<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idfc6c44cd-aaf5-11e3-a3be-eac978bc5dd5" identifier="/us/usc/t26/s166"><num value="166">§ 166.</num><heading> Bad debts</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idfc6c44ce-aaf5-11e3-a3be-eac978bc5dd5" identifier="/us/usc/t26/s166/a"><num value="a" class="bold">(a)</num><heading class="bold"> General rule</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idfc6c44cf-aaf5-11e3-a3be-eac978bc5dd5" identifier="/us/usc/t26/s166/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Wholly worthless debts</heading><content><p style="-uslm-lc:I12" class="indent1">There shall be allowed as a deduction any debt which becomes worthless within the taxable year.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idfc6c44d0-aaf5-11e3-a3be-eac978bc5dd5" identifier="/us/usc/t26/s166/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Partially worthless debts</heading><content><p style="-uslm-lc:I12" class="indent1">When satisfied that a debt is recoverable only in part, the Secretary may allow such debt, in an amount not in excess of the part charged off within the taxable year, as a deduction.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idfc6c44d1-aaf5-11e3-a3be-eac978bc5dd5" identifier="/us/usc/t26/s166/b"><num value="b" class="bold">(b)</num><heading class="bold"> Amount of deduction</heading><content><p style="-uslm-lc:I11" class="indent0">For purposes of subsection (a), the basis for determining the amount of the deduction for any bad debt shall be the adjusted basis provided in section 1011 for determining the loss from the sale or other disposition of property.</p>

<subparagraph style="-uslm-lc:I13" class="indent2" id="idfc6c44d6-aaf5-11e3-a3be-eac978bc5dd5" identifier="/us/usc/t26/s166/d/1/B"><num value="B">(B)</num><content> where any nonbusiness debt becomes worthless within the taxable year, the loss resulting therefrom shall be considered a loss from the sale or exchange, during the taxable year, of a capital asset held for not more than 1 year.</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="idfc6c44d9-aaf5-11e3-a3be-eac978bc5dd5" identifier="/us/usc/t26/s166/d/2/B"><num value="B">(B)</num><content> a debt the loss from the worthlessness of which is incurred in the taxpayer’s trade or business.</content>

</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> the assessment of a deficiency of the tax imposed by chapter 1 of such Code for such taxable year and each subsequent taxable year ending before <date date="1965-10-22">October 22, 1965</date>, is not prevented on <date date="1966-12-31">December 31, 1966</date>, by the operation of any law or rule of law,</content>

<continuation style="-uslm-lc:I33" class="indent0 firstIndent0">then such deduction on account of such debt obligations shall be allowed for each such taxable year under such section 166(c) to the extent that the deduction would have been allowable under the provisions of such section 166(g)(1)(A) if such provisions applied to such taxable years.</continuation>

<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><content> Section 166(g)(2) of the Internal Revenue Code of 1986 (as amended by the first section of this Act) shall apply to taxable years beginning after <date date="1953-12-31">December 31, 1953</date>, and ending after <date date="1954-08-16">August 16, 1954</date>.”</content>
