<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id13b5942d-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s472"><num value="472">§ 472.</num><heading> Development and implementation of a civil justice expense and delay reduction plan</heading><subsection style="-uslm-lc:I11" class="indent0" id="id13b5942e-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s472/a"><num value="a">(a)</num><content> The civil justice expense and delay reduction plan implemented by a district court shall be developed or selected, as the case may be, after consideration of the recommendations of an advisory group appointed in accordance with <ref href="/us/usc/t28/s478">section 478 of this title</ref>.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id13b5942f-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s472/b"><num value="b">(b)</num><chapeau> The advisory group of a United States district court shall submit to the court a report, which shall be made available to the public and which shall include—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id13b59430-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s472/b/1"><num value="1">(1)</num><content> an assessment of the matters referred to in subsection (c)(1);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id13b59431-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s472/b/2"><num value="2">(2)</num><content> the basis for its recommendation that the district court develop a plan or select a model plan;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id13b59432-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s472/b/3"><num value="3">(3)</num><content> recommended measures, rules and programs; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id13b59433-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s472/b/4"><num value="4">(4)</num><content> an explanation of the manner in which the recommended plan complies with <ref href="/us/usc/t28/s473">section 473 of this title</ref>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id13b59434-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s472/c"><num value="c">(c)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id13b59435-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s472/c/1"><num value="1">(1)</num><chapeau> In developing its recommendations, the advisory group of a district court shall promptly complete a thorough assessment of the state of the court’s civil and criminal dockets. In performing the assessment for a district court, the advisory group shall—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id13b59436-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s472/c/1/A"><num value="A">(A)</num><content> determine the condition of the civil and criminal dockets;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id13b59437-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s472/c/1/B"><num value="B">(B)</num><content> identify trends in case filings and in the demands being placed on the court’s resources;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id13b59438-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s472/c/1/C"><num value="C">(C)</num><content> identify the principal causes of cost and delay in civil litigation, giving consideration to such potential causes as court procedures and the ways in which litigants and their attorneys approach and conduct litigation; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id13b59439-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s472/c/1/D"><num value="D">(D)</num><content> examine the extent to which costs and delays could be reduced by a better assessment of the impact of new legislation on the courts.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id13b5943a-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s472/c/2"><num value="2">(2)</num><content> In developing its recommendations, the advisory group of a district court shall take into account the particular needs and circumstances of the district court, litigants in such court, and the litigants’ attorneys.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id13b5943b-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s472/c/3"><num value="3">(3)</num><content> The advisory group of a district court shall ensure that its recommended actions include significant contributions to be made by the court, the litigants, and the litigants’ attorneys toward reducing cost and delay and thereby facilitating access to the courts.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id13b5943c-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s472/d"><num value="d">(d)</num><chapeau> The chief judge of the district court shall transmit a copy of the plan implemented in accordance with subsection (a) and the report prepared in accordance with subsection (b) of this section to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id13b5943d-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s472/d/1"><num value="1">(1)</num><content> the Director of the Administrative Office of the United States Courts;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id13b5943e-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s472/d/2"><num value="2">(2)</num><content> the judicial council of the circuit in which the district court is located; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id13b5943f-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s472/d/3"><num value="3">(3)</num><content> the chief judge of each of the other United States district courts located in such circuit.</content>
