It is the policy of the United States to fulfill the Federal Government’s unique and continuing trust relationship with and responsibility to the Indian people for the education of Indian children and for the operation and financial support of the Bureau of Indian Affairs-funded school system to work in full cooperation with tribes toward the goal of ensuring that the programs of the Bureau of Indian Affairs-funded school system are of the highest quality and provide for the basic elementary and secondary educational needs of Indian children, including meeting the unique educational and cultural needs of those children.</p>\n</content><sourceCredit id=\"idc1aa3865-ec38-11e5-86c3-d68ad8aafe28\">(<ref href=\"/us/pl/95/561/tXI\">Pub. L. 112–74, div. E, title I</ref>, § 115, <date date=\"2011-12-23\">Dec. 23, 2011</date>, <ref href=\"/us/stat/125/1009\">125 Stat. 1009</ref>, as amended by <ref href=\"/us/pl/113/235/dF/tI\">Pub. L. 113–235, div. F, title I</ref>, § 116, <date date=\"2014-12-16\">Dec. 16, 2014</date>, <ref href=\"/us/stat/128/2421\">128 Stat. 2421</ref>; <ref href=\"/us/pl/114/113/dG/tI\">Pub. L. 114–113, div. G, title I</ref>, § 113, <date date=\"2015-12-18\">Dec. 18, 2015</date>, <ref href=\"/us/stat/129/2550\">129 Stat. 2550</ref>, provided that:<quotedContent origin=\"/us/pl/114/113/dG/tI\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"1\">(1)</num><content> Notwithstanding any other provision of law or Federal regulation, including <ref href=\"/us/usc/t40/s586/c\">section 586(c) of title 40</ref>, United States Code, the Director of the BIE [Bureau of Indian Education], or the Director’s designee, is authorized to enter into agreements with public and private persons and entities that provide for such persons and entities to rent or lease the land or facilities of a Bureau-operated school for such periods of time as the school is Bureau operated, in exchange for a consideration (in the form of funds) that benefits the school, as determined by the head of the school.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"2\">“(2)</num><content> Funds received under paragraph (1) shall be retained by the school and used for school purposes otherwise authorized by law. Any funds received under paragraph (1) are hereby made available until expended for such purposes, notwithstanding <ref href=\"/us/usc/t31/s3302\">section 3302 of title 31</ref>, United States Code.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"3\">“(3)</num><content> Nothing in this section shall be construed to allow for the diminishment of, or otherwise affect, the appropriation of funds to the budget accounts for the operation and maintenance of Bureau-operated schools. No funds shall be withheld from the distribution to the budget of any Bureau-operated school due to the receipt by the school of a benefit in accordance with this section.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><content> Notwithstanding any provision of title 5, United States Code, or any regulation promulgated under such title, education personnel who are under the direction and supervision of the Secretary of the Interior may participate in a fundraising activity for the benefit of a Bureau-operated school in an official capacity as part of their official duties. When participating in such an official capacity, the employee may use the employee’s official title, position, and authority. Nothing in this subsection shall be construed to authorize participation in political activity (as such term is used in <ref href=\"/us/usc/t5/s7324\">section 7324 of title 5</ref>, United States Code) otherwise prohibited by law.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><chapeau> The Secretary of the Interior shall promulgate regulations to carry out this section not later than 16 months after the date of the enactment of this Act [<date date=\"2011-12-23\">Dec. 23, 2011</date>]. Such regulations shall include—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> standards for the appropriate use of Bureau-operated school lands and facilities by third parties under a rental or lease agreement;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> provisions for the establishment and administration of mechanisms for the acceptance of consideration for the use and benefit of a school in accordance with this section (including, in appropriate cases, the establishment and administration of trust funds);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> accountability standards to ensure ethical conduct; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> provisions for monitoring the amount and terms of consideration received, the manner in which the consideration is used, and any results achieved by such use.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><content> Provisions of this section shall apply to fiscal years 2012 through 2027.”</content>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idc1aa386d-ec38-11e5-86c3-d68ad8aafe28\"><heading class=\"centered smallCaps\">Therapeutic Model Demonstration Schools</heading><p><ref href=\"/us/pl/103/382/tV\">Pub. L. 103–382, title V</ref>, § 566, <date date=\"1994-10-20\">Oct. 20, 1994</date>, <ref href=\"/us/stat/108/4059\">108 Stat. 4059</ref>, provided that:<quotedContent origin=\"/us/pl/103/382/tV\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> Authorization.—</heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>The Secretary of the Interior, acting through the Bureau of Indian Affairs, is authorized to establish demonstration schools, based on the therapeutic model described in this section, to provide services necessary to achieve positive changes in the attitudes, behavior, and academic performance of Indian youth attending off-reservation boarding schools.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Purpose</inline>.—</heading><chapeau>The purpose of the therapeutic model demonstration schools is—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> to provide a program, based on an annual written plan, linking clinicians, counselors, and mental health professionals with academic program personnel in a culturally sensitive residential program tailored to the particular needs of Indian students;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> to provide for a continued evaluation of the planning and implementation of the therapeutic model in the designated schools; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> to determine what steps the Bureau of Indian Affairs must take and what resources are required to transform existing off-reservation boarding schools to meet the needs of chemically dependent, emotionally disturbed, socially troubled, or other at-risk Indian youth who attend such schools.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Location</inline>.—</heading><chapeau>The Secretary shall initiate the therapeutic model at two schools during school years 1994 through 1996, and shall give priority to—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> one school that is the recipient of a grant under section 5204 of the August [Augustus] F. Hawkins-Robert T. Stafford Elementary and Secondary School Improvement Amendments of 1988 [<ref href=\"/us/usc/t25/s2503\">25 U.S.C. 2503</ref>] during the 1994–1995 school year; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> one school operated by the Bureau of Indian Affairs during the 1995–1996 school year.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Services</inline>.—</heading><chapeau>The demonstration schools shall provide an integrated residential environment that may include—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> mental health services;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> education;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> recreation therapy;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> social service programs;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> substance abuse education and prevention; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"6\">“(6)</num><content> other support services for aftercare.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Staffing</inline>.—</heading><chapeau>The demonstration schools shall be staffed with health and social service professionals, and educators, and may include—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> clinical psychologists;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> child psychologists;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> substance abuse counselors;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> social workers; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> health educators.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"e\">“(e)</num><heading> <inline class=\"small-caps\">Enrollment</inline>.—</heading><content>Notwithstanding any other provision of law, the Secretary of the Interior may limit the enrollment at the demonstration schools.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"f\">“(f)</num><heading> <inline class=\"small-caps\">Assistance</inline>.—</heading><content>The Secretary is authorized to enter into agreements with other organizations and agencies, including the Indian Health Service, to carry out this section.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"g\">“(g)</num><heading> <inline class=\"small-caps\">Report</inline>.—</heading><content>Not later than July 31 of each year, the Secretary of the Interior shall submit a report to the Committee on Indian Affairs of the Senate and the Committee on Education and Labor [now Committee on Education and the Workforce] of the House of Representatives on the progress of the Department of the Interior in the development of the demonstration schools.”</content>\n</subsection>\n</quotedContent>\n</p>\n</note>\n</notes>\n</section>","provision":null,"duplicates":[],"release":{"label":"115-8","currency_date":"2017-02-28","congress":115,"law_num":8,"excluded_laws":[],"update_num":null,"seq":92,"is_partial":false,"caveat":null,"titles_affected":["05","10","25","31","42","51"],"ingested_titles":[]},"served_from":{"label":"115-8","currency_date":"2017-02-28","congress":115,"law_num":8,"excluded_laws":[],"update_num":null,"seq":92,"is_partial":false,"caveat":null,"titles_affected":["05","10","25","31","42","51"],"ingested_titles":[]},"content_first_seen":{"label":"114-115","currency_date":"2015-12-28","congress":114,"law_num":115,"excluded_laws":[],"update_num":null,"seq":62,"is_partial":false,"caveat":null,"titles_affected":["02","07","08","10","15","20","21","23","25","26","29","31","40","42","47","49","50"],"ingested_titles":[]},"is_exact":true,"note":null}
