The fee shall be payable on the last day of the calendar month following the calendar quarter for which the fee is owed.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id52c5f8d8-3a70-11f1-9e0c-dcbb1364dae6" identifier="/us/usc/t28/s1930/a/6/B"><num value="B">(B)</num><clause style="-uslm-lc:I12" class="indent1" id="id52c5f8d9-3a70-11f1-9e0c-dcbb1364dae6" identifier="/us/usc/t28/s1930/a/6/B/i"><num value="i">(i)</num><content> During the 10-year period beginning on <date date="2021-01-01">January 1, 2021</date>, in addition to the filing fee paid to the clerk, a quarterly fee shall be paid to the United States trustee, for deposit in the Treasury, in each open and reopened case under chapter 11 of title 11, other than under subchapter V, for each quarter (including any fraction thereof) until the case is closed, converted, or dismissed, whichever occurs first.</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id52c5f8da-3a70-11f1-9e0c-dcbb1364dae6" identifier="/us/usc/t28/s1930/a/6/B/ii"><num value="ii">(ii)</num><chapeau> The fee shall be the greater of—</chapeau><subclause style="-uslm-lc:I13" class="indent2" id="id52c5f8db-3a70-11f1-9e0c-dcbb1364dae6" identifier="/us/usc/t28/s1930/a/6/B/ii/I"><num value="I">(I)</num><content> the greater of 0.4 percent of disbursements or $250 for each quarter in which disbursements total less than $1,000,000; or</content>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="id52c5f8dc-3a70-11f1-9e0c-dcbb1364dae6" identifier="/us/usc/t28/s1930/a/6/B/ii/II"><num value="II">(II)</num><content> 0.9 percent of disbursements but not more than $250,000 for each quarter in which disbursements total at least $1,000,000.</content>

<clause style="-uslm-lc:I12" class="indent1" id="id52c5f8dd-3a70-11f1-9e0c-dcbb1364dae6" identifier="/us/usc/t28/s1930/a/6/B/iii"><num value="iii">(iii)</num><content> The fee shall be payable on the last day of the calendar month following the calendar quarter for which the fee is owed.</content>

</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id52c5f8de-3a70-11f1-9e0c-dcbb1364dae6" identifier="/us/usc/t28/s1930/a/7"><num value="7">(7)</num><content> In districts that are not part of a United States trustee region as defined in <ref href="/us/usc/t28/s581">section 581 of this title</ref>, the Judicial Conference of the United States shall require the debtor in a case under chapter 11 of title 11 to pay fees equal to those imposed by paragraph (6) of this subsection. Such fees shall be deposited as offsetting receipts to the fund established under <ref href="/us/usc/t28/s1931">section 1931 of this title</ref> and shall remain available until expended.</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">An individual commencing a voluntary case or a joint case under title 11 may pay such fee in installments. For converting, on request of the debtor, a case under chapter 7, or 13 of title 11, to a case under chapter 11 of title 11, the debtor shall pay to the clerk of the district court or the clerk of the bankruptcy court, if one has been certified pursuant to <ref href="/us/usc/t28/s156/b">section 156(b) of this title</ref>, a fee of the amount equal to the difference between the fee specified in paragraph (3) and the fee specified in paragraph (1).</continuation>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id52c5f8df-3a70-11f1-9e0c-dcbb1364dae6" identifier="/us/usc/t28/s1930/b"><num value="b">(b)</num><content> The Judicial Conference of the United States may prescribe additional fees in cases under title 11 of the same kind as the Judicial Conference prescribes under <ref href="/us/usc/t28/s1914/b">section 1914(b) of this title</ref>.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id52c5f8e0-3a70-11f1-9e0c-dcbb1364dae6" identifier="/us/usc/t28/s1930/c"><num value="c">(c)</num><content> Upon the filing of any separate or joint notice of appeal or application for appeal or upon the receipt of any order allowing, or notice of the allowance of, an appeal or a writ of certiorari $5 shall be paid to the clerk of the court, by the appellant or petitioner.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id52c5f8e1-3a70-11f1-9e0c-dcbb1364dae6" identifier="/us/usc/t28/s1930/d"><num value="d">(d)</num><content> Whenever any case or proceeding is dismissed in any bankruptcy court for want of jurisdiction, such court may order the payment of just costs.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id52c5f8e2-3a70-11f1-9e0c-dcbb1364dae6" identifier="/us/usc/t28/s1930/e"><num value="e">(e)</num><content> The clerk of the court may collect only the fees prescribed under this section.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id52c5f8e3-3a70-11f1-9e0c-dcbb1364dae6" identifier="/us/usc/t28/s1930/f"><num value="f">(f)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id52c5f8e4-3a70-11f1-9e0c-dcbb1364dae6" identifier="/us/usc/t28/s1930/f/1"><num value="1">(1)</num><content> Under the procedures prescribed by the Judicial Conference of the United States, the district court or the bankruptcy court may waive the filing fee in a case under chapter 7 of title 11 for an individual if the court determines that such individual has income less than 150 percent of the income official poverty line (as defined by the Office of Management and Budget, and revised annually in accordance with section 673(2) of the Omnibus Budget Reconciliation Act of 1981) applicable to a family of the size involved and is unable to pay that fee in installments. For purposes of this paragraph, the term “filing fee” means the filing fee required by subsection (a), or any other fee prescribed by the Judicial Conference under subsections (b) and (c) that is payable to the clerk upon the commencement of a case under chapter 7.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id52c5f8e5-3a70-11f1-9e0c-dcbb1364dae6" identifier="/us/usc/t28/s1930/f/2"><num value="2">(2)</num><content> The district court or the bankruptcy court may waive for such debtors other fees prescribed under subsections (b) and (c).</content>

<paragraph style="-uslm-lc:I11" class="indent0" id="id52c5f8e6-3a70-11f1-9e0c-dcbb1364dae6" identifier="/us/usc/t28/s1930/f/3"><num value="3">(3)</num><content> This subsection does not restrict the district court or the bankruptcy court from waiving, in accordance with Judicial Conference policy, fees prescribed under this section for other debtors and creditors.</content>

L. 103–121, title I, § 111(d)</ref>, <date date="1993-10-27">Oct. 27, 1993</date>, <ref href="/us/stat/107/1165">107 Stat. 1165</ref>, provided that not later than <date date="1998-03-31">Mar. 31, 1998</date>, the Judicial Conference of the United States would submit to Congress a report, with specified contents, waiver of fees in selected districts, and study of graduated fee systems, relating to the bankruptcy fee system and the impact of such system on various participants in bankruptcy cases.</p>

(b) The Administrative Office shall permit and encourage the preparation and mailing of such notices to be performed by or at the expense of the debtors, trustees or such other interested parties as the Court may direct and approve. (c) The Director of the Administrative Office of the United States Courts shall make appropriate provisions for the use of and accounting for any postage required pursuant to such directives.”</quotedContent>
