<chapeau style="-uslm-lc:I11" class="indent0">As used in this chapter:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2dd308e6-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s2001/1"><num value="1" class="bold">(1)</num><heading class="bold"> Commerce</heading><content><p style="-uslm-lc:I12" class="indent1">The term “commerce” has the meaning provided by <ref href="/us/usc/t29/s203/b">section 203(b) of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2dd308e7-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s2001/2"><num value="2" class="bold">(2)</num><heading class="bold"> Employer</heading><content><p style="-uslm-lc:I12" class="indent1">The term “employer” includes any person acting directly or indirectly in the interest of an employer in relation to an employee or prospective employee.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2dd308e8-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s2001/3"><num value="3" class="bold">(3)</num><heading class="bold"> Lie detector</heading><content><p style="-uslm-lc:I12" class="indent1">The term “lie detector” includes a polygraph, deceptograph, voice stress analyzer, psychological stress evaluator, or any other similar device (whether mechanical or electrical) that is used, or the results of which are used, for the purpose of rendering a diagnostic opinion regarding the honesty or dishonesty of an individual.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2dd308e9-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s2001/4"><num value="4" class="bold">(4)</num><heading class="bold"> Polygraph</heading><chapeau>The term “polygraph” means an instrument that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id2dd308ea-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s2001/4/A"><num value="A">(A)</num><content> records continuously, visually, permanently, and simultaneously changes in cardiovascular, respiratory, and electrodermal patterns as minimum instrumentation standards; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2dd308eb-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s2001/4/B"><num value="B">(B)</num><content> is used, or the results of which are used, for the purpose of rendering a diagnostic opinion regarding the honesty or dishonesty of an individual.</content>
