<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id91925413-0381-11e7-b7dc-8ca5f1de100c" identifier="/us/usc/t3/s113"><num value="113">§ 113.</num><heading> Personnel report</heading><subsection style="-uslm-lc:I11" class="indent0" id="id91925414-0381-11e7-b7dc-8ca5f1de100c" identifier="/us/usc/t3/s113/a"><num value="a">(a)</num><content> The President shall transmit to each House of the Congress, and make available to the public, reports containing information described in subsection (b) for each fiscal year beginning on or after the effective date of this section. Each such report shall be transmitted no later than 60 days after the close of the fiscal year covered by such report and shall contain a statement of such information for such year.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id91925415-0381-11e7-b7dc-8ca5f1de100c" identifier="/us/usc/t3/s113/b"><num value="b">(b)</num><chapeau> Each report required under subsection (a) shall contain—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id91925416-0381-11e7-b7dc-8ca5f1de100c" identifier="/us/usc/t3/s113/b/1"><num value="1">(1)</num><content> the number of employees who are paid at a rate of basic pay equal to or greater than the rate of basic pay then currently paid for level V of the Executive Schedule of <ref href="/us/usc/t5/s5316">section 5316 of title 5</ref> and who are employed in the White House Office, the Executive Residence at the White House, the Office of the Vice President, the Domestic Policy Staff, or the Office of Administration, and the aggregate amount paid to such employees;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91925417-0381-11e7-b7dc-8ca5f1de100c" identifier="/us/usc/t3/s113/b/2"><num value="2">(2)</num><content> the number of employees employed in such offices who are paid at a rate of basic pay which is equal to or greater than the minimum rate of basic pay then currently paid for GS–16 of the General Schedule of <ref href="/us/usc/t5/s5332">section 5332 of title 5</ref> but which is less than the rate then currently paid for level V of the Executive Schedule of section 5316 of title V <ref class="footnoteRef" idref="fn002006">1</ref><note type="footnote" id="fn002006"><num>1</num> So in original. Probably should be title “5”.</note> and the aggregate amount paid to such employees;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91925418-0381-11e7-b7dc-8ca5f1de100c" identifier="/us/usc/t3/s113/b/3"><num value="3">(3)</num><content> the number of employees employed in such offices who are paid at a rate of basic pay which is less than the minimum rate then currently paid for GS–16 of the General Schedule of section 5332 of title V <sup>1</sup>, and the aggregate amount paid to such employees;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91925419-0381-11e7-b7dc-8ca5f1de100c" identifier="/us/usc/t3/s113/b/4"><num value="4">(4)</num><content> the number of individuals detailed under <ref href="/us/usc/t3/s112">section 112 of this title</ref> for more than 30 days to each such office, the number of days in excess of 30 each individual was detailed, and the aggregate amount of reimbursement made as provided by the provisions of <ref href="/us/usc/t3/s112">section 112 of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9192541a-0381-11e7-b7dc-8ca5f1de100c" identifier="/us/usc/t3/s113/b/5"><num value="5">(5)</num><content> the number of individuals whose services as experts or consultants are procured under this chapter for service in any such office, the total number of days employed, and the aggregate amount paid to procure such services.</content>
</paragraph>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><chapeau> with regard to each individual described in paragraph (1), the individual’s—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> name;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> position and title; and</content>

</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Exclusion From Report</inline>.—</heading><chapeau>If the President determines that disclosure of any item of information described in subsection (b) with respect to any particular individual would not be in the interest of the national defense or foreign policy of the United States—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><chapeau> a report under subsection (a) shall—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> exclude such information with respect to that individual; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> include a statement of the number of individuals with respect to whom such information has been excluded; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> at the request of the Committee on Governmental Affairs [now Committee on Homeland Security and Governmental Affairs] of the Senate or the Committee on Government Operations of the House of Representatives, the information that was excluded from the report shall be made available for inspection by such committee.”</content>
