<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id3f740924-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s401"><num value="401">§ 401.</num><heading> Definitions</heading><subsection style="-uslm-lc:I11" class="indent0" id="id3f740925-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s401/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><chapeau>Except as otherwise specifically provided in this chapter, as used in this chapter:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3f740926-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s401/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">Board</inline>.—</heading><content>The term “Board” means the Merit Systems Protection Board under chapter 12 of title 5.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id3f740927-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s401/a/2"><num value="2">(2)</num><heading> <inline class="small-caps">Covered employee</inline>.—</heading><content>The term “covered employee” means any employee of an employing office.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3f740928-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s401/a/3"><num value="3">(3)</num><heading> <inline class="small-caps">Employee</inline>.—</heading><content>The term “employee” includes an applicant for employment and a former employee.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id3f740929-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s401/a/4"><num value="4">(4)</num><heading> <inline class="small-caps">Employing office</inline>.—</heading><chapeau>The term “employing office” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3f74092a-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s401/a/4/A"><num value="A">(A)</num><content> each office, agency, or other component of the Executive Office of the President;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3f74092b-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s401/a/4/B"><num value="B">(B)</num><content> the Executive Residence at the White House; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3f74092c-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s401/a/4/C"><num value="C">(C)</num><content> the official residence (temporary or otherwise) of the Vice President.</content>

</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3f74092d-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s401/b"><num value="b">(b)</num><heading> <inline class="small-caps">Definitions Relating to Certain Matters</inline>.—</heading><chapeau>For purposes of applying this chapter with respect to any practice or other matter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3f74092e-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s401/b/1"><num value="1">(1)</num><content> to which section 411 relates, the terms “employing office” and “covered employee” shall each be considered to have the meaning given to the term by such section;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3f74092f-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s401/b/2"><num value="2">(2)</num><content> to which section 412 relates, the term “covered employee” means a covered employee described in section 412(a)(2)(B);</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id3f740930-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s401/b/3"><num value="3">(3)</num><content> to which section 413 relates, the term “covered employee” excludes interns and volunteers, as described in section 413(a)(2); and</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id3f740931-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s401/b/4"><num value="4">(4)</num><content> to which section 416 relates, the term “covered employee” means a covered employee described in section 416(a)(2).</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><content>Each provision of Federal law that is made applicable to the legislative branch under section 102 of the Congressional Accountability Act of 1995 (<ref href="/us/usc/t2/s1302">2 U.S.C. 1302</ref>), and that is enacted later than 12 months after the date of the enactment of this Act [<date date="1996-10-26">Oct. 26, 1996</date>], shall be deemed to apply with respect to ‘employing offices’ and ‘covered employees’ (within the meaning of <ref href="/us/usc/t3/s401">section 401 of title 3</ref>, United States Code, as added by this Act), unless such law specifically provides otherwise and expressly cites this section.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> Regulations.—</heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The President, or the designee of the President, shall issue regulations to implement such provision.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Agency regulations</inline>.—</heading><content>The regulations issued under paragraph (1) to implement a provision shall be the same as substantive regulations promulgated by the head of the appropriate executive agency to implement the provision, except to the extent that the President or designee may determine, for good cause shown and stated together with the regulation, that a modification of such regulations would be more effective for the implementation of the rights and protections under the section.”</content>
