paragraph (3); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3bac-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/C/ii"><num value="ii">(ii)</num><content> a State or local authority with ownership of publicly accessible transportation facilities.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3bad-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/D"><num value="D">(D)</num><heading> <inline class="small-caps">Eligible projects</inline>.—</heading><chapeau>The Secretary may provide a grant under this paragraph for a project that is expected to reduce greenhouse gas emissions and to expand or fill gaps in access to publicly accessible electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id193a3bae-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/D/i"><num value="i">(i)</num><content> development phase activities, including planning, feasibility analysis, revenue forecasting, environmental review, preliminary engineering and design work, and other preconstruction activities; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3baf-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/D/ii"><num value="ii">(ii)</num><content> the acquisition and installation of electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure that is directly related to the charging or fueling of a vehicle, including any related construction or reconstruction and the acquisition of real property directly related to the project, such as locations described in subparagraph (E), to expand access to electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3bb0-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/E"><num value="E">(E)</num><heading> <inline class="small-caps">Project locations</inline>.—</heading><content>A project receiving a grant under this paragraph may be located on any public road or in other publicly accessible locations, such as parking facilities at public buildings, public schools, and public parks, or in publicly accessible parking facilities owned or managed by a private entity.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3bb1-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/F"><num value="F">(F)</num><heading> <inline class="small-caps">Priority</inline>.—</heading><chapeau>In providing grants under this paragraph, the Secretary shall give priority to projects that expand access to electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure within—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id193a3bb2-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/F/i"><num value="i">(i)</num><content> rural areas;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3bb3-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/F/ii"><num value="ii">(ii)</num><content> low- and moderate-income neighborhoods; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3bb4-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/F/iii"><num value="iii">(iii)</num><content> communities with a low ratio of private parking spaces to households or a high ratio of multiunit dwellings to single family homes, as determined by the Secretary.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3bb5-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/G"><num value="G">(G)</num><heading> <inline class="small-caps">Additional considerations</inline>.—</heading><chapeau>In providing grants under this paragraph, the Secretary shall consider the extent to which the project—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id193a3bb6-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/G/i"><num value="i">(i)</num><content> contributes to geographic diversity among eligible entities, including achieving a balance between urban and rural communities; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3bb7-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/G/ii"><num value="ii">(ii)</num><content> meets current or anticipated market demands for charging or fueling infrastructure, including faster charging speeds with high-powered capabilities necessary to minimize the time to charge or refuel current and anticipated vehicles.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3bb8-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/H"><num value="H">(H)</num><heading> <inline class="small-caps">Partnering with private entities</inline>.—</heading><content>An eligible entity that receives a grant under this paragraph may use the grant funds to contract with a private entity for the acquisition, construction, installation, maintenance, or operation of electric vehicle charging infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure, or natural gas fueling infrastructure that is directly related to the charging or fueling of a vehicle.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3bb9-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/I"><num value="I">(I)</num><heading> <inline class="small-caps">Maximum grant amount</inline>.—</heading><content>The amount of a grant under this paragraph shall not be more than $15,000,000.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3bba-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/J"><num value="J">(J)</num><heading> <inline class="small-caps">Technical assistance</inline>.—</heading><content>Of the amounts reserved under subparagraph (A), the Secretary may use not more than 1 percent to provide technical assistance to eligible entities.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3bbb-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/8/K"><num value="K">(K)</num><heading> <inline class="small-caps">Additional activities</inline>.—</heading><content>The recipient of a grant under this paragraph may use not more than 5 percent of the grant funds on educational and community engagement activities to develop and implement education programs through partnerships with schools, community organizations, and vehicle dealerships to support the use of zero-emission vehicles and associated infrastructure.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id193a3bbc-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/9"><num value="9">(9)</num><heading> <inline class="small-caps">Requirements.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3bbd-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/9/A"><num value="A">(A)</num><heading> <inline class="small-caps">Project treatment</inline>.—</heading><content>Notwithstanding any other provision of law, any project funded by a grant under this subsection shall be treated as a project on a Federal-aid highway under this chapter.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3bbe-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/9/B"><num value="B">(B)</num><heading> <inline class="small-caps">Signs</inline>.—</heading><chapeau>Any traffic control device or on-premises sign acquired, installed, or operated with a grant under this subsection shall comply with—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id193a3bbf-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/9/B/i"><num value="i">(i)</num><content> the Manual on Uniform Traffic Control Devices, if located in the right-of-way; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id193a3bc0-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/9/B/ii"><num value="ii">(ii)</num><content> other provisions of Federal, State, and local law, as applicable.</content>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id193a3bc1-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/10"><num value="10">(10)</num><heading> <inline class="small-caps">Federal share.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3bc2-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/10/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Federal share of the cost of a project carried out with a grant under this subsection shall not exceed 80 percent of the total project cost.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id193a3bc3-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/10/B"><num value="B">(B)</num><heading> <inline class="small-caps">Responsibility of private entity</inline>.—</heading><content>As a condition of contracting with an eligible entity under paragraph (6) or (8), a private entity shall agree to pay the share of the cost of a project carried out with a grant under this subsection that is not paid by the Federal Government under subparagraph (A).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id193a3bc4-cbad-11ec-b696-c26cc3801616" identifier="/us/usc/t23/s151/f/11"><num value="11">(11)</num><heading> <inline class="small-caps">Report</inline>.—</heading><content>Not later than 3 years after the date of enactment of this subsection, the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives and make publicly available a report on the progress and implementation of this subsection.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Membership.—</inline></heading><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>The working group shall be composed of—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> the Secretaries (or designees), who shall be cochairs of the working group; and</content>

<item style="-uslm-lc:I580424" class="indent5"><num value="gg">“(gg)</num><content> the transportation fueling distribution industry;</content>
</item>
<item style="-uslm-lc:I580424" class="indent5"><num value="hh">“(hh)</num><content> the energy provider industry;</content>

<item style="-uslm-lc:I580424" class="indent5"><num value="ii">“(ii)</num><content> the automotive dealing industry;</content>

<item style="-uslm-lc:I580424" class="indent5"><num value="jj">“(jj)</num><content> the for-hire passenger transportation industry;</content>

<item style="-uslm-lc:I580424" class="indent5"><num value="mm">“(mm)</num><content> an organization representing State departments of transportation;</content>
</item>
<item style="-uslm-lc:I580424" class="indent5"><num value="nn">“(nn)</num><content> an organization representing State departments of energy or State energy planners;</content>
</item>
<item style="-uslm-lc:I580424" class="indent5"><num value="oo">“(oo)</num><content> the intelligent transportation systems and technologies industry;</content>
</item>
<item style="-uslm-lc:I580424" class="indent5"><num value="pp">“(pp)</num><content> labor organizations representing workers in transportation manufacturing, construction, or operations;</content>
</item>
<item style="-uslm-lc:I580424" class="indent5"><num value="qq">“(qq)</num><content> the trucking industry;</content>
</item>
<item style="-uslm-lc:I580424" class="indent5"><num value="rr">“(rr)</num><content> Tribal governments; and</content>
</item>
<item style="-uslm-lc:I580424" class="indent5"><num value="ss">“(ss)</num><content> the property development industry; and</content>
</item>
</subclause>
<subclause style="-uslm-lc:I36" class="indent4 firstIndent-4"><num value="II">     “(II)</num><content> may include a representative of any other non-Federal stakeholder that the Secretaries consider to be appropriate.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><heading> <inline class="small-caps">Requirement</inline>.—</heading><chapeau>The stakeholders selected under clause (i) shall, in the aggregate—</chapeau><subclause style="-uslm-lc:I36" class="indent4 firstIndent-4"><num value="I">     “(I)</num><content> consist of individuals with a balance of backgrounds, experiences, and viewpoints; and</content>
</subclause>
<subclause style="-uslm-lc:I36" class="indent4 firstIndent-4"><num value="II">     “(II)</num><content> include individuals that represent geographically diverse regions of the United States, including individuals representing the perspectives of rural, urban, and suburban areas.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><heading> <inline class="small-caps">Compensation</inline>.—</heading><content>A member of the working group shall serve without compensation.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Meetings.—</inline></heading><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The working group shall meet not less frequently than once every 120 days.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><heading> <inline class="small-caps">Remote participation</inline>.—</heading><content>A member of the working group may participate in a meeting of the working group via teleconference or similar means.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><heading> <inline class="small-caps">Coordination</inline>.—</heading><content>In carrying out the duties of the working group, the working group shall coordinate and consult with any existing Federal interagency working groups on fleet conversion or other similar matters relating to electric vehicles.</content>

</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Reports and Strategy on Electric Vehicle Adoption.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Working group reports</inline>.—</heading><chapeau>The working group shall complete by each of the deadlines described in paragraph (2) a report describing the status of electric vehicle adoption including—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><chapeau> a description of the barriers and opportunities to scaling up electric vehicle adoption throughout the United States, including recommendations for issues relating to—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> consumer behavior;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> charging infrastructure needs, including standardization and cybersecurity;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iii">“(iii)</num><content> manufacturing and battery costs, including the raw material shortages for batteries and electric motor magnets;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iv">“(iv)</num><content> the adoption of electric vehicles for low- and moderate-income individuals and underserved communities, including charging infrastructure access and vehicle purchase financing;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="v">“(v)</num><content> business models for charging personal electric vehicles outside the home, including wired and wireless charging;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="vi">“(vi)</num><content> charging infrastructure permitting and regulatory issues;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="vii">“(vii)</num><content> the connections between housing and transportation costs and emissions;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="viii">“(viii)</num><content> freight transportation, including local, port and drayage, regional, and long-haul trucking;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ix">“(ix)</num><content> intercity passenger travel;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="x">“(x)</num><content> the process by which governments collect a user fee for the contribution of electric vehicles to funding roadway improvements;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="xi">“(xi)</num><content> State- and local-level policies, incentives, and zoning efforts;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="xii">“(xii)</num><content> the installation of highway corridor signage;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="xiii">“(xiii)</num><content> secondary markets and recycling for batteries;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="xiv">“(xiv)</num><content> grid capacity and integration;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="xv">“(xv)</num><content> energy storage; and</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="xvi">“(xvi)</num><content> specific regional or local issues that may not appear to apply throughout the United States, but may hamper nationwide adoption or coordination of electric vehicles;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> examples of successful public and private models and demonstration projects that encourage electric vehicle adoption;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> an analysis of current efforts to overcome the barriers described in subparagraph (A);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><content> an analysis of the estimated costs and benefits of any recommendations of the working group; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="E">“(E)</num><content> any other topics, as determined by the working group.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Deadlines</inline>.—</heading><chapeau>A report under paragraph (1) shall be submitted to the Secretaries, the Committees on Commerce, Science, and Transportation and Appropriations of the Senate and the Committees on Transportation and Infrastructure and Appropriations of the House of Representatives—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> in the case of the first report, by not later than 18 months after the date on which the working group is established under subsection (b)(1);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> in the case of the second report, by not later than 2 years after the date on which the first report is required to be submitted under subparagraph (A); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> in the case of the third report, by not later than 2 years after the date on which the second report is required to be submitted under subparagraph (B).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Strategy.—</inline></heading><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Based on the reports submitted by the working group under paragraph (1), the Secretaries shall jointly develop, maintain, and update a strategy that describes the means by which the Federal Government, States, units of local government, and industry can—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> establish quantitative targets for transportation electrification;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> overcome the barriers described in paragraph (1)(A);</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iii">“(iii)</num><content> identify areas of opportunity in research and development to improve battery manufacturing, mineral mining, recycling costs, material recovery, fire risks, and battery performance for electric vehicles;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iv">“(iv)</num><content> enhance Federal interagency coordination to promote electric vehicle adoption;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="v">“(v)</num><content> prepare the workforce for the adoption of electric vehicles, including through collaboration with labor unions, educational institutions, and relevant manufacturers;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="vi">“(vi)</num><content> expand electric vehicle and charging infrastructure;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="vii">“(vii)</num><content> expand knowledge of the benefits of electric vehicles among the general public;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="viii">“(viii)</num><content> maintain the global competitiveness of the United States in the electric vehicle and charging infrastructure markets;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ix">“(ix)</num><content> provide clarity in regulations to improve national uniformity with respect to electric vehicles; and</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="x">“(x)</num><content> ensure the sustainable integration of electric vehicles into the national electric grid.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><heading> <inline class="small-caps">Notice and comment</inline>.—</heading><content>In carrying out subparagraph (A), the Secretaries shall provide public notice and opportunity for comment on the strategy described in that subparagraph.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><heading> <inline class="small-caps">Information.—</inline></heading><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Secretaries may enter into an agreement with the Transportation Research Board of the National Academies of Sciences, Engineering, and Medicine to provide, track, or report data, information, or research to assist the working group in carrying out paragraph (1).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><heading> <inline class="small-caps">Use of existing information</inline>.—</heading><chapeau>In developing a report under paragraph (1) or a strategy under paragraph (3), the Secretaries and the working group shall take into consideration existing Federal, State, local, private sector, and academic data and information relating to electric vehicles and, to the maximum extent practicable, coordinate with the entities that publish that information—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> to prevent duplication of efforts by the Federal Government; and</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> to leverage existing information and complementary efforts.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Coordination</inline>.—</heading><chapeau>To the maximum extent practicable, the Secretaries and the working group shall carry out this section using all available existing resources, websites, and databases of Federal agencies, such as—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> the Alternative Fuels Data Center;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> the Energy Efficient Mobility Systems program; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> the Clean Cities Coalition Network.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Termination</inline>.—</heading><content>The working group shall terminate on submission of the third report required under subsection (c)(2)(C).”</content>
