<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id13cd628c-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s562"><num value="562">§ 562.</num><heading> Vacancies</heading><subsection style="-uslm-lc:I11" class="indent0" id="id13cd628d-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s562/a"><num value="a">(a)</num><content> In the case of a vacancy in the office of a United States marshal, the Attorney General may designate a person to perform the functions of and act as marshal, except that the Attorney General may not designate to act as marshal any person who was appointed by the President to that office but with respect to such appointment the Senate has refused to give its advice and consent.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id13cd628e-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s562/b"><num value="b">(b)</num><chapeau> A person designated by the Attorney General under subsection (a) may serve until the earliest of the following events:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id13cd628f-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s562/b/1"><num value="1">(1)</num><content> The entry into office of a United States marshal appointed by the President, pursuant to section 561(c).</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id13cd6290-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s562/b/2"><num value="2">(2)</num><content> The expiration of the thirtieth day following the end of the next session of the Senate.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id13cd6291-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s562/b/3"><num value="3">(3)</num><content> If such designee of the Attorney General is appointed by the President pursuant to section 561(c), but the Senate refuses to give its advice and consent to the appointment, the expiration of the thirtieth day following such refusal.</content>
