A, title I, § 1115(a), July 6, 2012, 126 Stat. 468.)","seq_in_title":66,"parent_identifier":"/us/usc/t23/ch1","ancestors":[{"identifier":"/us/usc/t23","level":"title","num":"Title 23—","heading":"HIGHWAYS","status":null,"is_section":false},{"identifier":"/us/usc/t23/ch1","level":"chapter","num":"CHAPTER 1—","heading":"FEDERAL-AID HIGHWAYS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idf518817f-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167\"><num value=\"167\">§ 167.</num><heading> National freight policy</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf5188180-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><content>It is the policy of the United States to improve the condition and performance of the national freight network to ensure that the national freight network provides the foundation for the United States to compete in the global economy and achieve each goal described in subsection (b).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf5188181-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Goals</inline>.—</heading><chapeau>The goals of the national freight policy are—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf5188182-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/b/1\"><num value=\"1\">(1)</num><chapeau> to invest in infrastructure improvements and to implement operational improvements that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf5188183-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/b/1/A\"><num value=\"A\">(A)</num><content> strengthen the contribution of the national freight network to the economic competitiveness of the United States;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf5188184-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/b/1/B\"><num value=\"B\">(B)</num><content> reduce congestion; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf5188185-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/b/1/C\"><num value=\"C\">(C)</num><content> increase productivity, particularly for domestic industries and businesses that create high-value jobs;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf5188186-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/b/2\"><num value=\"2\">(2)</num><content> to improve the safety, security, and resilience of freight transportation;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf5188187-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/b/3\"><num value=\"3\">(3)</num><content> to improve the state of good repair of the national freight network;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf5188188-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/b/4\"><num value=\"4\">(4)</num><content> to use advanced technology to improve the safety and efficiency of the national freight network;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf5188189-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/b/5\"><num value=\"5\">(5)</num><content> to incorporate concepts of performance, innovation, competition, and accountability into the operation and maintenance of the national freight network; and <ref class=\"footnoteRef\" idref=\"fn002027\">1</ref><note type=\"footnote\" id=\"fn002027\"><num>1</num> So in original.</note></content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf518818a-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/b/6\"><num value=\"6\">(6)</num><content> to improve the economic efficiency of the national freight network.<sup>1</sup></content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf518818b-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/b/7\"><num value=\"7\">(7)</num><content> to reduce the environmental impacts of freight movement on the national freight network; <sup>1</sup></content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf518818c-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/c\"><num value=\"c\">(c)</num><heading> Establishment of a National Freight Network.—</heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf518818d-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/c/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>The Secretary shall establish a national freight network in accordance with this section to assist States in strategically directing resources toward improved system performance for efficient movement of freight on highways, including national highway system, freight intermodal connectors and aerotropolis transportation systems.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf518818e-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/c/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Network components</inline>.—</heading><chapeau>The national freight network shall consist of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf518818f-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/c/2/A\"><num value=\"A\">(A)</num><content> the primary freight network, as designated by the Secretary under subsection (d) (referred to in this section as the “primary freight network”) as most critical to the movement of freight;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf5188190-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/c/2/B\"><num value=\"B\">(B)</num><content> the portions of the Interstate System not designated as part of the primary freight network; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf5188191-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/c/2/C\"><num value=\"C\">(C)</num><content> critical rural freight corridors established under subsection (e).</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf5188192-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/d\"><num value=\"d\">(d)</num><heading> Designation of Primary Freight Network.—</heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf5188193-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/d/1\"><num value=\"1\">(1)</num><heading> Initial designation of primary freight network.—</heading><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf5188194-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/d/1/A\"><num value=\"A\">(A)</num><heading> <inline class=\"small-caps\">Designation</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of this section, the Secretary shall designate a primary freight network—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf5188195-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/d/1/A/i\"><num value=\"i\">(i)</num><content> based on an inventory of national freight volume conducted by the Administrator of the Federal Highway Administration, in consultation with stakeholders, including system users, transport providers, and States; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf5188196-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/d/1/A/ii\"><num value=\"ii\">(ii)</num><content> that shall be comprised of not more than 27,000 centerline miles of existing roadways that are most critical to the movement of freight.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf5188197-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/d/1/B\"><num value=\"B\">(B)</num><heading> <inline class=\"small-caps\">Factors for designation</inline>.—</heading><chapeau>In designating the primary freight network, the Secretary shall consider—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf5188198-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/d/1/B/i\"><num value=\"i\">(i)</num><content> the origins and destinations of freight movement in the United States;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf5188199-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/d/1/B/ii\"><num value=\"ii\">(ii)</num><content> the total freight tonnage and value of freight moved by highways;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf518819a-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/d/1/B/iii\"><num value=\"iii\">(iii)</num><content> the percentage of annual average daily truck traffic in the annual average daily traffic on principal arterials;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf518819b-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/d/1/B/iv\"><num value=\"iv\">(iv)</num><content> the annual average daily truck traffic on principal arterials;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf518819c-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/d/1/B/v\"><num value=\"v\">(v)</num><content> land and maritime ports of entry;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf518819d-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/d/1/B/vi\"><num value=\"vi\">(vi)</num><content> access to energy exploration, development, installation, or production areas;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf518819e-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/d/1/B/vii\"><num value=\"vii\">(vii)</num><content> population centers; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf518819f-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/d/1/B/viii\"><num value=\"viii\">(viii)</num><content> network connectivity.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf51881a0-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/d/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Additional miles on primary freight network</inline>.—</heading><content>In addition to the miles initially designated under paragraph (1), the Secretary may increase the number of miles designated as part of the primary freight network by not more than 3,000 additional centerline miles of roadways (which may include existing or planned roads) critical to future efficient movement of goods on the primary freight network.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf51881a1-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/d/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Redesignation of primary freight network</inline>.—</heading><content>Effective beginning 10 years after the designation of the primary freight network and every 10 years thereafter, using the designation factors described in paragraph (1), the Secretary shall redesignate the primary freight network (including additional mileage described in paragraph (2)).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf51881a2-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/e\"><num value=\"e\">(e)</num><heading> <inline class=\"small-caps\">Critical Rural Freight Corridors</inline>.—</heading><chapeau>A State may designate a road within the borders of the State as a critical rural freight corridor if the road—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf51881a3-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/e/1\"><num value=\"1\">(1)</num><content> is a rural principal arterial roadway and has a minimum of 25 percent of the annual average daily traffic of the road measured in passenger vehicle equivalent units from trucks (FHWA vehicle class 8 to 13);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf51881a4-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/e/2\"><num value=\"2\">(2)</num><content> provides access to energy exploration, development, installation, or production areas;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf51881a5-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/e/3\"><num value=\"3\">(3)</num><chapeau> connects the primary freight network, a roadway described in paragraph (1) or (2), or Interstate System to facilities that handle more than—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf51881a6-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/e/3/A\"><num value=\"A\">(A)</num><content> 50,000 20-foot equivalent units per year; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf51881a7-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/e/3/B\"><num value=\"B\">(B)</num><content> 500,000 tons per year of bulk commodities.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf51881a8-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/f\"><num value=\"f\">(f)</num><heading> National Freight Strategic Plan.—</heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf51881a9-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/f/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Initial development of national freight strategic plan</inline>.—</heading><chapeau>Not later than 3 years after the date of enactment of this section, the Secretary shall, in consultation with State departments of transportation and other appropriate public and private transportation stakeholders, develop and post on the Department of Transportation public website a national freight strategic plan that shall include—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf51881aa-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/f/1/A\"><num value=\"A\">(A)</num><content> an assessment of the condition and performance of the national freight network;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf51af1ab-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/f/1/B\"><num value=\"B\">(B)</num><chapeau> an identification of highway bottlenecks on the national freight network that create significant freight congestion problems, based on a quantitative methodology developed by the Secretary, which shall, at a minimum, include—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf51af1ac-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/f/1/B/i\"><num value=\"i\">(i)</num><content> information from the Freight Analysis Network of the Federal Highway Administration; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf51af1ad-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/f/1/B/ii\"><num value=\"ii\">(ii)</num><content> to the maximum extent practicable, an estimate of the cost of addressing each bottleneck and any operational improvements that could be implemented;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf51af1ae-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/f/1/C\"><num value=\"C\">(C)</num><content> forecasts of freight volumes for the 20-year period beginning in the year during which the plan is issued;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf51af1af-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/f/1/D\"><num value=\"D\">(D)</num><content> an identification of major trade gateways and national freight corridors that connect major population centers, trade gateways, and other major freight generators for current and forecasted traffic and freight volumes, the identification of which shall be revised, as appropriate, in subsequent plans;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf51af1b0-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/f/1/E\"><num value=\"E\">(E)</num><content> an assessment of statutory, regulatory, technological, institutional, financial, and other barriers to improved freight transportation performance (including opportunities for overcoming the barriers);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf51af1b1-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/f/1/F\"><num value=\"F\">(F)</num><content> an identification of routes providing access to energy exploration, development, installation, or production areas;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf51af1b2-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/f/1/G\"><num value=\"G\">(G)</num><content> best practices for improving the performance of the national freight network;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf51af1b3-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/f/1/H\"><num value=\"H\">(H)</num><content> best practices to mitigate the impacts of freight movement on communities;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf51af1b4-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/f/1/I\"><num value=\"I\">(I)</num><content> a process for addressing multistate projects and encouraging jurisdictions to collaborate; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf51af1b5-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/f/1/J\"><num value=\"J\">(J)</num><content> strategies to improve freight intermodal connectivity.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf51af1b6-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/f/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Updates to national freight strategic plan</inline>.—</heading><content>Not later than 5 years after the date of completion of the first national freight strategic plan under paragraph (1), and every 5 years thereafter, the Secretary shall update and repost on the Department of Transportation public website a revised national freight strategic plan.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf51af1b7-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/g\"><num value=\"g\">(g)</num><heading> <inline class=\"small-caps\">Freight Transportation Conditions and Performance Reports</inline>.—</heading><content>Not later than 2 years after the date of enactment of this section, and biennially thereafter, the Secretary shall prepare a report that contains a description of the conditions and performance of the national freight network in the United States.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf51af1b8-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/h\"><num value=\"h\">(h)</num><heading> Transportation Investment Data and Planning Tools.—</heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf51af1b9-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/h/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of this section, the Secretary shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf51af1ba-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/h/1/A\"><num value=\"A\">(A)</num><chapeau> begin development of new tools and improvement of existing tools or improve existing tools to support an outcome-oriented, performance-based approach to evaluate proposed freight-related and other transportation projects, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf51af1bb-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/h/1/A/i\"><num value=\"i\">(i)</num><content> methodologies for systematic analysis of benefits and costs;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf51af1bc-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/h/1/A/ii\"><num value=\"ii\">(ii)</num><content> tools for ensuring that the evaluation of freight-related and other transportation projects could consider safety, economic competitiveness, environmental sustainability, and system condition in the project selection process; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf51af1bd-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/h/1/A/iii\"><num value=\"iii\">(iii)</num><content> other elements to assist in effective transportation planning;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf51af1be-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/h/1/B\"><num value=\"B\">(B)</num><content> identify transportation-related model data elements to support a broad range of evaluation methods and techniques to assist in making transportation investment decisions; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf51af1bf-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/h/1/C\"><num value=\"C\">(C)</num><content> at a minimum, in consultation with other relevant Federal agencies, consider any improvements to existing freight flow data collection efforts that could reduce identified freight data gaps and deficiencies and help improve forecasts of freight transportation demand.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf51af1c0-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/h/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Consultation</inline>.—</heading><content>The Secretary shall consult with Federal, State, and other stakeholders to develop, improve, and implement the tools and collect the data in paragraph (1).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf51af1c1-aaf5-11e3-9cb9-d0ea7a264bf5\" identifier=\"/us/usc/t23/s167/i\"><num value=\"i\">(i)</num><heading> <inline class=\"small-caps\">Definition of Aerotropolis Transportation System</inline>.—</heading><content>In this section, the term “aerotropolis transportation system” means a planned and coordinated multimodal freight and passenger transportation network that, as determined by the Secretary, provides efficient, cost-effective, sustainable, and intermodal connectivity to a defined region of economic significance centered around a major airport.</content>\n</subsection>\n<sourceCredit id=\"idf51af1c2-aaf5-11e3-9cb9-d0ea7a264bf5\">(Added <ref href=\"/us/pl/112/141/s1115/a\">Pub. L. 112–141, div. A, title I</ref>, §§ 1116–1118, <date date=\"2012-07-06\">July 6, 2012</date>, <ref href=\"/us/stat/126/472\">126 Stat. 472</ref>, 473, provided that:<quotedContent origin=\"/us/pl/112/141\">\n<section style=\"-uslm-lc:I580467\"><num value=\"1116\">“SEC. 1116.</num><heading> PRIORITIZATION OF PROJECTS TO IMPROVE FREIGHT MOVEMENT.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><content>Notwithstanding <ref href=\"/us/usc/t23/s120\">section 120 of title 23</ref>, United States Code, the Secretary may increase the Federal share payable for any project to 95 percent for projects on the Interstate System and 90 percent for any other project if the Secretary certifies that the project meets the requirements of this section.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Increased Funding</inline>.—</heading><chapeau>To be eligible for the increased Federal funding share under this section, a project shall—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> demonstrate the improvement made by the project to the efficient movement of freight, including making progress towards meeting performance targets for freight movement established under <ref href=\"/us/usc/t23/s150/d\">section 150(d) of title 23</ref>, United States Code; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> be identified in a State freight plan developed pursuant to section 1118.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Eligible Projects</inline>.—</heading><chapeau>Eligible projects to improve the movement of freight under this section may include, but are not limited to—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> construction, reconstruction, rehabilitation, and operational improvements directly relating to improving freight movement;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> intelligent transportation systems and other technology to improve the flow of freight;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> efforts to reduce the environmental impacts of freight movement on the primary freight network;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> railway-highway grade separation;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> geometric improvements to interchanges and ramps. [sic]</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"6\">“(6)</num><content> truck-only lanes;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"7\">“(7)</num><content> climbing and runaway truck lanes;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"8\">“(8)</num><content> truck parking facilities eligible for funding under section 1401;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"9\">“(9)</num><content> real-time traffic, truck parking, roadway condition, and multimodal transportation information systems;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"10\">“(10)</num><content> improvements to freight intermodal connectors; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"11\">“(11)</num><content> improvements to truck bottlenecks.</content>\n</paragraph>\n</subsection>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"1117\">“SEC. 1117.</num><heading> STATE FREIGHT ADVISORY COMMITTEES.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><content>The Secretary shall encourage each State to establish a freight advisory committee consisting of a representative cross-section of public and private sector freight stakeholders, including representatives of ports, shippers, carriers, freight-related associations, the freight industry workforce, the transportation department of the State, and local governments.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Role of Committee</inline>.—</heading><chapeau>A freight advisory committee of a State described in subsection (a) shall—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> advise the State on freight-related priorities, issues, projects, and funding needs;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> serve as a forum for discussion for State transportation decisions affecting freight mobility;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> communicate and coordinate regional priorities with other organizations;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> promote the sharing of information between the private and public sectors on freight issues; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> participate in the development of the freight plan of the State described in section 1118.</content>\n</paragraph>\n</subsection>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"1118\">“SEC. 1118.</num><heading> STATE FREIGHT PLANS.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><content>The Secretary shall encourage each State to develop a freight plan that provides a comprehensive plan for the immediate and long-range planning activities and investments of the State with respect to freight.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Plan Contents</inline>.—</heading><chapeau>A freight plan described in subsection (a) shall include, at a minimum—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> an identification of significant freight system trends, needs, and issues with respect to the State;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> a description of the freight policies, strategies, and performance measures that will guide the freight-related transportation investment decisions of the State;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> a description of how the plan will improve the ability of the State to meet the national freight goals established under <ref href=\"/us/usc/t23/s167\">section 167 of title 23</ref>, United States Code;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> evidence of consideration of innovative technologies and operational strategies, including intelligent transportation systems, that improve the safety and efficiency of freight movement;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> in the case of routes on which travel by heavy vehicles (including mining, agricultural, energy cargo or equipment, and timber vehicles) is projected to substantially deteriorate the condition of roadways, a description of improvements that may be required to reduce or impede the deterioration;
