<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idc5a01f9f-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s68"><num value="68">§ 68.</num><heading> Overall limitation on itemized deductions</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc5a01fa0-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s68/a"><num value="a" class="bold">(a)</num><heading class="bold"> General rule</heading><chapeau>In the case of an individual whose adjusted gross income exceeds the applicable amount, the amount of the itemized deductions otherwise allowable for the taxable year shall be reduced by the lesser of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idc5a01fa1-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s68/a/1"><num value="1">(1)</num><content> 3 percent of the excess of adjusted gross income over the applicable amount, or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idc5a01fa2-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s68/a/2"><num value="2">(2)</num><content> 80 percent of the amount of the itemized deductions otherwise allowable for such taxable year.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc5a01fa3-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s68/b"><num value="b" class="bold">(b)</num><heading class="bold"> Applicable amount</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idc5a01fa4-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s68/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau>For purposes of this section, the term “applicable amount” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idc5a01fa5-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s68/b/1/A"><num value="A">(A)</num><content> $300,000 in the case of a joint return or a surviving spouse (as defined in section 2(a)),</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idc5a01fa6-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s68/b/1/B"><num value="B">(B)</num><content> $275,000 in the case of a head of household (as defined in section 2(b)),</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idc5a01fa7-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s68/b/1/C"><num value="C">(C)</num><content> $250,000 in the case of an individual who is not married and who is not a surviving spouse or head of household, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idc5a01fa8-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s68/b/1/D"><num value="D">(D)</num><content> ½ the amount applicable under subparagraph (A) (after adjustment, if any, under paragraph (2)) in the case of a married individual filing a separate return.</content>
</subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">For purposes of this paragraph, marital status shall be determined under section 7703.</continuation>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idc5a01fa9-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s68/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Inflation adjustment</heading><chapeau>In the case of any taxable year beginning in calendar years after 2013, each of the dollar amounts under subparagraphs (A), (B), and (C) of paragraph (1) shall be shall be <ref class="footnoteRef" idref="fn002055">1</ref><note type="footnote" id="fn002055"><num>1</num> So in original.</note> increased by an amount equal to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idc5a01faa-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s68/b/2/A"><num value="A">(A)</num><content> such dollar amount, multiplied by</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idc5a01fab-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s68/b/2/B"><num value="B">(B)</num><content> the cost-of-living adjustment determined under section 1(f)(3) for the calendar year in which the taxable year begins, except that section 1(f)(3)(B) shall be applied by substituting “2012” for “1992”.</content>
</subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">If any amount after adjustment under the preceding sentence is not a multiple of $50, such amount shall be rounded to the next lowest multiple of $50.</continuation>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc5a01fac-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s68/c"><num value="c" class="bold">(c)</num><heading class="bold"> Exception for certain itemized deductions</heading><chapeau>For purposes of this section, the term “itemized deductions” does not include—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idc5a01fad-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s68/c/1"><num value="1">(1)</num><content> the deduction under section 213 (relating to medical, etc. expenses),</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idc5a01fae-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s68/c/2"><num value="2">(2)</num><content> any deduction for investment interest (as defined in section 163(d)), and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idc5a01faf-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s68/c/3"><num value="3">(3)</num><content> the deduction under section 165(a) for casualty or theft losses described in paragraph (2) or (3) of section 165(c) or for losses described in section 165(d).</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc5a01fb0-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s68/d"><num value="d" class="bold">(d)</num><heading class="bold"> Coordination with other limitations</heading><content><p style="-uslm-lc:I11" class="indent0">This section shall be applied after the application of any other limitation on the allowance of any itemized deduction.</p>
