value=\"167\">§ 167.</num><heading> National highway freight program</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide9dc3da2-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/a\"><num value=\"a\">(a)</num><heading> In General.—</heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc3da3-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/a/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Policy</inline>.—</heading><content>It is the policy of the United States to improve the condition and performance of the National Highway Freight Network established under this section to ensure that the Network provides the foundation for the United States to compete in the global economy and achieve the goals described in subsection (b).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc3da4-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/a/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Establishment</inline>.—</heading><content>In support of the goals described in subsection (b), the Administrator of the Federal Highway Administration shall establish a national highway freight program in accordance with this section to improve the efficient movement of freight on the National Highway Freight Network.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide9dc3da5-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Goals</inline>.—</heading><chapeau>The goals of the national highway freight program are—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc3da6-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/b/1\"><num value=\"1\">(1)</num><chapeau> to invest in infrastructure improvements and to implement operational improvements on the highways of the United States that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc3da7-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/b/1/A\"><num value=\"A\">(A)</num><content> strengthen the contribution of the National Highway Freight Network to the economic competitiveness of the United States;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc3da8-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/b/1/B\"><num value=\"B\">(B)</num><content> reduce congestion and bottlenecks on the National Highway Freight Network;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc3da9-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/b/1/C\"><num value=\"C\">(C)</num><content> reduce the cost of freight transportation;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc3daa-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/b/1/D\"><num value=\"D\">(D)</num><content> improve the year-round reliability of freight transportation; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc3dab-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/b/1/E\"><num value=\"E\">(E)</num><content> increase productivity, particularly for domestic industries and businesses that create high-value jobs;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc3dac-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/b/2\"><num value=\"2\">(2)</num><content> to improve the safety, security, efficiency, and resiliency of freight transportation in rural and urban areas;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc3dad-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/b/3\"><num value=\"3\">(3)</num><content> to improve the state of good repair of the National Highway Freight Network;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc3dae-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/b/4\"><num value=\"4\">(4)</num><content> to use innovation and advanced technology to improve the safety, efficiency, and reliability of the National Highway Freight Network;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc3daf-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/b/5\"><num value=\"5\">(5)</num><content> to improve the efficiency and productivity of the National Highway Freight Network;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc3db0-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/b/6\"><num value=\"6\">(6)</num><content> to improve the flexibility of States to support multi-State corridor planning and the creation of multi-State organizations to increase the ability of States to address highway freight connectivity; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc3db1-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/b/7\"><num value=\"7\">(7)</num><content> to reduce the environmental impacts of freight movement on the National Highway Freight Network.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide9dc3db2-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/c\"><num value=\"c\">(c)</num><heading> Establishment of National Highway Freight Network.—</heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc3db3-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/c/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>The Administrator shall establish a National Highway Freight Network in accordance with this section to strategically direct Federal resources and policies toward improved performance of the Network.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc3db4-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/c/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Network components</inline>.—</heading><chapeau>The National Highway Freight Network shall consist of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc3db5-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/c/2/A\"><num value=\"A\">(A)</num><content> the primary highway freight system, as designated under subsection (d);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc3db6-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/c/2/B\"><num value=\"B\">(B)</num><content> critical rural freight corridors established under subsection (e);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc3db7-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/c/2/C\"><num value=\"C\">(C)</num><content> critical urban freight corridors established under subsection (f); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc64c8-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/c/2/D\"><num value=\"D\">(D)</num><content> the portions of the Interstate System not designated as part of the primary highway freight system.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide9dc64c9-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Designation and Redesignation of the Primary Highway Freight System</inline>.—</heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc64ca-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/d/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Initial designation of primary highway freight system</inline>.—</heading><content>The initial designation of the primary highway freight system shall be the 41,518-mile network identified during the designation process for the primary freight network under <ref href=\"/us/usc/t23/s167/d\">section 167(d) of this title</ref>, as in effect on the day before the date of enactment of the FAST Act.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc64cb-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/d/2\"><num value=\"2\">(2)</num><heading> Redesignation of primary highway freight system.—</heading><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc64cc-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/d/2/A\"><num value=\"A\">(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Beginning 5 years after the date of enactment of the FAST Act, and every 5 years thereafter, using the designation factors described in subparagraph (E), the Administrator shall redesignate the primary highway freight system.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc64cd-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/d/2/B\"><num value=\"B\">(B)</num><heading> <inline class=\"small-caps\">Redesignation mileage</inline>.—</heading><content>Each redesignation may increase the mileage on the primary highway freight system by not more than 3 percent of the total mileage of the system.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc64ce-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/d/2/C\"><num value=\"C\">(C)</num><heading> <inline class=\"small-caps\">Use of measurable data</inline>.—</heading><content>In redesignating the primary highway freight system, to the maximum extent practicable, the Administrator shall use measurable data to assess the significance of goods movement, including consideration of points of origin, destinations, and linking components of the United States global and domestic supply chains.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc64cf-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/d/2/D\"><num value=\"D\">(D)</num><heading> <inline class=\"small-caps\">Input</inline>.—</heading><content>In redesignating the primary highway freight system, the Administrator shall provide an opportunity for State freight advisory committees, as applicable, to submit additional miles for consideration.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc64d0-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/d/2/E\"><num value=\"E\">(E)</num><heading> <inline class=\"small-caps\">Factors for redesignation</inline>.—</heading><chapeau>In redesignating the primary highway freight system, the Administrator shall consider—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc64d1-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/d/2/E/i\"><num value=\"i\">(i)</num><content> changes in the origins and destinations of freight movement in, to, and from the United States;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc64d2-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/d/2/E/ii\"><num value=\"ii\">(ii)</num><content> changes in the percentage of annual daily truck traffic in the annual average daily traffic on principal arterials;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc64d3-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/d/2/E/iii\"><num value=\"iii\">(iii)</num><content> changes in the location of key facilities;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc64d4-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/d/2/E/iv\"><num value=\"iv\">(iv)</num><content> land and water ports of entry;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc64d5-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/d/2/E/v\"><num value=\"v\">(v)</num><content> access to energy exploration, development, installation, or production areas;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc64d6-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/d/2/E/vi\"><num value=\"vi\">(vi)</num><content> access to other freight intermodal facilities, including rail, air, water, and pipelines facilities;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc64d7-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/d/2/E/vii\"><num value=\"vii\">(vii)</num><content> the total freight tonnage and value moved via highways;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc64d8-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/d/2/E/viii\"><num value=\"viii\">(viii)</num><content> significant freight bottlenecks, as identified by the Administrator;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc64d9-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/d/2/E/ix\"><num value=\"ix\">(ix)</num><content> the significance of goods movement on principal arterials, including consideration of global and domestic supply chains;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc64da-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/d/2/E/x\"><num value=\"x\">(x)</num><content> critical emerging freight corridors and critical commerce corridors; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc64db-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/d/2/E/xi\"><num value=\"xi\">(xi)</num><content> network connectivity.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide9dc64dc-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/e\"><num value=\"e\">(e)</num><heading> Critical Rural Freight Corridors.—</heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc64dd-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/e/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>A State may designate a public road within the borders of the State as a critical rural freight corridor if the public road is not in an urbanized area and—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc64de-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/e/1/A\"><num value=\"A\">(A)</num><content> is a rural principal arterial roadway and has a minimum of 25 percent of the annual average daily traffic of the road measured in passenger vehicle equivalent units from trucks (Federal Highway Administration vehicle class 8 to 13);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc64df-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/e/1/B\"><num value=\"B\">(B)</num><content> provides access to energy exploration, development, installation, or production areas;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc64e0-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/e/1/C\"><num value=\"C\">(C)</num><chapeau> connects the primary highway freight system, a roadway described in subparagraph (A) or (B), or the Interstate System to facilities that handle more than—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc64e1-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/e/1/C/i\"><num value=\"i\">(i)</num><content> 50,000 20-foot equivalent units per year; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc64e2-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/e/1/C/ii\"><num value=\"ii\">(ii)</num><content> 500,000 tons per year of bulk commodities;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc64e3-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/e/1/D\"><num value=\"D\">(D)</num><chapeau> provides access to—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc64e4-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/e/1/D/i\"><num value=\"i\">(i)</num><content> a grain elevator;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc8bf5-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/e/1/D/ii\"><num value=\"ii\">(ii)</num><content> an agricultural facility;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc8bf6-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/e/1/D/iii\"><num value=\"iii\">(iii)</num><content> a mining facility;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc8bf7-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/e/1/D/iv\"><num value=\"iv\">(iv)</num><content> a forestry facility; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc8bf8-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/e/1/D/v\"><num value=\"v\">(v)</num><content> an intermodal facility;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc8bf9-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/e/1/E\"><num value=\"E\">(E)</num><content> connects to an international port of entry;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc8bfa-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/e/1/F\"><num value=\"F\">(F)</num><content> provides access to significant air, rail, water, or other freight facilities in the State; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc8bfb-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/e/1/G\"><num value=\"G\">(G)</num><content> is, in the determination of the State, vital to improving the efficient movement of freight of importance to the economy of the State.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc8bfc-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/e/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Limitation</inline>.—</heading><content>A State may designate as critical rural freight corridors a maximum of 150 miles of highway or 20 percent of the primary highway freight system mileage in the State, whichever is greater.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide9dc8bfd-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/f\"><num value=\"f\">(f)</num><heading> Critical Urban Freight Corridors.—</heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc8bfe-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/f/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Urbanized area with population of 500,000 or more</inline>.—</heading><content>In an urbanized area with a population of 500,000 or more individuals, the representative metropolitan planning organization, in consultation with the State, may designate a public road within the borders of that area of the State as a critical urban freight corridor.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc8bff-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/f/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Urbanized area with a population less than 500,000</inline>.—</heading><content>In an urbanized area with a population of less than 500,000 individuals, the State, in consultation with the representative metropolitan planning organization, may designate a public road within the borders of that area of the State as a critical urban freight corridor.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc8c00-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/f/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Requirements for designation</inline>.—</heading><chapeau>A designation may be made under paragraph (1) or (2) if the public road—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc8c01-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/f/3/A\"><num value=\"A\">(A)</num><content> is in an urbanized area, regardless of population; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc8c02-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/f/3/B\"><num value=\"B\">(B)</num><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc8c03-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/f/3/B/i\"><num value=\"i\">(i)</num><chapeau> connects an intermodal facility to—</chapeau><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc8c04-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/f/3/B/i/I\"><num value=\"I\">(I)</num><content> the primary highway freight system;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc8c05-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/f/3/B/i/II\"><num value=\"II\">(II)</num><content> the Interstate System; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dc8c06-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/f/3/B/i/III\"><num value=\"III\">(III)</num><content> an intermodal freight facility;</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc8c07-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/f/3/B/ii\"><num value=\"ii\">(ii)</num><content> is located within a corridor of a route on the primary highway freight system and provides an alternative highway option important to goods movement;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc8c08-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/f/3/B/iii\"><num value=\"iii\">(iii)</num><content> serves a major freight generator, logistic center, or manufacturing and warehouse industrial land; or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dc8c09-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/f/3/B/iv\"><num value=\"iv\">(iv)</num><content> is important to the movement of freight within the region, as determined by the metropolitan planning organization or the State.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc8c0a-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/f/4\"><num value=\"4\">(4)</num><heading> <inline class=\"small-caps\">Limitation</inline>.—</heading><content>For each State, a maximum of 75 miles of highway or 10 percent of the primary highway freight system mileage in the State, whichever is greater, may be designated as a critical urban freight corridor under paragraphs (1) and (2).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide9dc8c0b-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/g\"><num value=\"g\">(g)</num><heading> Designation and Certification.—</heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc8c0c-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/g/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Designation</inline>.—</heading><content>States and metropolitan planning organizations may designate corridors under subsections (e) and (f) and submit the designated corridors to the Administrator on a rolling basis.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc8c0d-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/g/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Certification</inline>.—</heading><content>Each State or metropolitan planning organization that designates a corridor under subsection (e) or (f) shall certify to the Administrator that the designated corridor meets the requirements of the applicable subsection.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide9dc8c0e-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/h\"><num value=\"h\">(h)</num><heading> <inline class=\"small-caps\">Highway Freight Transportation Conditions and Performance Reports</inline>.—</heading><content>Not later than 2 years after the date of enactment of the FAST Act, and biennially thereafter, the Administrator shall prepare and submit to Congress a report that describes the conditions and performance of the National Highway Freight Network in the United States.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide9dc8c0f-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i\"><num value=\"i\">(i)</num><heading> Use of Apportioned Funds.—</heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc8c10-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>A State shall obligate funds apportioned to the State under section 104(b)(5) to improve the movement of freight on the National Highway Freight Network.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dc8c11-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Formula</inline>.—</heading><chapeau>The Administrator shall calculate for each State the proportion that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dcb222-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/2/A\"><num value=\"A\">(A)</num><content> the total mileage in the State designated as part of the primary highway freight system; bears to</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dcb223-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/2/B\"><num value=\"B\">(B)</num><content> the total mileage of the primary highway freight system in all States.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dcb224-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/3\"><num value=\"3\">(3)</num><heading> Use of funds.—</heading><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dcb225-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/3/A\"><num value=\"A\">(A)</num><heading> <inline class=\"small-caps\">States with high primary highway freight system mileage</inline>.—</heading><chapeau>If the proportion of a State under paragraph (2) is greater than or equal to 2 percent, the State may obligate funds apportioned to the State under section 104(b)(5) for projects on—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcb226-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/3/A/i\"><num value=\"i\">(i)</num><content> the primary highway freight system;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcb227-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/3/A/ii\"><num value=\"ii\">(ii)</num><content> critical rural freight corridors; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcb228-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/3/A/iii\"><num value=\"iii\">(iii)</num><content> critical urban freight corridors.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dcb229-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/3/B\"><num value=\"B\">(B)</num><heading> <inline class=\"small-caps\">States with low primary highway freight system mileage</inline>.—</heading><content>If the proportion of a State under paragraph (2) is less than 2 percent, the State may obligate funds apportioned to the State under section 104(b)(5) for projects on any component of the National Highway Freight Network.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dcb22a-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/4\"><num value=\"4\">(4)</num><heading> <inline class=\"small-caps\">Freight planning</inline>.—</heading><content>Notwithstanding any other provision of law, effective beginning 2 years after the date of enactment of the FAST Act, a State may not obligate funds apportioned to the State under section 104(b)(5) unless the State has developed a freight plan in accordance with <ref href=\"/us/usc/t49/s70202\">section 70202 of title 49</ref>, except that the multimodal component of the plan may be incomplete before an obligation may be made under this section.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dcb22b-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5\"><num value=\"5\">(5)</num><heading> Eligibility.—</heading><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dcb22c-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/A\"><num value=\"A\">(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>Except as provided in this subsection, for a project to be eligible for funding under this section the project shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcb22d-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/A/i\"><num value=\"i\">(i)</num><content> contribute to the efficient movement of freight on the National Highway Freight Network; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcb22e-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/A/ii\"><num value=\"ii\">(ii)</num><content> be identified in a freight investment plan included in a freight plan of the State that is in effect.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dcb22f-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/B\"><num value=\"B\">(B)</num><heading> <inline class=\"small-caps\">Other projects</inline>.—</heading><chapeau>For each fiscal year, a State may obligate not more than 10 percent of the total apportionment of the State under section 104(b)(5) for freight intermodal or freight rail projects, including projects—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcb230-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/B/i\"><num value=\"i\">(i)</num><content> within the boundaries of public or private freight rail or water facilities (including ports); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcb231-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/B/ii\"><num value=\"ii\">(ii)</num><content> that provide surface transportation infrastructure necessary to facilitate direct intermodal interchange, transfer, and access into or out of the facility.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dcb232-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C\"><num value=\"C\">(C)</num><heading> <inline class=\"small-caps\">Eligible projects</inline>.—</heading><chapeau>Funds apportioned to the State under section 104(b)(5) for the national highway freight program may be obligated to carry out 1 or more of the following:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcb233-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/i\"><num value=\"i\">(i)</num><content> Development phase activities, including planning, feasibility analysis, revenue forecasting, environmental review, preliminary engineering and design work, and other preconstruction activities.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcb234-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/ii\"><num value=\"ii\">(ii)</num><content> Construction, reconstruction, rehabilitation, acquisition of real property (including land relating to the project and improvements to land), construction contingencies, acquisition of equipment, and operational improvements directly relating to improving system performance.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcb235-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/iii\"><num value=\"iii\">(iii)</num><content> Intelligent transportation systems and other technology to improve the flow of freight, including intelligent freight transportation systems.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcb236-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/iv\"><num value=\"iv\">(iv)</num><content> Efforts to reduce the environmental impacts of freight movement.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcb237-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/v\"><num value=\"v\">(v)</num><content> Environmental and community mitigation for freight movement.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcb238-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/vi\"><num value=\"vi\">(vi)</num><content> Railway-highway grade separation.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcb239-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/vii\"><num value=\"vii\">(vii)</num><content> Geometric improvements to interchanges and ramps.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcb23a-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/viii\"><num value=\"viii\">(viii)</num><content> Truck-only lanes.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcb23b-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/ix\"><num value=\"ix\">(ix)</num><content> Climbing and runaway truck lanes.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcb23c-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/x\"><num value=\"x\">(x)</num><content> Adding or widening of shoulders.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcb23d-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/xi\"><num value=\"xi\">(xi)</num><content> Truck parking facilities eligible for funding under section 1401 of MAP–21 (<ref href=\"/us/usc/t23/s137\">23 U.S.C. 137</ref> note).</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcd94e-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/xii\"><num value=\"xii\">(xii)</num><content> Real-time traffic, truck parking, roadway condition, and multimodal transportation information systems.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcd94f-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/xiii\"><num value=\"xiii\">(xiii)</num><content> Electronic screening and credentialing systems for vehicles, including weigh-in-motion truck inspection technologies.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcd950-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/xiv\"><num value=\"xiv\">(xiv)</num><content> Traffic signal optimization, including synchronized and adaptive signals.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcd951-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/xv\"><num value=\"xv\">(xv)</num><content> Work zone management and information systems.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcd952-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/xvi\"><num value=\"xvi\">(xvi)</num><content> Highway ramp metering.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcd953-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/xvii\"><num value=\"xvii\">(xvii)</num><content> Electronic cargo and border security technologies that improve truck freight movement.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcd954-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/xviii\"><num value=\"xviii\">(xviii)</num><content> Intelligent transportation systems that would increase truck freight efficiencies inside the boundaries of intermodal facilities.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcd955-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/xix\"><num value=\"xix\">(xix)</num><content> Additional road capacity to address highway freight bottlenecks.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcd956-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/xx\"><num value=\"xx\">(xx)</num><content> Physical separation of passenger vehicles from commercial motor freight.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcd957-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/xxi\"><num value=\"xxi\">(xxi)</num><content> Enhancement of the resiliency of critical highway infrastructure, including highway infrastructure that supports national energy security, to improve the flow of freight.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcd958-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/xxii\"><num value=\"xxii\">(xxii)</num><content> A highway or bridge project, other than a project described in clauses (i) through (xxi), to improve the flow of freight on the National Highway Freight Network.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcd959-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/5/C/xxiii\"><num value=\"xxiii\">(xxiii)</num><content> Any other surface transportation project to improve the flow of freight into and out of a facility described in subparagraph (B).</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dcd95a-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/6\"><num value=\"6\">(6)</num><heading> <inline class=\"small-caps\">Other eligible costs</inline>.—</heading><chapeau>In addition to the eligible projects identified in paragraph (5), a State may use funds apportioned under section 104(b)(5) for—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dcd95b-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/6/A\"><num value=\"A\">(A)</num><content> carrying out diesel retrofit or alternative fuel projects under section 149 for class 8 vehicles; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dcd95c-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/6/B\"><num value=\"B\">(B)</num><chapeau> the necessary costs of—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcd95d-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/6/B/i\"><num value=\"i\">(i)</num><content> conducting analyses and data collection related to the national highway freight program;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcd95e-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/6/B/ii\"><num value=\"ii\">(ii)</num><content> developing and updating performance targets to carry out this section; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dcd95f-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/6/B/iii\"><num value=\"iii\">(iii)</num><content> reporting to the Administrator to comply with the freight performance target under section 150.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dcd960-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/i/7\"><num value=\"7\">(7)</num><heading> <inline class=\"small-caps\">Applicability of planning requirements</inline>.—</heading><content>Programming and expenditure of funds for projects under this section shall be consistent with the requirements of sections 134 and 135.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide9dcd961-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/j\"><num value=\"j\">(j)</num><heading> <inline class=\"small-caps\">State Performance Targets</inline>.—</heading><chapeau>If the Administrator determines that a State has not met or made significant progress toward meeting the performance targets related to freight movement of the State established under section 150(d) by the date that is 2 years after the date of the establishment of the performance targets, the State shall include in the next report submitted under section 150(e) a description of the actions the State will undertake to achieve the targets, including—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dcd962-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/j/1\"><num value=\"1\">(1)</num><content> an identification of significant freight system trends, needs, and issues within the State;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dcd963-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/j/2\"><num value=\"2\">(2)</num><content> a description of the freight policies and strategies that will guide the freight-related transportation investments of the State;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dcd964-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/j/3\"><num value=\"3\">(3)</num><content> an inventory of freight bottlenecks within the State and a description of the ways in which the State is allocating national highway freight program funds to improve those bottlenecks; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dcd965-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/j/4\"><num value=\"4\">(4)</num><content> a description of the actions the State will undertake to meet the performance targets of the State.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide9dcd966-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/k\"><num value=\"k\">(k)</num><heading> Intelligent Freight Transportation System.—</heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dcd967-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/k/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Definition of intelligent freight transportation system</inline>.—</heading><chapeau>In this section, the term “intelligent freight transportation system” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dd0078-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/k/1/A\"><num value=\"A\">(A)</num><chapeau> innovative or intelligent technological transportation systems, infrastructure, or facilities, including elevated freight transportation facilities—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dd0079-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/k/1/A/i\"><num value=\"i\">(i)</num><content> in proximity to, or within, an existing right of way on a Federal-aid highway; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide9dd007a-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/k/1/A/ii\"><num value=\"ii\">(ii)</num><content> that connect land ports-of entry <ref class=\"footnoteRef\" idref=\"fn002021\">1</ref><note type=\"footnote\" id=\"fn002021\"><num>1</num> So in original.</note> to existing Federal-aid highways; or</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide9dd007b-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/k/1/B\"><num value=\"B\">(B)</num><content> communications or information processing systems that improve the efficiency, security, or safety of freight movements on the Federal-aid highway system, including to improve the conveyance of freight on dedicated intelligent freight lanes.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide9dd007c-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/k/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Operating standards</inline>.—</heading><content>The Administrator shall determine whether there is a need for establishing operating standards for intelligent freight transportation systems.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide9dd007d-590a-11e8-9240-ee73f6b1e948\" identifier=\"/us/usc/t23/s167/l\"><num value=\"l\">(l)</num><heading> <inline class=\"small-caps\">Treatment of Freight Projects</inline>.—</heading><content>Notwithstanding any other provision of law, a freight project carried out under
