<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id2cabc688-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s751"><num value="751">§ 751.</num><heading> Data sharing</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2cabc689-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s751/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2cabc68a-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s751/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Memorandum of understanding</heading><chapeau>The Secretary of Education and the Secretary of Health and Human Services shall enter into a memorandum of understanding for the purposes of exchanging data of mutual importance—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id2cabc68b-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s751/a/1/A"><num value="A">(A)</num><content> that concern clients of designated State agencies; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2cabc68c-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s751/a/1/B"><num value="B">(B)</num><chapeau> that are data maintained either by—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id2cabc68d-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s751/a/1/B/i"><num value="i">(i)</num><content> the Rehabilitation Services Administration, as required by <ref href="/us/usc/t29/s710">section 710 of this title</ref>; or</content>

<clause style="-uslm-lc:I14" class="indent3" id="id2cabc68e-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s751/a/1/B/ii"><num value="ii">(ii)</num><content> the Social Security Administration, from its Summary Earnings and Records and Master Beneficiary Records.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2cabc68f-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s751/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Employment statistics</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary of Labor shall provide the Commissioner with employment statistics specified in section 49<i>l</i>–2 of this title, that facilitate evaluation by the Commissioner of the program carried out under part B of this subchapter, and allow the Commissioner to compare the progress of individuals with disabilities who are assisted under the program in securing, retaining, regaining, and advancing in employment with the progress made by individuals who are assisted under title I of the Workforce Investment Act of 1998 [<ref href="/us/usc/t29/s2801">29 U.S.C. 2801</ref> et seq.].</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2cabc690-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s751/b"><num value="b" class="bold">(b)</num><heading class="bold"> Treatment of information</heading><content><p style="-uslm-lc:I11" class="indent0">For purposes of the exchange described in subsection (a)(1) of this section, the data described in subsection (a)(1)(B)(ii) of this section shall not be considered return information (as defined in <ref href="/us/usc/t26/s6103/b/2">section 6103(b)(2) of title 26</ref>) and, as appropriate, the confidentiality of all client information shall be maintained by the Rehabilitation Services Administration and the Social Security Administration.</p>
