<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id2cb563af-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s765"><num value="765">§ 765.</num><heading> Rehabilitation Research Advisory Council</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2cb563b0-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s765/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I11" class="indent0">Subject to the availability of appropriations, the Secretary shall establish in the Department of Education a Rehabilitation Research Advisory Council (referred to in this section as the “Council”) composed of 12 members appointed by the Secretary.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2cb563b1-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s765/b"><num value="b" class="bold">(b)</num><heading class="bold"> Duties</heading><content><p style="-uslm-lc:I11" class="indent0">The Council shall advise the Director with respect to research priorities and the development and revision of the 5-year plan required by <ref href="/us/usc/t29/s762/h">section 762(h) of this title</ref>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2cb563b2-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s765/c"><num value="c" class="bold">(c)</num><heading class="bold"> Qualifications</heading><content><p style="-uslm-lc:I11" class="indent0">Members of the Council shall be generally representative of the community of rehabilitation professionals, the community of rehabilitation researchers, the community of individuals with disabilities, and the individuals’ representatives. At least one-half of the members shall be individuals with disabilities or the individuals’ representatives.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2cb563b3-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s765/d"><num value="d" class="bold">(d)</num><heading class="bold"> Terms of appointment</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2cb563b4-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s765/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Length of term</heading><chapeau>Each member of the Council shall serve for a term of up to 3 years, determined by the Secretary, except that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id2cb563b5-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s765/d/1/A"><num value="A">(A)</num><content> a member appointed to fill a vacancy occurring prior to the expiration of the term for which a predecessor was appointed, shall be appointed for the remainder of such term; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2cb563b6-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s765/d/1/B"><num value="B">(B)</num><content> the terms of service of the members initially appointed shall be (as specified by the Secretary) for such fewer number of years as will provide for the expiration of terms on a staggered basis.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2cb563b7-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s765/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Number of terms</heading><content><p style="-uslm-lc:I12" class="indent1">No member of the Council may serve more than two consecutive full terms. Members may serve after the expiration of their terms until their successors have taken office.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2cb563b8-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s765/e"><num value="e" class="bold">(e)</num><heading class="bold"> Vacancies</heading><content><p style="-uslm-lc:I11" class="indent0">Any vacancy occurring in the membership of the Council shall be filled in the same manner as the original appointment for the position being vacated. The vacancy shall not affect the power of the remaining members to execute the duties of the Council.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2cb563b9-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s765/f"><num value="f" class="bold">(f)</num><heading class="bold"> Payment and expenses</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2cb563ba-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s765/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> Payment</heading><content><p style="-uslm-lc:I12" class="indent1">Each member of the Council who is not an officer or full-time employee of the Federal Government shall receive a payment of $150 for each day (including travel time) during which the member is engaged in the performance of duties for the Council. All members of the Council who are officers or full-time employees of the United States shall serve without compensation in addition to compensation received for their services as officers or employees of the United States.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2cb563bb-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s765/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Travel expenses</heading><content><p style="-uslm-lc:I12" class="indent1">Each member of the Council may receive travel expenses, including per diem in lieu of subsistence, as authorized by <ref href="/us/usc/t5/s5703">section 5703 of title 5</ref> for employees serving intermittently in the Government service, for each day the member is engaged in the performance of duties away from the home or regular place of business of the member.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2cb563bc-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s765/g"><num value="g" class="bold">(g)</num><heading class="bold"> Detail of Federal employees</heading><content><p style="-uslm-lc:I11" class="indent0">On the request of the Council, the Secretary may detail, with or without reimbursement, any of the personnel of the Department of Education to the Council to assist the Council in carrying out its duties. Any detail shall not interrupt or otherwise affect the civil service status or privileges of the Federal employee.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2cb563bd-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s765/h"><num value="h" class="bold">(h)</num><heading class="bold"> Technical assistance</heading><content><p style="-uslm-lc:I11" class="indent0">On the request of the Council, the Secretary shall provide such technical assistance to the Council as the Council determines to be necessary to carry out its duties.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2cb563be-56ae-11e3-a47c-a1431db9a670" identifier="/us/usc/t29/s765/i"><num value="i" class="bold">(i)</num><heading class="bold"> Termination</heading><content><p style="-uslm-lc:I11" class="indent0">Section 14 of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply with respect to the Council.</p>
