<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id13e0751f-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s677"><num value="677">§ 677.</num><heading> Counselor to the Chief Justice</heading><subsection style="-uslm-lc:I11" class="indent0" id="id13e07520-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s677/a"><num value="a">(a)</num><content> The Chief Justice of the United States may appoint a Counselor who shall serve at the pleasure of the Chief Justice and shall perform such duties as may be assigned to him by the Chief Justice. The salary payable to the Counselor shall be fixed by the Chief Justice at a rate which shall not exceed the salary payable to the Director of the Administrative Office of the United States Courts. The Counselor may elect to bring himself within the same retirement program available to the Director of the Administrative Office of the United States Courts, as provided by <ref href="/us/usc/t28/s611">section 611 of this title</ref>, by filing a written election with the Chief Justice within the time and in the manner prescribed by section 611.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id13e07521-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s677/b"><num value="b">(b)</num><content> The Counselor, with the approval of the Chief Justice, may appoint and fix the compensation of necessary employees. The Counselor and his employees shall be deemed employees of the Supreme Court.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id13e07522-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s677/c"><num value="c">(c)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id13e07523-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s677/c/1"><num value="1">(1)</num><content> Notwithstanding <ref href="/us/usc/t31/s1342">section 1342 of title 31</ref>, the Counselor, with the approval of the Chief Justice, may accept voluntary personal services to assist with public and visitor programs.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id13e07524-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s677/c/2"><num value="2">(2)</num><content> No person may volunteer personal services under this subsection unless the person has first agreed, in writing, to waive any claim against the United States arising out of or in connection with such services, other than a claim under chapter 81 of title 5.</content>

<paragraph style="-uslm-lc:I11" class="indent0" id="id13e07525-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s677/c/3"><num value="3">(3)</num><chapeau> No person volunteering personal services under this subsection shall be considered an employee of the United States for any purpose other than for purposes of—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id13e07526-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s677/c/3/A"><num value="A">(A)</num><content> chapter 81 of title 5; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id13e07527-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s677/c/3/B"><num value="B">(B)</num><content> chapter 171 of this title.</content>

<paragraph style="-uslm-lc:I11" class="indent0" id="id13e07528-f67d-11e5-bd8c-a577a4d23433" identifier="/us/usc/t28/s677/c/4"><num value="4">(4)</num><content> In the administration of this subsection, the Counselor shall ensure that the acceptance of personal services shall not result in the reduction of pay or displacement of any employee of the Supreme Court.</content>
