<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id13b593df-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s458"><num value="458">§ 458.</num><heading> Relative of justice or judge ineligible to appointment</heading><subsection style="-uslm-lc:I11" class="indent0" id="id13b593e0-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s458/a"><num value="a">(a)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id13b593e1-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s458/a/1"><num value="1">(1)</num><content> No person shall be appointed to or employed in any office or duty in any court who is related by affinity or consanguinity within the degree of first cousin to any justice or judge of such court.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id13b593e2-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s458/a/2"><num value="2">(2)</num><content> With respect to the appointment of a judge of a court exercising judicial power under article III of the United States Constitution (other than the Supreme Court), subsection (b) shall apply in lieu of this subsection.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="id13b593e3-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s458/b"><num value="b">(b)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id13b593e4-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s458/b/1"><num value="1">(1)</num><chapeau> In this subsection, the term—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id13b593e5-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s458/b/1/A"><num value="A">(A)</num><chapeau> “same court” means—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id13b593e6-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s458/b/1/A/i"><num value="i">(i)</num><content> in the case of a district court, the court of a single judicial district; and</content>

<clause style="-uslm-lc:I13" class="indent2" id="id13b593e7-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s458/b/1/A/ii"><num value="ii">(ii)</num><content> in the case of a court of appeals, the court of appeals of a single circuit; and</content>

</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id13b593e8-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s458/b/1/B"><num value="B">(B)</num><chapeau> “member”—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id13b593e9-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s458/b/1/B/i"><num value="i">(i)</num><content> means an active judge or a judge retired in senior status under section 371(b); and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id13b593ea-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s458/b/1/B/ii"><num value="ii">(ii)</num><content> shall not include a retired judge, except as described under clause (i).</content>
