<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida81c00f4-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007"><num value="2007">§ 2007.</num><heading> Restrictions on use of exemptions</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida81c00f5-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/a"><num value="a" class="bold">(a)</num><heading class="bold"> Test as basis for adverse employment action</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida81c00f6-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Under ongoing investigations exemption</heading><content><p style="-uslm-lc:I12" class="indent1">Except as provided in paragraph (2), the exemption under subsection (d) of <ref href="/us/usc/t29/s2006">section 2006 of this title</ref> shall not apply if an employee is discharged, disciplined, denied employment or promotion, or otherwise discriminated against in any manner on the basis of the analysis of a polygraph test chart or the refusal to take a polygraph test, without additional supporting evidence. The evidence required by such subsection may serve as additional supporting evidence.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida81c00f7-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Under other exemptions</heading><content><p style="-uslm-lc:I12" class="indent1">In the case of an exemption described in subsection (e) or (f) of such section, the exemption shall not apply if the results of an analysis of a polygraph test chart are used, or the refusal to take a polygraph test is used, as the sole basis upon which an adverse employment action described in paragraph (1) is taken against an employee or prospective employee.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida81c00f8-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b"><num value="b" class="bold">(b)</num><heading class="bold"> Rights of examinee</heading><chapeau>The exemptions provided under subsections (d), (e), and (f) of <ref href="/us/usc/t29/s2006">section 2006 of this title</ref> shall not apply unless the requirements described in the following paragraphs are met:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida81c00f9-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> All phases</heading><chapeau>Throughout all phases of the test—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida81c00fa-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/1/A"><num value="A">(A)</num><content> the examinee shall be permitted to terminate the test at any time;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida81c00fb-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/1/B"><num value="B">(B)</num><content> the examinee is not asked questions in a manner designed to degrade, or needlessly intrude on, such examinee;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida81c00fc-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/1/C"><num value="C">(C)</num><chapeau> the examinee is not asked any question concerning—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida81c00fd-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/1/C/i"><num value="i">(i)</num><content> religious beliefs or affiliations,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida81c00fe-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/1/C/ii"><num value="ii">(ii)</num><content> beliefs or opinions regarding racial matters,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida81c280f-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/1/C/iii"><num value="iii">(iii)</num><content> political beliefs or affiliations,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida81c2810-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/1/C/iv"><num value="iv">(iv)</num><content> any matter relating to sexual behavior; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida81c2811-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/1/C/v"><num value="v">(v)</num><content> beliefs, affiliations, opinions, or lawful activities regarding unions or labor organizations; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida81c2812-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/1/D"><num value="D">(D)</num><content> the examiner does not conduct the test if there is sufficient written evidence by a physician that the examinee is suffering from a medical or psychological condition or undergoing treatment that might cause abnormal responses during the actual testing phase.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida81c2813-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Pretest phase</heading><chapeau>During the pretest phase, the prospective examinee—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida81c2814-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/2/A"><num value="A">(A)</num><content> is provided with reasonable written notice of the date, time, and location of the test, and of such examinee’s right to obtain and consult with legal counsel or an employee representative before each phase of the test;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida81c2815-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/2/B"><num value="B">(B)</num><content> is informed in writing of the nature and characteristics of the tests and of the instruments involved;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida81c2816-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/2/C"><num value="C">(C)</num><chapeau> is informed, in writing—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida81c2817-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/2/C/i"><num value="i">(i)</num><content> whether the testing area contains a two-way mirror, a camera, or any other device through which the test can be observed,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida81c2818-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/2/C/ii"><num value="ii">(ii)</num><content> whether any other device, including any device for recording or monitoring the test, will be used, or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida81c2819-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/2/C/iii"><num value="iii">(iii)</num><content> that the employer or the examinee may (with mutual knowledge) make a recording of the test;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida81c281a-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/2/D"><num value="D">(D)</num><chapeau> is read and signs a written notice informing such examinee—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida81c281b-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/2/D/i"><num value="i">(i)</num><content> that the examinee cannot be required to take the test as a condition of employment,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida81c281c-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/2/D/ii"><num value="ii">(ii)</num><content> that any statement made during the test may constitute additional supporting evidence for the purposes of an adverse employment action described in subsection (a),</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida81c4f2d-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/2/D/iii"><num value="iii">(iii)</num><content> of the limitations imposed under this section,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida81c4f2e-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/2/D/iv"><num value="iv">(iv)</num><content> of the legal rights and remedies available to the examinee if the polygraph test is not conducted in accordance with this chapter, and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida81c4f2f-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/2/D/v"><num value="v">(v)</num><content> of the legal rights and remedies of the employer under this chapter (including the rights of the employer under <ref href="/us/usc/t29/s2008/c/2">section 2008(c)(2) of this title</ref>); and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida81c4f30-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/2/E"><num value="E">(E)</num><content> is provided an opportunity to review all questions to be asked during the test and is informed of the right to terminate the test at any time.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida81c4f31-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Actual testing phase</heading><content><p style="-uslm-lc:I12" class="indent1">During the actual testing phase, the examiner does not ask such examinee any question relevant during the test that was not presented in writing for review to such examinee before the test.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida81c4f32-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Post-test phase</heading><chapeau>Before any adverse employment action, the employer shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida81c4f33-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/4/A"><num value="A">(A)</num><content> further interview the examinee on the basis of the results of the test; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida81c4f34-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/4/B"><num value="B">(B)</num><chapeau> provide the examinee with—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida81c4f35-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/4/B/i"><num value="i">(i)</num><content> a written copy of any opinion or conclusion rendered as a result of the test, and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida81c4f36-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/4/B/ii"><num value="ii">(ii)</num><content> a copy of the questions asked during the test along with the corresponding charted responses.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida81c4f37-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/b/5"><num value="5" class="bold">(5)</num><heading class="bold"> Maximum number and minimum duration of tests</heading><content><p style="-uslm-lc:I12" class="indent1">The examiner shall not conduct and complete more than five polygraph tests on a calendar day on which the test is given, and shall not conduct any such test for less than a 90-minute duration.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida81c4f38-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/c"><num value="c" class="bold">(c)</num><heading class="bold"> Qualifications and requirements of examiners</heading><chapeau>The exemptions provided under subsections (d), (e), and (f) of <ref href="/us/usc/t29/s2006">section 2006 of this title</ref> shall not apply unless the individual who conducts the polygraph test satisfies the requirements under the following paragraphs:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida81c4f39-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Qualifications</heading><chapeau>The examiner—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida81c4f3a-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/c/1/A"><num value="A">(A)</num><content> has a valid and current license granted by licensing and regulatory authorities in the State in which the test is to be conducted, if so required by the State; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida81c4f3b-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/c/1/B"><num value="B">(B)</num><content> maintains a minimum of a $50,000 bond or an equivalent amount of professional liability coverage.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida81c764c-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Requirements</heading><chapeau>The examiner—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida81c764d-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/c/2/A"><num value="A">(A)</num><chapeau> renders any opinion or conclusion regarding the test—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida81c764e-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/c/2/A/i"><num value="i">(i)</num><content> in writing and solely on the basis of an analysis of polygraph test charts,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida81c764f-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/c/2/A/ii"><num value="ii">(ii)</num><content> that does not contain information other than admissions, information, case facts, and interpretation of the charts relevant to the purpose and stated objectives of the test, and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida81c7650-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/c/2/A/iii"><num value="iii">(iii)</num><content> that does not include any recommendation concerning the employment of the examinee; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida81c7651-e9c4-11e9-801d-f959d54be0ff" identifier="/us/usc/t29/s2007/c/2/B"><num value="B">(B)</num><content> maintains all opinions, reports, charts, written questions, lists, and other records relating to the test for a minimum period of 3 years after administration of the test.</content>
