<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idedec71be-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412"><num value="412">§ 412.</num><heading> Rights and protections under the Family and Medical Leave Act of 1993</heading><subsection style="-uslm-lc:I11" class="indent0" id="idedec71bf-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/a"><num value="a">(a)</num><heading> <inline class="small-caps">Family and Medical Leave Rights and Protections Provided.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idedeee2c0-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The rights and protections established by sections 101 through 105 of the Family and Medical Leave Act of 1993 shall apply to covered employees.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idedeee2c1-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/a/2"><num value="2">(2)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>For purposes of the application described in paragraph (1)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idedeee2c2-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/a/2/A"><num value="A">(A)</num><content> the term “employer” as used in the Family and Medical Leave Act of 1993 means any employing office; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idedeee2c3-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/a/2/B"><num value="B">(B)</num><content> the term “eligible employee” as used in the Family and Medical Leave Act of 1993 means a covered employee who has been employed in any employing office for 12 months and for at least 1,250 hours of employment during the previous 12 months.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idedeee2c4-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/a/3"><num value="3">(3)</num><heading> <inline class="small-caps">Exception</inline>.—</heading><content>Notwithstanding section 401(b)(2), the requirements of paragraph (2)(B) shall not apply with respect to leave under subparagraph (A) or (B) of section 102(a)(1) of the Family and Medical Leave Act of 1993 (<ref href="/us/usc/t29/s2612/a/1">29 U.S.C. 2612(a)(1)</ref>).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idedeee2c5-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/b"><num value="b">(b)</num><heading> <inline class="small-caps">Remedy</inline>.—</heading><content>The remedy for a violation of subsection (a) shall be such remedy, including liquidated damages, as would be appropriate if awarded under paragraph (1) of section 107(a) of the Family and Medical Leave Act of 1993.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idedeee2c6-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/c"><num value="c">(c)</num><heading> <inline class="small-caps">Special Rules for Substitution of Paid Leave.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idedeee2c7-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">Substitution of paid leave</inline>.—</heading><content>A covered employee may elect to substitute for any leave without pay under subparagraph (A) or (B) of section 102(a)(1) of the Family and Medical Leave Act of 1993 (<ref href="/us/usc/t29/s2612/a/1">29 U.S.C. 2612(a)(1)</ref>) any paid leave which is available to such employee for that purpose.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idedeee2c8-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">Available leave</inline>.—</heading><content>The paid leave that is available to a covered employee for purposes of paragraph (1) is leave of the type and in the amount available to an employee under <ref href="/us/usc/t5/s6382/d/2/B">section 6382(d)(2)(B) of title 5</ref>, United States Code, for substitution for leave without pay under subparagraph (A) or (B) of section 6382(a)(1) of such title.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idedeee2c9-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/c/3"><num value="3">(3)</num><heading> <inline class="small-caps">Consistency with title 5</inline>.—</heading><content>Paid leave shall be substituted under this subsection in a manner that is consistent with the requirements in <ref href="/us/usc/t5/s6382/d/2">section 6382(d)(2) of title 5</ref>, United States Code, except that a reference in that section to an employing agency shall be considered to be a reference to an employing office, and subparagraph (E) of that section shall not apply.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idedeee2ca-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/d"><num value="d">(d)</num><heading> <inline class="small-caps">Regulations To Implement Section.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idedeee2cb-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/d/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The President, or the designee of the President, shall issue regulations to implement this section.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idedeee2cc-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/d/2"><num value="2">(2)</num><heading> <inline class="small-caps">Agency regulations</inline>.—</heading><chapeau>The regulations issued under paragraph (1) shall be the same as substantive regulations promulgated by the Secretary of Labor to implement the statutory provisions referred to in subsections (a) and (b)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idedeee2cd-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/d/2/A"><num value="A">(A)</num><content> except to the extent that the President or designee may determine, for good cause shown and stated together with the regulation, that a modification of such regulations would be more effective for the implementation of the rights and protections under this section;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idedeee2ce-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/d/2/B"><num value="B">(B)</num><chapeau> except that the President or designee may, at the discretion of the President or designee, issue regulations to implement a provision of subchapter V of chapter 63 of title 5, United States Code, that applies to employees in the executive branch of the Federal Government in lieu of an analogous statutory provision referred to in subsection (a) or (b), if the issuance of such regulations—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idedeee2cf-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/d/2/B/i"><num value="i">(i)</num><content> would be equally effective for the implementation of the rights and protections under this section; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idedeee2d0-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/d/2/B/ii"><num value="ii">(ii)</num><content> would promote uniformity in the application of Federal law to employees in the executive branch of the Federal Government; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idedeee2d1-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/d/2/C"><num value="C">(C)</num><content> except that the President or designee shall issue regulations to implement subsection (c) in accordance with the requirements of that subsection.</content>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idedeee2d2-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/e"><num value="e">(e)</num><heading> <inline class="small-caps">Effective Date</inline>.—</heading><chapeau>Subsections (a) and (b) shall take effect on the earlier of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idedeee2d3-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/e/1"><num value="1">(1)</num><content> the effective date of regulations issued under subsection (c) (as in effect on the date of enactment of the Presidential and Executive Office Accountability Act); or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idedeee2d4-496a-11ed-af19-f4a7762a2316" identifier="/us/usc/t3/s412/e/2"><num value="2">(2)</num><content> <date date="1998-10-01">October 1, 1998</date>.</content>
