<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idb503cdcb-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201"><num value="201">§ 201.</num><heading> Federal lands and tribal transportation programs</heading><subsection style="-uslm-lc:I11" class="indent0" id="idb503cdcc-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/a"><num value="a">(a)</num><heading> <inline class="small-caps">Purpose</inline>.—</heading><content>Recognizing the need for all public Federal and tribal transportation facilities to be treated under uniform policies similar to the policies that apply to Federal-aid highways and other public transportation facilities, the Secretary of Transportation, in collaboration with the Secretaries of the appropriate Federal land management agencies, shall coordinate a uniform policy for all public Federal and tribal transportation facilities that shall apply to Federal lands transportation facilities, tribal transportation facilities, and Federal lands access transportation facilities.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idb503cdcd-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b"><num value="b">(b)</num><heading> <inline class="small-caps">Availability of Funds</inline>.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="idb503cdce-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">Availability</inline>.—</heading><content>Funds authorized for the tribal transportation program, the Federal lands transportation program, and the Federal lands access program shall be available for contract upon apportionment, or on October 1 of the fiscal year for which the funds were authorized if no apportionment is required.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb503cdcf-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">Amount remaining</inline>.—</heading><content>Any amount remaining unexpended for a period of 3 years after the close of the fiscal year for which the funds were authorized shall lapse.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb503cdd0-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b/3"><num value="3">(3)</num><heading> <inline class="small-caps">Obligations</inline>.—</heading><content>The Secretary of the department responsible for the administration of funds under this subsection may incur obligations, approve projects, and enter into contracts under such authorizations, which shall be considered to be contractual obligations of the United States for the payment of the cost thereof, the funds of which shall be considered to have been expended when obligated.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb503cdd1-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b/4"><num value="4">(4)</num><heading> <inline class="small-caps">Expenditure</inline>.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="idb503cdd2-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b/4/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Any funds authorized for any fiscal year after the date of enactment of this section under the Federal lands transportation program, the Federal lands access program, and the tribal transportation program shall be considered to have been expended if a sum equal to the total of the sums authorized for the fiscal year and previous fiscal years have been obligated.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idb503cdd3-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b/4/B"><num value="B">(B)</num><heading> <inline class="small-caps">Credited funds</inline>.—</heading><chapeau>Any funds described in subparagraph (A) that are released by payment of final voucher or modification of project authorizations shall be—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idb503cdd4-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b/4/B/i"><num value="i">(i)</num><content> credited to the balance of unobligated authorizations; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idb503cdd5-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b/4/B/ii"><num value="ii">(ii)</num><content> immediately available for expenditure.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb503cdd6-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b/5"><num value="5">(5)</num><heading> <inline class="small-caps">Applicability</inline>.—</heading><content>This section shall not apply to funds authorized before the date of enactment of this paragraph.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb503cdd7-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b/6"><num value="6">(6)</num><heading> <inline class="small-caps">Contractual obligation</inline>.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="idb503cdd8-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b/6/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Notwithstanding any other provision of law (including regulations), the authorization by the Secretary, or the Secretary of the appropriate Federal land management agency if the agency is the contracting office, of engineering and related work for the development, design, and acquisition associated with a construction project, whether performed by contract or agreement authorized by law, or the approval by the Secretary of plans, specifications, and estimates for construction of a project, shall be considered to constitute a contractual obligation of the Federal Government to pay the total eligible cost of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idb503cdd9-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b/6/A/i"><num value="i">(i)</num><content> any project funded under this title; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idb503cdda-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b/6/A/ii"><num value="ii">(ii)</num><content> any project funded pursuant to agreements authorized by this title or any other title.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idb503cddb-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b/6/B"><num value="B">(B)</num><heading> <inline class="small-caps">Effect</inline>.—</heading><chapeau>Nothing in this paragraph—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idb503cddc-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b/6/B/i"><num value="i">(i)</num><content> affects the application of the Federal share associated with the project being undertaken under this section; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idb503cddd-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b/6/B/ii"><num value="ii">(ii)</num><content> modifies the point of obligation associated with Federal salaries and expenses.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb503cdde-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b/7"><num value="7">(7)</num><heading> <inline class="small-caps">Federal share</inline>.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="idb503cddf-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b/7/A"><num value="A">(A)</num><heading> <inline class="small-caps">Tribal and federal lands transportation program</inline>.—</heading><content>The Federal share of the cost of a project carried out under the Federal lands transportation program or the tribal transportation program shall be 100 percent.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idb503cde0-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/b/7/B"><num value="B">(B)</num><heading> <inline class="small-caps">Federal lands access program</inline>.—</heading><content>The Federal share of the cost of a project carried out under the Federal lands access program shall be determined in accordance with section 120.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idb503cde1-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c"><num value="c">(c)</num><heading> <inline class="small-caps">Transportation Planning</inline>.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="idb503cde2-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">Transportation planning procedures</inline>.—</heading><content>In consultation with the Secretary of each appropriate Federal land management agency, the Secretary shall implement transportation planning procedures for Federal lands and tribal transportation facilities that are consistent with the planning processes required under sections 134 and 135.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb503cde3-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">Approval of transportation improvement program</inline>.—</heading><content>The transportation improvement program developed as a part of the transportation planning process under this section shall be approved by the Secretary.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb503cde4-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/3"><num value="3">(3)</num><heading> <inline class="small-caps">Inclusion in other plans</inline>.—</heading><chapeau>Each regionally significant tribal transportation program, Federal lands transportation program, and Federal lands access program project shall be—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idb503cde5-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/3/A"><num value="A">(A)</num><content> developed in cooperation with State and metropolitan planning organizations; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idb503cde6-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/3/B"><num value="B">(B)</num><content> included in appropriate tribal transportation program plans, Federal lands transportation program plans, Federal lands access program plans, State and metropolitan plans, and transportation improvement programs.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb503cde7-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/4"><num value="4">(4)</num><heading> <inline class="small-caps">Inclusion in state programs</inline>.—</heading><content>The approved tribal transportation program, Federal lands transportation program, and Federal lands access program transportation improvement programs shall be included in appropriate State and metropolitan planning organization plans and programs without further action on the transportation improvement program.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb503cde8-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/5"><num value="5">(5)</num><heading> <inline class="small-caps">Asset management</inline>.—</heading><content>The Secretary and the Secretary of each appropriate Federal land management agency shall, to the extent appropriate, implement safety, bridge, pavement, and congestion management systems for facilities funded under the tribal transportation program and the Federal lands transportation program in support of asset management.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb503cde9-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/6"><num value="6">(6)</num><heading> <inline class="small-caps">Data collection</inline>.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="idb503cdea-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/6/A"><num value="A">(A)</num><heading> <inline class="small-caps">Data collection</inline>.—</heading><clause style="-uslm-lc:I14" class="indent3" id="idb503cdeb-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/6/A/i"><num value="i">(i)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Secretaries of the appropriate Federal land management agencies shall collect and report data necessary to implement the Federal lands transportation program, the Federal lands access program, and the tribal transportation program.</content>

<clause style="-uslm-lc:I14" class="indent3" id="idb503cded-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/6/A/iii"><num value="iii">(iii)</num><heading> <inline class="small-caps">Inclusions</inline>.—</heading><chapeau>Data collected under this paragraph includes—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idb503cdee-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/6/A/iii/I"><num value="I">(I)</num><content> inventory and condition information on Federal lands transportation facilities and tribal transportation facilities; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idb503cdef-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/6/A/iii/II"><num value="II">(II)</num><content> bridge inspection and inventory information on any Federal bridge open to the public.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idb503cdf0-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/6/B"><num value="B">(B)</num><heading> <inline class="small-caps">Standards</inline>.—</heading><content>The Secretary, in coordination with the Secretaries of the appropriate Federal land management agencies, shall define the collection and reporting data standards.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idb503cdf1-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/6/C"><num value="C">(C)</num><heading> <inline class="small-caps">Tribal data collection</inline>.—</heading><chapeau>In addition to the data to be collected under subparagraph (A), not later than 90 days after the last day of each fiscal year, any entity carrying out a project under the tribal transportation program under section 202 shall submit to the Secretary and the Secretary of the Interior, based on obligations and expenditures under the tribal transportation program during the preceding fiscal year, the following data:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idb503cdf2-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/6/C/i"><num value="i">(i)</num><content> The names of projects and activities carried out by the entity under the tribal transportation program during the preceding fiscal year.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idb503cdf3-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/6/C/ii"><num value="ii">(ii)</num><content> A description of the projects and activities identified under clause (i).</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idb503cdf4-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/6/C/iii"><num value="iii">(iii)</num><content> The current status of the projects and activities identified under clause (i).</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idb503cdf5-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/6/C/iv"><num value="iv">(iv)</num><content> An estimate of the number of jobs created and the number of jobs retained by the projects and activities identified under clause (i).</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb503cdf6-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/7"><num value="7">(7)</num><heading> <inline class="small-caps">Cooperative research and technology deployment</inline>.—</heading><content>The Secretary may conduct cooperative research and technology deployment in coordination with Federal land management agencies, as determined appropriate by the Secretary.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb503cdf7-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/8"><num value="8">(8)</num><heading> Funding.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="idb503cdf8-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/8/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>To carry out the activities described in this subsection for Federal lands transportation facilities, Federal lands access transportation facilities, and other federally owned roads open to public travel (as that term is defined in section 125(e)), the Secretary shall for each fiscal year combine and use not greater than 5 percent of the funds authorized for programs under sections 203 and 204.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idb503cdf9-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/8/B"><num value="B">(B)</num><heading> <inline class="small-caps">Other activities</inline>.—</heading><chapeau>In addition to the activities described in subparagraph (A), funds described under that subparagraph may be used for—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idb503cdfa-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/8/B/i"><num value="i">(i)</num><content> bridge inspections on any federally owned bridge even if that bridge is not included on the inventory described under section 203; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idb503cdfb-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/c/8/B/ii"><num value="ii">(ii)</num><content> transportation planning activities carried out by Federal land management agencies eligible for funding under this chapter.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idb503cdfc-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/d"><num value="d">(d)</num><heading> <inline class="small-caps">Reimbursable Agreements</inline>.—</heading><chapeau>In carrying out work under reimbursable agreements with any State, local, or tribal government under this title, the Secretary—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idb503cdfd-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/d/1"><num value="1">(1)</num><content> may, without regard to any other provision of law (including regulations), record obligations against accounts receivable from the entity; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb503cdfe-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/d/2"><num value="2">(2)</num><content> shall credit amounts received from the entity to the appropriate account, which shall occur not later than 90 days after the date of the original request by the Secretary for payment.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idb503cdff-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/e"><num value="e">(e)</num><heading> <inline class="small-caps">Transfers</inline>.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="idb503ce00-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/e/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>To enable the efficient use of funds made available for the Federal lands transportation program and the Federal lands access program, the funds may be transferred by the Secretary within and between each program with the concurrence of, as appropriate—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idb503ce01-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/e/1/A"><num value="A">(A)</num><content> the Secretary;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idb503ce02-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/e/1/B"><num value="B">(B)</num><content> the affected Secretaries of the respective Federal land management agencies;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idb503ce03-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/e/1/C"><num value="C">(C)</num><content> State departments of transportation; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idb503ce04-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/e/1/D"><num value="D">(D)</num><content> local government agencies.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb503ce05-9221-11e6-b3a7-c114e35e6813" identifier="/us/usc/t23/s201/e/2"><num value="2">(2)</num><heading> <inline class="small-caps">Credit</inline>.—</heading><content>The funds described in paragraph (1) shall be credited back to the loaning entity with funds that are currently available for obligation at the time of the credit.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">Purpose</inline>.—</heading><content>The Secretary [of Transportation] shall establish a nationally significant Federal lands and tribal projects program (referred to in this section as the ‘program’) to provide funding to construct, reconstruct, or rehabilitate nationally significant Federal lands and tribal transportation projects.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> Eligible Applicants.—</heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Except as provided in paragraph (2), entities eligible to receive funds under sections 201, 202, 203, and 204 of title 23, United States Code, may apply for funding under the program.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Special rule</inline>.—</heading><content>A State, county, or unit of local government may only apply for funding under the program if sponsored by an eligible Federal land management agency or Indian tribe.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Eligible Projects</inline>.—</heading><chapeau>An eligible project under the program shall be a single continuous project—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> on a Federal lands transportation facility, a Federal lands access transportation facility, or a tribal transportation facility (as those terms are defined in <ref href="/us/usc/t23/s101">section 101 of title 23</ref>, United States Code), except that such facility is not required to be included in an inventory described in section 202 or 203 of such title;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><chapeau> for which completion of activities required under the National Environmental Policy Act of 1969 (<ref href="/us/usc/t42/s4321">42 U.S.C. 4321</ref> et seq.) has been demonstrated through—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> a record of decision with respect to the project;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> a finding that the project has no significant impact; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> a determination that the project is categorically excluded; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> having an estimated cost, based on the results of preliminary engineering, equal to or exceeding $25,000,000, with priority consideration given to projects with an estimated cost equal to or exceeding $50,000,000.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> Eligible Activities.—</heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Subject to paragraph (2), an eligible applicant receiving funds under the program may only use the funds for construction, reconstruction, and rehabilitation activities.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Ineligible activities</inline>.—</heading><content>An eligible applicant may not use funds received under the program for activities relating to project design.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Applications</inline>.—</heading><content>Eligible applicants shall submit to the Secretary [of Transportation] an application at such time, in such form, and containing such information as the Secretary may require.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><heading> <inline class="small-caps">Selection Criteria</inline>.—</heading><chapeau>In selecting a project to receive funds under the program, the Secretary shall consider the extent to which the project—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> furthers the goals of the Department, including state of good repair, economic competitiveness, quality of life, and safety;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> improves the condition of critical transportation facilities, including multimodal facilities;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> needs construction, reconstruction, or rehabilitation;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> has costs matched by funds that are not provided under this section, with projects with a greater percentage of other sources of matching funds ranked ahead of lesser matches;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> is included in or eligible for inclusion in the National Register of Historic Places;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><content> uses new technologies and innovations that enhance the efficiency of the project;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="7">“(7)</num><content> is supported by funds, other than the funds received under the program, to construct, maintain, and operate the facility;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="8">“(8)</num><content> spans 2 or more States; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="9">“(9)</num><content> serves land owned by multiple Federal agencies or Indian tribes.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="g">“(g)</num><heading> Federal Share.—</heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Federal share of the cost of a project shall be up to 90 percent.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Non-federal share</inline>.—</heading><content>Notwithstanding any other provision of law, any Federal funds other than those made available under title 23 or title 49, United States Code, may be used to pay the non-Federal share of the cost of a project carried out under this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="h">“(h)</num><heading> <inline class="small-caps">Authorization of Appropriations</inline>.—</heading><content>There is authorized to be appropriated to carry out this section $100,000,000 for each of fiscal years 2016 through 2020. Such sums shall remain available for a period of 3 fiscal years following the fiscal year for which the amounts are appropriated.”</content>
