<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idc1aa3811-ec38-11e5-86c3-d68ad8aafe28" identifier="/us/usc/t25/s1918"><num value="1918">§ 1918.</num><heading> Reassumption of jurisdiction over child cus­tody proceedings</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc1aa3812-ec38-11e5-86c3-d68ad8aafe28" identifier="/us/usc/t25/s1918/a"><num value="a" class="bold">(a)</num><heading class="bold"> Petition; suitable plan; approval by Secretary</heading><content><p style="-uslm-lc:I11" class="indent0">Any Indian tribe which became subject to State jurisdiction pursuant to the provisions of the Act of <date date="1953-08-15">August 15, 1953</date> (<ref href="/us/stat/67/588">67 Stat. 588</ref>), as amended by title IV of the Act of <date date="1968-04-11">April 11, 1968</date> (<ref href="/us/stat/82/73">82 Stat. 73</ref>, 78), or pursuant to any other Federal law, may reassume jurisdiction over child custody proceedings. Before any Indian tribe may reassume jurisdiction over Indian child custody proceedings, such tribe shall present to the Secretary for approval a petition to reassume such jurisdiction which includes a suitable plan to exercise such jurisdiction.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc1aa3813-ec38-11e5-86c3-d68ad8aafe28" identifier="/us/usc/t25/s1918/b"><num value="b" class="bold">(b)</num><heading class="bold"> Criteria applicable to consideration by Secretary; partial retrocession</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idc1aa3814-ec38-11e5-86c3-d68ad8aafe28" identifier="/us/usc/t25/s1918/b/1"><num value="1">(1)</num><chapeau> In considering the petition and feasibility of the plan of a tribe under subsection (a), the Secretary may consider, among other things:</chapeau><clause style="-uslm-lc:I12" class="indent1" id="idc1aa3815-ec38-11e5-86c3-d68ad8aafe28" identifier="/us/usc/t25/s1918/b/1/i"><num value="i">(i)</num><content> whether or not the tribe maintains a membership roll or alternative provision for clearly identifying the persons who will be affected by the reassumption of jurisdiction by the tribe;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idc1aa3816-ec38-11e5-86c3-d68ad8aafe28" identifier="/us/usc/t25/s1918/b/1/ii"><num value="ii">(ii)</num><content> the size of the reservation or former reservation area which will be affected by retrocession and reassumption of jurisdiction by the tribe;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idc1aa3817-ec38-11e5-86c3-d68ad8aafe28" identifier="/us/usc/t25/s1918/b/1/iii"><num value="iii">(iii)</num><content> the population base of the tribe, or distribution of the population in homogeneous communities or geographic areas; and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idc1aa3818-ec38-11e5-86c3-d68ad8aafe28" identifier="/us/usc/t25/s1918/b/1/iv"><num value="iv">(iv)</num><content> the feasibility of the plan in cases of multitribal occupation of a single reservation or geographic area.</content>

<paragraph style="-uslm-lc:I11" class="indent0" id="idc1aa3819-ec38-11e5-86c3-d68ad8aafe28" identifier="/us/usc/t25/s1918/b/2"><num value="2">(2)</num><content> In those cases where the Secretary determines that the jurisdictional provisions of <ref href="/us/usc/t25/s1911/a">section 1911(a) of this title</ref> are not feasible, he is authorized to accept partial retrocession which will enable tribes to exercise referral jurisdiction as provided in <ref href="/us/usc/t25/s1911/b">section 1911(b) of this title</ref>, or, where appropriate, will allow them to exercise exclusive jurisdiction as provided in <ref href="/us/usc/t25/s1911/a">section 1911(a) of this title</ref> over limited community or geographic areas without regard for the reservation status of the area affected.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc1aa381a-ec38-11e5-86c3-d68ad8aafe28" identifier="/us/usc/t25/s1918/c"><num value="c" class="bold">(c)</num><heading class="bold"> Approval of petition; publication in Federal Register; notice; reassumption period; correction of causes for disapproval</heading><content><p style="-uslm-lc:I11" class="indent0">If the Secretary approves any petition under subsection (a), the Secretary shall publish notice of such approval in the Federal Register and shall notify the affected State or States of such approval. The Indian tribe concerned shall reassume jurisdiction sixty days after publication in the Federal Register of notice of approval. If the Secretary disapproves any petition under subsection (a), the Secretary shall provide such technical assistance as may be necessary to enable the tribe to correct any deficiency which the Secretary identified as a cause for disapproval.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc1aa381b-ec38-11e5-86c3-d68ad8aafe28" identifier="/us/usc/t25/s1918/d"><num value="d" class="bold">(d)</num><heading class="bold"> Pending actions or proceedings unaffected</heading><content><p style="-uslm-lc:I11" class="indent0">Assumption of jurisdiction under this section shall not affect any action or proceeding over which a court has already assumed jurisdiction, except as may be provided pursuant to any agreement under <ref href="/us/usc/t25/s1919">section 1919 of this title</ref>.</p>
