<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="iddc28e8b9-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166"><num value="166">§ 166.</num><heading> HOV facilities</heading><subsection style="-uslm-lc:I11" class="indent0" id="iddc28e8ba-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/a"><num value="a">(a)</num><heading> In General.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="iddc28e8bb-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">Authority of public authorities</inline>.—</heading><content>A public authority that has jurisdiction over the operation of a HOV facility shall establish the occupancy requirements of vehicles operating on the facility.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="iddc28e8bc-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/a/2"><num value="2">(2)</num><heading> <inline class="small-caps">Occupancy requirement</inline>.—</heading><content>Except as otherwise provided by this section, no fewer than two occupants per vehicle may be required for use of a HOV facility.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="iddc28e8bd-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b"><num value="b">(b)</num><heading> Exceptions.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="iddc28e8be-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Notwithstanding the occupancy requirement of subsection (a)(2), the exceptions in paragraphs (2) through (5) shall apply with respect to a public authority operating a HOV facility.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="iddc28e8bf-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/2"><num value="2">(2)</num><heading> Motorcycles and bicycles.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8c0-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/2/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Subject to subparagraph (B), the public authority shall allow motorcycles and bicycles to use the HOV facility.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8c1-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/2/B"><num value="B">(B)</num><heading> <inline class="small-caps">Safety exception</inline>.—</heading><clause style="-uslm-lc:I14" class="indent3" id="iddc28e8c2-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/2/B/i"><num value="i">(i)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>A public authority may restrict use of the HOV facility by motorcycles or bicycles (or both) if the authority certifies to the Secretary that such use would create a safety hazard and the Secretary accepts the certification.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="iddc28e8c3-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/2/B/ii"><num value="ii">(ii)</num><heading> <inline class="small-caps">Acceptance of certification</inline>.—</heading><content>The Secretary may accept a certification under this subparagraph only after the Secretary publishes notice of the certification in the Federal Register and provides an opportunity for public comment.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="iddc28e8c4-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/3"><num value="3">(3)</num><heading> <inline class="small-caps">Public transportation vehicles</inline>.—</heading><chapeau>The public authority may allow public transportation vehicles to use the HOV facility if the authority—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8c5-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/3/A"><num value="A">(A)</num><content> establishes requirements for clearly identifying the vehicles;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8c6-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/3/B"><num value="B">(B)</num><content> establishes procedures for enforcing the restrictions on the use of the facility by the vehicles; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8c7-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/3/C"><num value="C">(C)</num><content> provides equal access under the same rates, terms, and conditions for all public transportation vehicles and over-the-road buses serving the public.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="iddc28e8c8-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/4"><num value="4">(4)</num><heading> <inline class="small-caps">High occupancy toll vehicles</inline>.—</heading><chapeau>The public authority may allow vehicles not otherwise exempt pursuant to this subsection to use the HOV facility if the operators of the vehicles pay a toll charged by the authority for use of the facility and the authority—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8c9-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/4/A"><num value="A">(A)</num><content> establishes a program that addresses how motorists can enroll and participate in the toll program;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8ca-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/4/B"><num value="B">(B)</num><content> develops, manages, and maintains a system that will automatically collect the toll; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8cb-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/4/C"><num value="C">(C)</num><chapeau> establishes policies and procedures to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="iddc28e8cc-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/4/C/i"><num value="i">(i)</num><content> manage the demand to use the facility by varying the toll amount that is charged;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="iddc28e8cd-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/4/C/ii"><num value="ii">(ii)</num><content> enforce violations of use of the facility; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="iddc28e8ce-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/4/C/iii"><num value="iii">(iii)</num><content> ensure that over-the-road buses serving the public are provided access to the facility under the same rates, terms, and conditions as public transportation buses.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="iddc28e8cf-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/5"><num value="5">(5)</num><heading> Low emission and energy-efficient vehicles.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8d0-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/5/A"><num value="A">(A)</num><heading> <inline class="small-caps">Special rule</inline>.—</heading><chapeau>Before <date date="2025-09-30">September 30, 2025</date>, if a public authority establishes procedures for enforcing the restrictions on the use of a HOV facility by vehicles described in clauses (i) and (ii), the public authority may allow the use of the HOV facility by—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="iddc28e8d1-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/5/A/i"><num value="i">(i)</num><content> alternative fuel vehicles; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="iddc28e8d2-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/5/A/ii"><num value="ii">(ii)</num><content> any motor vehicle described in section 30D(d)(1) of the Internal Revenue Code of 1986.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8d3-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/5/B"><num value="B">(B)</num><heading> <inline class="small-caps">Other low emission and energy-efficient vehicles</inline>.—</heading><chapeau>Before <date date="2019-09-30">September 30, 2019</date>, the public authority may allow vehicles certified as low emission and energy-efficient vehicles under subsection (e), and labeled in accordance with subsection (e), to use the HOV facility if the operators of the vehicles pay a toll charged by the authority for use of the facility and the authority—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="iddc28e8d4-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/5/B/i"><num value="i">(i)</num><content> establishes a program that addresses the selection of vehicles under this paragraph; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="iddc28e8d5-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/5/B/ii"><num value="ii">(ii)</num><content> establishes procedures for enforcing the restrictions on the use of the facility by the vehicles.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8d6-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/b/5/C"><num value="C">(C)</num><heading> <inline class="small-caps">Amount of tolls</inline>.—</heading><content>Under this paragraph, a public authority may charge no toll or may charge a toll that is less than or equal to tolls charged under paragraph (4).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="iddc28e8d7-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/c"><num value="c">(c)</num><heading> Requirements Applicable to Tolls.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="iddc28e8d8-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Notwithstanding section 301, tolls may be charged under paragraphs (4) and (5) of subsection (b), subject to the requirements of section 129.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="iddc28e8d9-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">Toll revenue</inline>.—</heading><content>Toll revenue collected under this section is subject to the requirements of section 129(a)(3).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="iddc28e8da-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d"><num value="d">(d)</num><heading> HOV Facility Management, Operation, Monitoring, and Enforcement.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="iddc28e8db-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>A public authority that allows vehicles to use a HOV facility under paragraph (4) or (5) of subsection (b) shall submit to the Secretary a report demonstrating that the facility is not already degraded, and that the presence of the vehicles will not cause the facility to become degraded, and certify to the Secretary that the authority will carry out the following responsibilities with respect to the facility:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8dc-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/A"><num value="A">(A)</num><content> Establishing, managing, and supporting a performance monitoring, evaluation, and reporting program for the facility that provides for continuous monitoring, assessment, and reporting on the impacts that the vehicles may have on the operation of the facility and adjacent highways and submitting to the Secretary annual reports of those impacts.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8dd-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/B"><num value="B">(B)</num><content> Establishing, managing, and supporting an enforcement program that ensures that the facility is being operated in accordance with the requirements of this section.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8de-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/C"><num value="C">(C)</num><content> Limiting or discontinuing the use of the facility by the vehicles whenever the operation of the facility is degraded.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8df-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/D"><num value="D">(D)</num><heading> Maintenance of operating performance.—</heading><clause style="-uslm-lc:I14" class="indent3" id="iddc28e8e0-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/D/i"><num value="i">(i)</num><heading> <inline class="small-caps">Submission of plan</inline>.—</heading><chapeau>Not later than 180 days after the date on which a facility is degraded under paragraph (2), the public authority with jurisdiction over the facility shall submit to the Secretary for approval a plan that details the actions the public authority will take to make significant progress toward bringing the facility into compliance with the minimum average operating speed performance standard through changes to the operation of the facility, including—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="iddc28e8e1-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/D/i/I"><num value="I">(I)</num><content> increasing the occupancy requirement for HOV lanes;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="iddc28e8e2-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/D/i/II"><num value="II">(II)</num><content> varying the toll charged to vehicles allowed under subsection (b) to reduce demand;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="iddc28e8e3-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/D/i/III"><num value="III">(III)</num><content> discontinuing allowing non-HOV vehicles to use HOV lanes under subsection (b); or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="iddc28e8e4-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/D/i/IV"><num value="IV">(IV)</num><content> increasing the available capacity of the HOV facility.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="iddc28e8e5-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/D/ii"><num value="ii">(ii)</num><heading> <inline class="small-caps">Notice of approval or disapproval</inline>.—</heading><content>Not later than 60 days after the date of receipt of a plan under clause (i), the Secretary shall provide to the public authority a written notice indicating whether the Secretary has approved or disapproved the plan based on a determination of whether the implementation of the plan will make significant progress toward bringing the HOV facility into compliance with the minimum average operating speed performance standard.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="iddc28e8e6-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/D/iii"><num value="iii">(iii)</num><heading> <inline class="small-caps">Annual progress updates</inline>.—</heading><chapeau>Until the date on which the Secretary determines that the public authority has brought the HOV facility into compliance with this subsection, the public authority shall submit annual updates that describe—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="iddc28e8e7-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/D/iii/I"><num value="I">(I)</num><content> the actions taken to bring the HOV facility into compliance; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="iddc28e8e8-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/D/iii/II"><num value="II">(II)</num><content> the progress made by those actions.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8e9-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/E"><num value="E">(E)</num><heading> <inline class="small-caps">Compliance</inline>.—</heading><content>If the public authority fails to bring a facility into compliance under subparagraph (D), the Secretary shall subject the public authority to appropriate program sanctions under section 1.36 of title 23, Code of Federal Regulations (or successor regulations), until the performance is no longer degraded.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8ea-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/F"><num value="F">(F)</num><heading> Waiver.—</heading><clause style="-uslm-lc:I14" class="indent3" id="iddc28e8eb-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/F/i"><num value="i">(i)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Upon the request of a public authority, the Secretary may waive the compliance requirements of subparagraph (E), if the Secretary determines that—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="iddc28e8ec-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/F/i/I"><num value="I">(I)</num><content> the waiver is in the best interest of the traveling public;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="iddc28e8ed-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/F/i/II"><num value="II">(II)</num><content> the public authority is meeting the conditions under subparagraph (D); and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="iddc28e8ee-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/F/i/III"><num value="III">(III)</num><content> the public authority has made a good faith effort to improve the performance of the facility.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="iddc28e8ef-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/1/F/ii"><num value="ii">(ii)</num><heading> <inline class="small-caps">Condition</inline>.—</heading><content>The Secretary may require, as a condition of providing a waiver under this subparagraph, that a public authority take additional actions, as determined by the Secretary, to maximize the operating speed performance of the facility, even if such performance is below the level set under paragraph (2).</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="iddc28e8f0-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/2"><num value="2">(2)</num><heading> Degraded facility.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8f1-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/2/A"><num value="A">(A)</num><heading> <inline class="small-caps">Definition of minimum average operating speed</inline>.—</heading><chapeau>In this paragraph, the term “minimum average operating speed” means—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="iddc28e8f2-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/2/A/i"><num value="i">(i)</num><content> 45 miles per hour, in the case of a HOV facility with a speed limit of 50 miles per hour or greater; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="iddc28e8f3-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/2/A/ii"><num value="ii">(ii)</num><content> not more than 10 miles per hour below the speed limit, in the case of a HOV facility with a speed limit of less than 50 miles per hour.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8f4-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/2/B"><num value="B">(B)</num><heading> <inline class="small-caps">Standard for determining degraded facility</inline>.—</heading><content>For purposes of paragraph (1), the operation of a HOV facility shall be considered to be degraded if vehicles operating on the facility are failing to maintain a minimum average operating speed 90 percent of the time over a consecutive 180-day period during morning or evening weekday peak hour periods (or both).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8f5-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/d/2/C"><num value="C">(C)</num><heading> <inline class="small-caps">Management of low emission and energy-efficient vehicles</inline>.—</heading><content>In managing the use of HOV lanes by low emission and energy-efficient vehicles that do not meet applicable occupancy requirements, a public authority may increase the percentages described in subsection (f)(3)(B)(i).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="iddc28e8f6-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/e"><num value="e">(e)</num><heading> <inline class="small-caps">Certification of Low Emission and Energy-Efficient Vehicles</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this section, the Administrator of the Environmental Protection Agency shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="iddc28e8f7-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/e/1"><num value="1">(1)</num><content> issue a final rule establishing requirements for certification of vehicles as low emission and energy-efficient vehicles for purposes of this section and requirements for the labeling of the vehicles; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="iddc28e8f8-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/e/2"><num value="2">(2)</num><content> establish guidelines and procedures for making the vehicle comparisons and performance calculations described in subsection (f)(3)(B), in accordance with <ref href="/us/usc/t49/s32908/b">section 32908(b) of title 49</ref>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="iddc28e8f9-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f"><num value="f">(f)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section, the following definitions apply:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="iddc28e8fa-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/1"><num value="1">(1)</num><heading> <inline class="small-caps">Alternative fuel vehicle</inline>.—</heading><chapeau>The term “alternative fuel vehicle” means a vehicle that is solely operating on—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8fb-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/1/A"><num value="A">(A)</num><content> methanol, denatured ethanol, or other alcohols;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8fc-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/1/B"><num value="B">(B)</num><content> a mixture containing at least 85 percent of methanol, denatured ethanol, and other alcohols by volume with gasoline or other fuels;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8fd-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/1/C"><num value="C">(C)</num><content> natural gas;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8fe-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/1/D"><num value="D">(D)</num><content> liquefied petroleum gas;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e8ff-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/1/E"><num value="E">(E)</num><content> hydrogen;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e900-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/1/F"><num value="F">(F)</num><content> coal derived liquid fuels;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e901-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/1/G"><num value="G">(G)</num><content> fuels (except alcohol) derived from biological materials;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e902-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/1/H"><num value="H">(H)</num><content> electricity (including electricity from solar energy); or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e903-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/1/I"><num value="I">(I)</num><content> any other fuel that the Secretary prescribes by regulation that is not substantially petroleum and that would yield substantial energy security and environmental benefits, including fuels regulated under <ref href="/us/usc/t10/s490">section 490 of title 10</ref>, Code of Federal Regulations (or successor regulations).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="iddc28e904-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/2"><num value="2">(2)</num><heading> HOV <inline class="small-caps">facility</inline>.—</heading><content>The term “HOV facility” means a high occupancy vehicle facility.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="iddc28e905-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/3"><num value="3">(3)</num><heading> <inline class="small-caps">Low emission and energy-efficient vehicle</inline>.—</heading><chapeau>The term “low emission and energy-efficient vehicle” means a vehicle that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e906-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/3/A"><num value="A">(A)</num><content> has been certified by the Administrator as meeting the Tier II emission level established in regulations prescribed by the Administrator under section 202(i) of the Clean Air Act (<ref href="/us/usc/t42/s7521/i">42 U.S.C. 7521(i)</ref>) for that make and model year vehicle; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e907-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/3/B"><num value="B">(B)</num><clause style="-uslm-lc:I13" class="indent2" id="iddc28e908-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/3/B/i"><num value="i">(i)</num><content> is certified by the Administrator of the Environmental Protection Agency, in consultation with the manufacturer, to have achieved not less than a 50-percent increase in city fuel economy or not less than a 25-percent increase in combined city-highway fuel economy (or such greater percentage of city or city-highway fuel economy as may be determined by a State under subsection (d)(2)(C)) relative to a comparable vehicle that is an internal combustion gasoline fueled vehicle (other than a vehicle that has propulsion energy from onboard hybrid sources); or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="iddc28e909-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/3/B/ii"><num value="ii">(ii)</num><content> is an alternative fuel vehicle.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="iddc28e90a-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/4"><num value="4">(4)</num><heading> <inline class="small-caps">Over-the-road bus</inline>.—</heading><content>The term “over-the-road bus” has the meaning given the term in section 301 of the Americans with Disabilities Act of 1990 (<ref href="/us/usc/t42/s12181">42 U.S.C. 12181</ref>).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="iddc28e90b-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/5"><num value="5">(5)</num><heading> <inline class="small-caps">Public authority</inline>.—</heading><content>The term “public authority” as used with respect to a HOV facility, means a State, interstate compact of States, public entity designated by a State, or local government having jurisdiction over the operation of the facility.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="iddc28e90c-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/6"><num value="6">(6)</num><heading> <inline class="small-caps">Public transportation vehicle</inline>.—</heading><chapeau>The term “public transportation vehicle” means a vehicle that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e90d-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/6/A"><num value="A">(A)</num><content> provides designated public transportation (as defined in section 221 of the Americans with Disabilities Act of 1990 (<ref href="/us/usc/t42/s12141">42 U.S.C. 12141</ref>) or provides public school transportation (to and from public or private primary, secondary, or tertiary schools); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="iddc28e90e-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/6/B"><num value="B">(B)</num><clause style="-uslm-lc:I13" class="indent2" id="iddc28e90f-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/6/B/i"><num value="i">(i)</num><content> is owned or operated by a public entity;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="iddc28e910-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/6/B/ii"><num value="ii">(ii)</num><content> is operated under a contract with a public entity; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="iddc28e911-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/f/6/B/iii"><num value="iii">(iii)</num><content> is operated pursuant to a license by the Secretary or a public authority to provide motorbus or school vehicle transportation services to the public.</content>

</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="iddc28e912-4db0-11e6-8c16-c75e75b729c7" identifier="/us/usc/t23/s166/g"><num value="g">(g)</num><heading> <inline class="small-caps">Consultation of MPO</inline>.—</heading><content>If a HOV facility charging tolls under paragraph (4) or (5) of subsection (b) is on the Interstate System and located in a metropolitan planning area established in accordance with section 134, the public authority shall consult with the metropolitan planning organization for the area concerning the placement and amount of tolls on the facility.</content>
