<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id3f78c38d-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s415"><num value="415">§ 415.</num><heading> Rights and protections under the Worker Adjustment and Retraining Notification Act</heading><subsection style="-uslm-lc:I11" class="indent0" id="id3f78c38e-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s415/a"><num value="a">(a)</num><heading> Worker Adjustment and Retraining Notification Rights.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3f78c38f-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s415/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Except as provided in paragraph (2), no employing office shall be closed or mass layoff ordered within the meaning of section 3 of the Worker Adjustment and Retraining Notification Act until the end of a 60-day period after the employing office serves written notice of such prospective closing or layoff to representatives of covered employees or, if there are no representatives, to covered employees.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3f78c390-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s415/a/2"><num value="2">(2)</num><heading> Exception.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id3f78c391-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s415/a/2/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>In the event that a President (hereinafter in this paragraph referred to as the “previous President”) is not elected to a successive term in office as a result of the election of a new President—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3f78c392-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s415/a/2/A/i"><num value="i">(i)</num><content> no notice or waiting period shall be required under paragraph (1) with respect to the separation of any individual described in subparagraph (B), if such separation occurs pursuant to a closure or mass layoff ordered after the term of the new President commences; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3f78c393-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s415/a/2/A/ii"><num value="ii">(ii)</num><content> if any individual is separated from service, or begins a period of leave under the Family and Medical Leave Act of 1993, before such term commences, nothing in this chapter shall require reinstatement or restoration to employment of the individual after such term commences.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3f78c394-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s415/a/2/B"><num value="B">(B)</num><heading> <inline class="small-caps">Description of individuals</inline>.—</heading><chapeau>An individual described in this subparagraph is any covered employee serving pursuant to an appointment made during—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3f78c395-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s415/a/2/B/i"><num value="i">(i)</num><content> the term of office of the previous President; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3f78c396-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s415/a/2/B/ii"><num value="ii">(ii)</num><content> any term, earlier than the term referred to in clause (i), during which such previous President served as President or Vice President.</content>

</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3f78c397-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s415/b"><num value="b">(b)</num><heading> <inline class="small-caps">Remedy</inline>.—</heading><content>The remedy for a violation of subsection (a) shall be such damages as would be appropriate if awarded under paragraphs (1), (2), and (4) of section 5(a) of the Worker Adjustment and Retraining Notification Act.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3f78c398-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s415/c"><num value="c">(c)</num><heading> Regulations To Implement Section.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3f78c399-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s415/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The President, or the designee of the President, shall issue regulations to implement this section.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3f78c39a-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s415/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">Agency regulations</inline>.—</heading><content>The regulations issued under paragraph (1) shall be the same as substantive regulations promulgated by the Secretary of Labor to implement the statutory provisions referred to in subsections (a) and (b) except to the extent that the President or designee may determine, for good cause shown and stated together with the regulation, that a modification of such regulations would be more effective for the implementation of the rights and protections under this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3f78c39b-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s415/d"><num value="d">(d)</num><heading> <inline class="small-caps">Effective Date</inline>.—</heading><chapeau>Subsections (a) and (b) shall take effect on the earlier of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3f78c39c-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s415/d/1"><num value="1">(1)</num><content> the effective date of regulations issued under subsection (c); or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3f78c39d-2e14-11e4-bc4f-a8600e36c151" identifier="/us/usc/t3/s415/d/2"><num value="2">(2)</num><content> <date date="1998-10-01">October 1, 1998</date>.</content>
