<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id13b59401-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s461"><num value="461">§ 461.</num><heading> Adjustments in certain salaries</heading><subsection style="-uslm-lc:I11" class="indent0" id="id13b59402-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s461/a"><num value="a">(a)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id13b59403-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s461/a/1"><num value="1">(1)</num><content> Subject to paragraph (2), effective at the beginning of the first applicable pay period commencing on or after the first day of the month in which an adjustment takes effect under <ref href="/us/usc/t5/s5303">section 5303 of title 5</ref> in the rates of pay under the General Schedule (except as provided in subsection (b)), each salary rate which is subject to adjustment under this section shall be adjusted by an amount, rounded to the nearest multiple of $100 (or if midway between multiples of $100, to the next higher multiple of $100) equal to the percentage of such salary rate which corresponds to the most recent percentage change in the ECI (relative to the date described in the next sentence), as determined under section 704(a)(1) of the Ethics Reform Act of 1989. The appropriate date under this sentence is the first day of the fiscal year in which such adjustment in the rates of pay under the General Schedule takes effect.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id13b59404-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s461/a/2"><num value="2">(2)</num><content> In no event shall the percentage adjustment taking effect under paragraph (1) in any calendar year (before rounding), in any salary rate, exceed the percentage adjustment taking effect in such calendar year under <ref href="/us/usc/t5/s5303">section 5303 of title 5</ref> in the rates of pay under the General Schedule.</content>

</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id13b59405-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s461/b"><num value="b">(b)</num><content> Subsection (a) shall not apply to the extent it would reduce the salary of any individual whose compensation may not, under section 1 of article III of the Constitution of the United States, be diminished during such individual’s continuance in office.</content>

<p style="-uslm-lc:I21" class="indent0"><ref href="/us/pl/101/194/tVII">Pub. L. 101–194, title VII</ref>, § 703(a)(3), <date date="1989-11-30">Nov. 30, 1989</date>, <ref href="/us/stat/103/1768">103 Stat. 1768</ref>, set out as a note under <ref href="/us/usc/t5/s5318">section 5318 of Title 5</ref>, Government Organization and Employees, provided that effective the first day of the first applicable pay period that begins on or after <date date="1991-01-01">January 1, 1991</date>, the rate of basic pay for the Chief Justice of the United States, an associate justice of the Supreme Court of the United States, a judge of a United States circuit court, a judge of a district court of the United States, and a judge of the United States Court of International Trade shall be increased in the amount of 25 percent of their respective rates (as last in effect before the increase), rounded to the nearest multiple of $100 (or, if midway between multiples of $100, to the next higher multiple of $100).</p>
<p style="-uslm-lc:I21" class="indent0">For purposes of <ref href="/us/pl/97/92/s140">section 140 of Pub. L. 97–92</ref> (set out below), appropriate salary increases were authorized for Federal judges and Justices of the Supreme Court pursuant to <ref href="/us/pl/101/194/s702/a">section 702(a) of Pub. L. 101–194</ref> which provided that effective for pay periods beginning on or after <date date="1989-11-30">Nov. 30, 1989</date>, the rate of basic pay for any office or position in the judicial branch of the Government shall be determined as if <ref href="/us/pl/100/440/s620/b">section 620(b) of Pub. L. 100–440</ref> (<ref href="/us/usc/t5/s5303">5 U.S.C. 5303</ref> note) and <ref href="/us/pl/101/136/s619/b">section 619(b) of Pub. L. 101–136</ref> (<ref href="/us/usc/t5/s5303">5 U.S.C. 5303</ref> note) had never been enacted, see <ref href="/us/pl/101/194/s702">section 702 of Pub. L. 101–194</ref>, set out as a note under <ref href="/us/usc/t5/s5303">section 5303 of Title 5</ref>.</p>
<p><ref href="/us/pl/100/202">Pub. L. 100–202</ref>, § 101(a) [title IV, § 406], <date date="1987-12-22">Dec. 22, 1987</date>, <ref href="/us/stat/101/1329">101 Stat. 1329</ref>, 1329–26, provided that: <quotedContent origin="/us/pl/100/202">“Pursuant to <ref href="/us/pl/97/92/s140">section 140 of Public Law 97–92</ref> [set out below], during fiscal year 1988, justices and judges of the United States shall receive the same percentage increase in salary accorded to employees paid under the General Schedule (pursuant to <ref href="/us/usc/t5/s5305">5 U.S.C. 5305</ref>).”</quotedContent>
