<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idc5a4da82-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s74"><num value="74">§ 74.</num><heading> Prizes and awards</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc5a4da83-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s74/a"><num value="a" class="bold">(a)</num><heading class="bold"> General rule</heading><content><p style="-uslm-lc:I11" class="indent0">Except as otherwise provided in this section or in section 117 (relating to qualified scholarships), gross income includes amounts received as prizes and awards.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc5a4da84-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s74/b"><num value="b" class="bold">(b)</num><heading class="bold"> Exception for certain prizes and awards transferred to charities</heading><chapeau>Gross income does not include amounts received as prizes and awards made primarily in recognition of religious, charitable, scientific, educational, artistic, literary, or civic achievement, but only if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idc5a4da85-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s74/b/1"><num value="1">(1)</num><content> the recipient was selected without any action on his part to enter the contest or proceeding;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idc5a4da86-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s74/b/2"><num value="2">(2)</num><content> the recipient is not required to render substantial future services as a condition to receiving the prize or award; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idc5a4da87-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s74/b/3"><num value="3">(3)</num><content> the prize or award is transferred by the payor to a governmental unit or organization described in paragraph (1) or (2) of section 170(c) pursuant to a designation made by the recipient.</content>
</paragraph>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc5a4da88-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s74/c"><num value="c" class="bold">(c)</num><heading class="bold"> Exception for certain employee achievement awards</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idc5a4da89-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s74/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Gross income shall not include the value of an employee achievement award (as defined in section 274(j)) received by the taxpayer if the cost to the employer of the employee achievement award does not exceed the amount allowable as a deduction to the employer for the cost of the employee achievement award.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idc5a74a8a-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s74/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Excess deduction award</heading><chapeau>If the cost to the employer of the employee achievement award received by the taxpayer exceeds the amount allowable as a deduction to the employer, then gross income includes the greater of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idc5a74a8b-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s74/c/2/A"><num value="A">(A)</num><content> an amount equal to the portion of the cost to the employer of the award that is not allowable as a deduction to the employer (but not in excess of the value of the award), or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idc5a74a8c-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s74/c/2/B"><num value="B">(B)</num><content> the amount by which the value of the award exceeds the amount allowable as a deduction to the employer.</content>
</subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">The remaining portion of the value of such award shall not be included in the gross income of the recipient.</continuation>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idc5a74a8d-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s74/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Treatment of tax-exempt employers</heading><content><p style="-uslm-lc:I12" class="indent1">In the case of an employer exempt from taxation under this subtitle, any reference in this subsection to the amount allowable as a deduction to the employer shall be treated as a reference to the amount which would be allowable as a deduction to the employer if the employer were not exempt from taxation under this subtitle.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc5a74a8f-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s74/d"><num value="d" class="bold">(d)</num><heading class="bold"> Exception for Olympic and Paralympic medals and prizes</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idc5a74a90-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s74/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Gross income shall not include the value of any medal awarded in, or any prize money received from the United States Olympic Committee on account of, competition in the Olympic Games or Paralympic Games.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idc5a74a91-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s74/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Limitation based on adjusted gross income</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idc5a74a92-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s74/d/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Paragraph (1) shall not apply to any taxpayer for any taxable year if the adjusted gross income (determined without regard to this subsection) of such taxpayer for such taxable year exceeds $1,000,000 (half of such amount in the case of a married individual filing a separate return).</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idc5a74a93-9221-11e6-a55f-f33f06b2349c" identifier="/us/usc/t26/s74/d/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Coordination with other limitations</heading><content><p style="-uslm-lc:I13" class="indent2">For purposes of sections 86, 135, 137, 199, 219, 221, 222, and 469, adjusted gross income shall be determined after the application of paragraph (1) and before the application of subparagraph (A).</p>
