<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id13a28213-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s258"><num value="258">§ 258.</num><heading> Chief judges; precedence of judges</heading><subsection style="-uslm-lc:I11" class="indent0" id="id13a28214-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s258/a"><num value="a">(a)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id13a28215-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s258/a/1"><num value="1">(1)</num><chapeau> The chief judge of the Court of International Trade shall be the judge of the court in regular active service who is senior in commission of those judges who—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id13a28216-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s258/a/1/A"><num value="A">(A)</num><content> are 64 years of age or under;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id13a28217-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s258/a/1/B"><num value="B">(B)</num><content> have served for 1 year or more as a judge of the court; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id13a28218-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s258/a/1/C"><num value="C">(C)</num><content> have not served previously as chief judge.</content>
</subparagraph>

<paragraph style="-uslm-lc:I11" class="indent0" id="id13a28219-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s258/a/2"><num value="2">(2)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id13a2821a-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s258/a/2/A"><num value="A">(A)</num><content> In any case in which no judge of the court meets the qualifications under paragraph (1), the youngest judge in regular active service who is 65 years of age or over and who has served as a judge of the court for 1 year or more shall act as the chief judge.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id13a2821b-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s258/a/2/B"><num value="B">(B)</num><content> In any case under subparagraph (A) in which there is no judge of the court in regular active service who has served as a judge of the court for 1 year or more, the judge of the court in regular active service who is senior in commission and who has not served previously as chief judge shall act as the chief judge.</content>

<paragraph style="-uslm-lc:I11" class="indent0" id="id13a2821c-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s258/a/3"><num value="3">(3)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id13a2821d-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s258/a/3/A"><num value="A">(A)</num><content> Except as provided under subparagraph (C), the chief judge serving under paragraph (1) shall serve for a term of 7 years and shall serve after expiration of such term until another judge is eligible under paragraph (1) to serve as chief judge.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id13a2821e-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s258/a/3/B"><num value="B">(B)</num><content> Except as provided under subparagraph (C), a judge of the court acting as chief judge under subparagraph (A) or (B) of paragraph (2) shall serve until a judge meets the qualifications under paragraph (1).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id13a2821f-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s258/a/3/C"><num value="C">(C)</num><content> No judge of the court may serve or act as chief judge of the court after attaining the age of 70 years unless no other judge is qualified to serve as chief judge under paragraph (1) or is qualified to act as chief judge under paragraph (2).</content>

</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id13a28220-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s258/b"><num value="b">(b)</num><content> The chief judge shall have precedence and preside at any session of the court which such judge attends. Other judges of the court shall have precedence and preside according to the seniority of their commissions. Judges whose commissions bear the same date shall have precedence according to seniority in age.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id13a28221-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s258/c"><num value="c">(c)</num><content> If the chief judge desires to be relieved of the duties as chief judge while retaining active status as a judge of the court, the chief judge may so certify to the Chief Justice of the United States, and thereafter the chief judge of the court shall be such other judge of the court who is qualified to serve or act as chief judge under subsection (a).</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id13a28222-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s258/d"><num value="d">(d)</num><content> If a chief judge is temporarily unable to perform the duties as such, such duties shall be performed by the judge of the court in active service, able and qualified to act, who is next in precedence.</content>

<paragraph style="-uslm-lc:I21" class="indent0"><num value="1">“(1)</num><chapeau> Notwithstanding the provisions of <ref href="/us/usc/t28/s258/a">section 258(a) of title 28</ref>, United States Code (as added by subsection (a) of this section), the chief judge of the United States Court of International Trade who is in office on the day before the date of enactment of this Act [<date date="1996-10-19">Oct. 19, 1996</date>] shall continue to be such chief judge on or after such date until any one of the following events occurs:</chapeau><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><content> The chief judge is relieved of his duties under <ref href="/us/usc/t28/s258/c">section 258(c) of title 28</ref>, United States Code.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><content> The regular active status of the chief judge is terminated.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="C">“(C)</num><content> The chief judge attains the age of 70 years.</content>

<subparagraph style="-uslm-lc:I22" class="indent1"><num value="D">“(D)</num><content> The chief judge has served for a term of 7 years as chief judge.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="2">“(2)</num><content> When the chief judge vacates the position of chief judge under paragraph (1), the position of chief judge of the Court of International Trade shall be filled in accordance with <ref href="/us/usc/t28/s258/a">section 258(a) of title 28</ref>, United States Code.”</content>
