<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idfd5ea03a-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007"><num value="2007">§ 2007.</num><heading> Allotment formula</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idfd5ea03b-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a"><num value="a" class="bold">(a)</num><heading class="bold"> Factors considered; revision to reflect standards</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idfd5ea03c-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Formula</heading><chapeau>The Secretary shall establish, by regulation adopted in accordance with <ref href="/us/usc/t25/s2017">section 2017 of this title</ref>, a formula for determining the minimum annual amount of funds necessary to sustain each Bureau-funded school. In establishing such formula, the Secretary shall consider—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idfd5ea03d-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a/1/A"><num value="A">(A)</num><content> the number of eligible Indian students served and total student population of the school;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idfd5ea03e-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a/1/B"><num value="B">(B)</num><chapeau> special cost factors, such as—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idfd5ea03f-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a/1/B/i"><num value="i">(i)</num><content> the isolation of the school;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idfd5ea040-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a/1/B/ii"><num value="ii">(ii)</num><content> the need for special staffing, transportation, or educational programs;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idfd5ea041-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a/1/B/iii"><num value="iii">(iii)</num><content> food and housing costs;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idfd5ea042-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a/1/B/iv"><num value="iv">(iv)</num><content> maintenance and repair costs associated with the physical condition of the educational facilities;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idfd5ea043-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a/1/B/v"><num value="v">(v)</num><content> special transportation and other costs of isolated and small schools;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idfd5ea044-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a/1/B/vi"><num value="vi">(vi)</num><content> the costs of home-living (dormitory) arrangements, where determined necessary by a tribal governing body or designated school board;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idfd5ea045-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a/1/B/vii"><num value="vii">(vii)</num><content> costs associated with greater lengths of service by education personnel;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idfd5ea046-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a/1/B/viii"><num value="viii">(viii)</num><content> the costs of therapeutic programs for students requiring such programs; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idfd5ea047-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a/1/B/ix"><num value="ix">(ix)</num><content> special costs for gifted and talented students;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idfd5ea048-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a/1/C"><num value="C">(C)</num><content> the cost of providing academic services which are at least equivalent to those provided by public schools in the State in which the school is located;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idfd5ea049-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a/1/D"><num value="D">(D)</num><content> whether the available funding will enable the school involved to comply with the accreditation standards applicable to the school under <ref href="/us/usc/t25/s2001">section 2001 of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idfd5ea04a-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a/1/E"><num value="E">(E)</num><content> such other relevant factors as the Secretary determines are appropriate.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idfd5ea04b-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Revision of formula</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idfd5ea04c-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Upon the establishment of the standards required in <ref href="/us/usc/t25/s2002">section 2002 of this title</ref>, the Secretary shall revise the formula established under this subsection to reflect the cost of funding such standards.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idfd5ea04d-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Review of formula</heading><content><p style="-uslm-lc:I13" class="indent2">Not later than <date date="2003-01-01">January 1, 2003</date>, the Secretary shall review the formula established under this section and shall take such steps as are necessary to increase the availability of counseling and therapeutic programs for students in off-reservation home-living (dormitory) schools and other Bureau-operated residential facilities.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idfd5ea04e-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/a/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Review of standards</heading><content><p style="-uslm-lc:I13" class="indent2">Concurrent with such action, the Secretary shall review the standards established under <ref href="/us/usc/t25/s2002">section 2002 of this title</ref> to be certain that adequate provision is made for parental notification regarding, and consent for, such counseling and therapeutic programs.</p>
</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idfd5ea04f-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/b"><num value="b" class="bold">(b)</num><heading class="bold"> Pro rata allotment</heading><content><p style="-uslm-lc:I11" class="indent0">Notwithstanding any other provision of law, Federal funds appropriated for the general local operation of Bureau-funded schools shall be allotted pro rata in accordance with the formula established under subsection (a).</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idfd5ea050-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c"><num value="c" class="bold">(c)</num><heading class="bold"> Annual adjustment; reservation of amount for school board activities</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idfd5ea051-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Annual adjustment</heading><chapeau>For fiscal year 2003, and for each subsequent fiscal year, the Secretary shall adjust the formula established under subsection (a) to ensure that the formula does the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idfd5ea052-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/1/A"><num value="A">(A)</num><content> Uses a weighted unit of 1.2 for each eligible Indian student enrolled in the seventh and eighth grades of the school in considering the number of eligible Indian students served by the school.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idfd5ea053-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/1/B"><num value="B">(B)</num><content> Considers a school with an enrollment of less than 50 eligible Indian students as having an average daily attendance of 50 eligible Indian students for purposes of implementing the adjustment factor for small schools.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idfd5ea054-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/1/C"><num value="C">(C)</num><content> Takes into account the provision of residential services on less than a 9-month basis at a school when the school board and supervisor of the school determine that a less than 9-month basis will be implemented for the school year involved.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idfd5ea055-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/1/D"><num value="D">(D)</num><chapeau> Uses a weighted unit of 2.0 for each eligible Indian student that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idfd5ea056-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/1/D/i"><num value="i">(i)</num><content> is gifted and talented; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idfd5ea057-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/1/D/ii"><num value="ii">(ii)</num><content> is enrolled in the school on a full-time basis,</content>
</clause>

<continuation style="-uslm-lc:I32" class="indent2 firstIndent0">in considering the number of eligible Indian students served by the school.</continuation>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idfd5ea058-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/1/E"><num value="E">(E)</num><chapeau> Uses a weighted unit of 0.25 for each eligible Indian student who is enrolled in a year-long credit course in an Indian or Native language as part of the regular curriculum of a school, in considering the number of eligible Indian students served by such school. The adjustment required under this subparagraph shall be used for such school after—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idfd5ea059-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/1/E/i"><num value="i">(i)</num><content> the certification of the Indian or Native language curriculum by the school board of such school to the Secretary, together with an estimate of the number of full-time students expected to be enrolled in the curriculum in the second school year for which the certification is made; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idfd5ea05a-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/1/E/ii"><num value="ii">(ii)</num><content> the funds appropriated for allotment under this section are designated by the appropriations Act appropriating such funds as the amount necessary to implement such adjustment at such school without reducing allotments made under this section to any school by virtue of such adjustment.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idfd5ea05b-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Reservation of amount</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idfd5ea05c-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>From the funds allotted in accordance with the formula established under subsection (a) for each Bureau school, the local school board of such school may reserve an amount which does not exceed the greater of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idfd5ea05d-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/2/A/i"><num value="i">(i)</num><content> $8,000; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idfd5ea05e-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/2/A/ii"><num value="ii">(ii)</num><chapeau> the lesser of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idfd5ea05f-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/2/A/ii/I"><num value="I">(I)</num><content> $15,000; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idfd5ea060-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/2/A/ii/II"><num value="II">(II)</num><content> 1 percent of such allotted funds,</content>
</subclause>
</clause>

<continuation style="-uslm-lc:I32" class="indent2 firstIndent0">for school board activities for such school, including (notwithstanding any other provision of law) meeting expenses and the cost of membership in, and support of, organizations engaged in activities on behalf of Indian education.</continuation>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idfd5ea061-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Training</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idfd5ea062-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/2/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">Each local school board, and any agency school board that serves as a local school board for any grant or contract school, shall ensure that each individual who is a new member of the school board receives, within 1 year after the individual becomes a member of the school board, 40 hours of training relevant to that individual’s service on the board.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idfd5ea063-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/2/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Types of training</heading><content><p style="-uslm-lc:I14" class="indent3">Such training may include training concerning legal issues pertaining to Bureau-funded schools, legal issues pertaining to school boards, ethics, and other topics determined to be appropriate by the school board.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idfd5ea064-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/c/2/B/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Recommendation</heading><content><p style="-uslm-lc:I14" class="indent3">The training described in this subparagraph shall not be required, but is recommended, for a tribal governing body that serves in the capacity of a school board.</p>

</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idfd5ea065-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/d"><num value="d" class="bold">(d)</num><heading class="bold"> Reservation of amount for emergencies</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idfd5ea066-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall reserve from the funds available for distribution for each fiscal year under this section an amount that, in the aggregate, equals 1 percent of the funds available for such purpose for that fiscal year, to be used, at the discretion of the Director of the Office of Indian Education Programs, to meet emergencies and unforeseen contingencies affecting the education programs funded under this section.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idfd5ea067-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Use of funds</heading><content><p style="-uslm-lc:I12" class="indent1">Funds reserved under this subsection may be expended only for education services or programs, including emergency repairs of educational facilities, at a schoolsite (as defined by section 2503(c)(2) <ref class="footnoteRef" idref="fn002116">1</ref><note type="footnote" id="fn002116"><num>1</num> So in original. Probably should be section “2502(c)(2)”.</note> of this title).</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idfd5ea068-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Availability of funds</heading><content><p style="-uslm-lc:I12" class="indent1">Funds reserved under this subsection shall remain available without fiscal year limitation until expended. However, the aggregate amount available from all fiscal years may not exceed 1 percent of the current year funds.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idfd5ea069-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Report</heading><content><p style="-uslm-lc:I12" class="indent1">When the Secretary makes funds available under this subsection, the Secretary shall report such action to the appropriate committees of Congress within the annual budget submission.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idfd5ea06a-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/e"><num value="e" class="bold">(e)</num><heading class="bold"> Supplemental appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">Supplemental appropriations enacted to meet increased pay costs attributable to school level personnel shall be distributed under this section.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idfd5ea06b-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/f"><num value="f" class="bold">(f)</num><heading class="bold"> Eligible Indian student defined</heading><chapeau>In this section, the term “eligible Indian student” means a student who—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idfd5ea06c-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/f/1"><num value="1">(1)</num><content> is a member of, or is at least one-fourth degree Indian blood descendant of a member of, a tribe that is eligible for the special programs and services provided by the United States through the Bureau to Indians because of their status as Indians;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idfd5ea06d-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/f/2"><num value="2">(2)</num><content> resides on or near a reservation or meets the criteria for attendance at a Bureau off-reservation home-living school; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idfd5ea06e-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/f/3"><num value="3">(3)</num><content> is enrolled in a Bureau-funded school.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idfd5ea06f-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/g"><num value="g" class="bold">(g)</num><heading class="bold"> Tuition</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idfd5ea070-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/g/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">No eligible Indian student or a student attending a Bureau school under paragraph (2)(C) may be charged tuition for attendance at a Bureau school or contract or grant school.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idfd5ea071-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/g/2"><num value="2" class="bold">(2)</num><heading class="bold"> Attendance of non-Indian students at Bureau schools</heading><chapeau>The Secretary may permit the attendance at a Bureau school of a student who is not an eligible Indian student if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idfd5ea072-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/g/2/A"><num value="A">(A)</num><content> the Secretary determines that the student’s attendance will not adversely affect the school’s program for eligible Indian students because of cost, overcrowding, or violation of standards or accreditation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idfd5ea073-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/g/2/B"><num value="B">(B)</num><content> the school board consents;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idfd5ea074-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/g/2/C"><num value="C">(C)</num><content> the student is a dependent of a Bureau, Indian Health Service, or tribal government employee who lives on or near the school site; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idfd5ea075-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/g/2/D"><num value="D">(D)</num><content> tuition is paid for the student that is not more than the tuition charged by the nearest public school district for out-of-district students and shall be in addition to the school’s allocation under this section.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idfd5ea076-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/g/3"><num value="3" class="bold">(3)</num><heading class="bold"> Attendance of non-Indian students at contract and grant schools</heading><content><p style="-uslm-lc:I12" class="indent1">The school board of a contract or grant school may permit students who are not eligible Indian students under this subsection to attend its contract school or grant school. Any tuition collected for those students shall be in addition to funding received under this section.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idfd5ea077-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/h"><num value="h" class="bold">(h)</num><heading class="bold"> Funds available without fiscal year limitation</heading><content><p style="-uslm-lc:I11" class="indent0">Notwithstanding any other provision of law, at the election of the school board of a Bureau school made at any time during the fiscal year, a portion equal to not more than 15 percent of the funds allocated with respect to a school under this section for any fiscal year shall remain available to the school for expenditure without fiscal year limitation. The Assistant Secretary shall take such steps as are necessary to implement this subsection.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idfd5ea078-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/i"><num value="i" class="bold">(i)</num><heading class="bold"> Students at Richfield dormitory, Richfield, Utah</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idfd5ea079-857a-11e6-8d3c-c02bfc99672c" identifier="/us/usc/t25/s2007/i/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Tuition for the instruction of each out-of-State Indian student in a home-living situation at the Richfield dormitory in Richfield, Utah, who attends Sevier County high schools in Richfield, Utah, for an academic year, shall be paid from Indian school equalization program funds authorized in this section and section 2009 <sup>2</sup> of this title, at a rate not to exceed the weighted amount provided for under subsection (b) for a student for that year.</p>
