<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id4dfa8069-a3d3-11e9-a1cd-d0ff1fbb1a6f" identifier="/us/usc/t26/s845"><num value="845">§ 845.</num><heading> Certain reinsurance agreements</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id4dfa806a-a3d3-11e9-a1cd-d0ff1fbb1a6f" identifier="/us/usc/t26/s845/a"><num value="a" class="bold">(a)</num><heading class="bold"> Allocation in case of reinsurance agreement involving tax avoidance or evasion</heading><chapeau>In the case of 2 or more related persons (within the meaning of section 482) who are parties to a reinsurance agreement (or where one of the parties to a reinsurance agreement is, with respect to any contract covered by the agreement, in effect an agent of another party to such agreement or a conduit between related persons), the Secretary may—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id4dfa806b-a3d3-11e9-a1cd-d0ff1fbb1a6f" identifier="/us/usc/t26/s845/a/1"><num value="1">(1)</num><content> allocate between or among such persons income (whether investment income, premium, or otherwise), deductions, assets, reserves, credits, and other items related to such agreement,</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4dfa806c-a3d3-11e9-a1cd-d0ff1fbb1a6f" identifier="/us/usc/t26/s845/a/2"><num value="2">(2)</num><content> recharacterize any such items, or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4dfa806d-a3d3-11e9-a1cd-d0ff1fbb1a6f" identifier="/us/usc/t26/s845/a/3"><num value="3">(3)</num><content> make any other adjustment,</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">if he determines that such allocation, recharacterization, or adjustment is necessary to reflect the proper amount, source, or character of the taxable income (or any item described in paragraph (1) relating to such taxable income) of each such person.</continuation>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id4dfa806e-a3d3-11e9-a1cd-d0ff1fbb1a6f" identifier="/us/usc/t26/s845/b"><num value="b" class="bold">(b)</num><heading class="bold"> Reinsurance contract having significant tax avoidance effect</heading><content><p style="-uslm-lc:I11" class="indent0">If the Secretary determines that any reinsurance contract has a significant tax avoidance effect on any party to such contract, the Secretary may make proper adjustments with respect to such party to eliminate such tax avoidance effect (including treating such contract with respect to such party as terminated on December 31 of each year and reinstated on January 1 of the next year).</p>
